Full 2026 rankings, city guides, and red-flag checks: Business Cash Advance Settlement.
No published ranking can evaluate a Jacksonville funding dispute, because the measure that matters arrived as paper, not as reputation.
In 2023 Florida added commercial financing disclosures to chapter 559, and the Florida commercial financing disclosure statute now dictates what paper a provider must deliver at or before consummation. The ledger behind the advertisement is where counsel begins.
Before the signature dried, before the first debit tested the payment schedule, the owner held disclosure rights the closing call never mentioned.
In 2023 the legislature imposed a written disclosure duty on providers that consummate commercial financing transactions. The disclosure must arrive at or before consummation, only one is required for each transaction, and no fresh disclosure follows a modification, forbearance or change to a consummated deal.
The contents are extremely precise, and they accumulate into a picture no advertisement supplies: the total funds provided, the total disbursed where fees, prior balances or third party payments reduce it, the total to be paid, the total dollar cost as the difference between provided and payable, the manner, frequency and amount of each payment with methodology and variation circumstances where payments may vary, and any prepayment costs or discounts with a reference to the agreement provision that creates them.
The disclosure arrives once.
Rarely does a modification trigger a fresh disclosure, and counsel should assemble and preserve the original package before discussing any balance, since a provider that understated cost at closing seldom states it with precision at settlement. For facilities the statute permits a disclosure built on an example transaction with an accounts receivable face amount of $10,000, and that example sits in the package like a showroom sample tile: exact in itself, silent about the floor.
The statute commands transparency. It delivers paper. Most funders complied on paper before their borrowers learned to read it, and whether Florida courts will treat these disclosures as evidence of true cost or as mere paperwork is a question worth leaving open (the MCA coverage debate sits outside the inspected section, and counsel must confirm scope, timing, and what remedy follows a violation per file).
Disclosure paper classifies nothing by itself. New York courts test funding agreements by substance, weighing reconciliation practice, finite term, and whether the merchant retained any recourse in bankruptcy, and the Second Department decision in LG Funding supplies the questions even where its authority does not govern.
The agreement called itself a purchase (which defenders of the industry will call proof of a true purchase). The debits behaved as installments.
Counsel should test and confirm each factor against the Jacksonville file first. The disclosure states what the provider claimed. The debits show what the merchant paid. Ask for the disclosure before discussing the balance. Most owners do the reverse, for ordinary reasons.
Settlement documentation decides what survives the payment. The release should name the parties, the covered agreements and each guarantor whose liability the payment retires, with fees, costs and notice provisions stated in the same text.
Counsel should compare and reconcile the payoff figures with the disclosure figures before signing, and any security interest the funder asserted should end in a filed termination with copies delivered to the owner. The sample behind that observation is small, and I state it as impression rather than finding.
A release that incorporates summaries from correspondence instead of stating its scope invites the dispute it was purchased to end.
Material connections behind endorsements should be disclosed. The FTC guidance on endorsements and compensation states the duty, and referral revenue never proves a provider is best.
The disclosure page, where one exists, deserves more attention than the order of names.
The ranking stays online.
Steps an owner takes, or does not take, in the weeks after default determine whether the disclosure becomes an instrument. Counsel selection decides the outcome more than any single clause, and the evaluation starts with extremely brief questions about documents. Promises about discounts answer none of them.
Independent counsel should ensure each guarantor appears by name in the release. The owner should ensure payments flow through channels the agreement names. Resist the urge to answer the collector, and simply state that counsel will respond to the claims asserted against the business, even briefly worded demands slipped into email.
This counsel must build from the documents, not from the directory. Delancey Street, a debt relief company rather than a law firm, offers a free confidential initial review for MCA distress and coordinates legal matters with independently licensed counsel, and a Jacksonville owner can seek that review through Delancey Street as the beginning of a diagnosis.
The disclosure delivered at consummation outlasts the advertisement that preceded it, and the ledger assembled from that paper decides the settlement long after the ranking has faded. Owners who read the package before negotiating the balance keep an advantage no placement can sell, despite a wobbly confidence in advertised outcomes that often explains the wait, since agreements of this kind are drafted in order to survive exactly this scrutiny.
Most funders accept 30–60% as a full settlement — with proper leverage.
