Full 2026 rankings, city guides, and red-flag checks: Business Cash Advance Settlement.

A Miami merchant served with New York papers has lost the only argument that felt obvious, because the caption on the judgment matters less than what Florida permits to cross the state line.

The defense now concerns procedure rather than outrage: whether the paper is a confession that Florida voids, a judgment that Florida may record, or a claim that still requires a lawsuit.

Under longstanding Florida law, pre action powers of attorney to confess judgment are absolutely null and void, and the voidness rule for confession instruments supplies the first fixed point before advocacy begins.

Confession Instruments That Florida Will Not Honor

Section 55.05 declares all powers of attorney for confessing judgment, made before action brought, absolutely null and void. A funder holding a New York confession signed with the funding documents cannot enter it in Florida as a confession. The creditor must domesticate an entered judgment or file a new action, and the distinction controls the calendar.

The instrument may satisfy every formality of the state where it was signed. Florida still treats the pre suit confession power as void. Counsel should place the funding file beside the enforcement paper and ask which of the two the creditor actually holds, because collection letters tend to blur a confession into a judgment in order to obtain payment without a forum.

The funding file ran to nineteen pages, of which two decided anything. The creditor, if we are being precise, holds paper rather than a judgment, and paper must become a judgment before any clerk can record it.

Most owners learn this distinction after the funds are already held.

The file begins with the instrument, not with the amount.

Recording, Notice and the Thirty Day Bar

A sister state judgment entitled to full faith and credit may be recorded with any county circuit clerk upon a certified copy, and the recorded judgment then carries Florida judgment effect for enforcement, defenses, and reopening, vacatur, or stay.

The clerk handles the notice task in the routine manner of such offices. At the time of recording the creditor records an affidavit with the debtor name, social security number if known, and last known address, and the clerk mails notice of the recording by registered mail with return receipt requested, then dockets the mailing, while the creditor may also mail notice and record proof of mailing to cure a clerk failure.

No execution or other process issues until thirty days after the mailing of notice by the clerk, and no lien arises until thirty days after that mailing, which means counsel can review and analyze the judgment, the affidavit, and the notice before enforcement begins, though whether every clerk dockets the mailing on the same day is a question I cannot answer from this desk.

Filing the contest authorized by statute stays both the enforcement and the lien provisions, so the thirty days function as a window for assessment, and counsel uses them to test jurisdiction, identity of parties, and satisfaction before the judgment hardens into a lien.

Thirty days pass before a lien attaches.

The Dade County Intake Counter

On an ordinary weekday morning the Dade County clerk receives the certified copy with a plain copy beside it. The creditor files an original affidavit and a copy with debtor and creditor particulars and the attorney name, address, number, and bar number.

The amount of the judgment determines the division that receives the filing. Recording fees follow the number of pages, with the judgment and the affidavit treated as separate documents, and postage covers the registered mailing to each debtor named in the affidavit.

Upon receipt the clerk records the documents and mails the notice, and the submitting attorney receives a courtesy copy indicating that the judgment may be contested before becoming a lien. Writs issue afterward upon proper forms. Why the notice still travels by registered mail in an age of electronic dockets is a question the statute does not pause to answer.

A servicing office based, if I recall, near the river sends these packets every week.

The Ranking as Paid Placement

Federal endorsement guidance requires clear disclosure where a material relationship colors a recommendation, and the endorsement guidance on material connections treats visibility as a fact about marketing rather than a measure of suitability.

Placement is purchased. Competence is demonstrated.

Choosing Counsel and Settlement Help in Miami

Rarely does a docket reward the merchant who shops for counsel by star count. The advocate who reads the confession clause and the guaranty before quoting a fee has already performed the only ranking that matters.

Competent counsel will test whether the paper is void confession or domesticated judgment, calendar the thirty day contest window, and construct a response that addresses the affidavit and the operating needs of the business, since steps the owner takes, or does not take, in the days after service determine the shape of that response.

The merchant should resist the urge to call the collector to explain the revenue decline, even casually, and should simply ask counsel what forum the clause requires before signing anything sent over after service.

This is where an outside assessment earns its place. Delancey Street, a debt relief company rather than a law firm, offers a free confidential initial review for MCA distress and coordinates legal matters with independently licensed counsel, and a Miami merchant can request that assessment through Delancey Street while the contest window remains open.

A confession void in Florida still frightens the owner who receives it with a New York caption. Fear collects debts that procedure would not permit.

The objective throughout is to ensure no deadline passes without response, and to ensure the guaranty receives extremely close attention before any stipulation bears the owner signature, since enforcement moves extremely fast after the thirty days.

The notice and timing rules for recorded foreign judgments and the Dade County intake practice for foreign judgments fix the steps the creditor must take before a lien exists. The question was never which name stood highest on a list. The question was which paper the law of this state would honor, and that question belongs to counsel, the clerk, and the file.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
