The operating balance becomes the creditor’s property when the statutory conditions align, and the owner learns of it after the bank has taken direction from the papers.

In the early weeks of January, while prior year payables crowd the ledger, an execution can arrive without a call or a warning letter. The statute names the recipient garnishee. The owner knows it as the bank.

Execution Issuance and Direction

The execution provisions permit issuance before satisfaction or vacatur, from the court in the county of docketing, by the clerk or by the creditor’s attorney as officer of the court. The execution runs to the sheriffs of one or more counties with direction to satisfy the judgment from the debtor’s property and the debts owed to that debtor.

The form carries the entry date, the court, the amount, interest terms where applicable, and the names for and against whom judgment was entered. It directs levy and sale of only the named debtor’s property, and it states that debtor’s last known address.

Levy by Service on the Bank

Levy upon personal property reaches bank balances through service of a copy of the execution upon the garnishee in the same manner as a summons. The levy takes effect where the bank owes the debtor a debt at service, holds property in which the debtor has a known or believed interest, or received a notice specifying the debt or the property.

Once served, the bank must transfer the property, pay matured debts, and execute the transfer documents. You learn of the levy when the transfer fails. Counsel should confirm which officer holds the execution for the court and county involved.

The Ninety Day Reach

The levy captures property and debts in the garnishee’s hands and those coming into its possession or coming due, including specified items, until transfer or payment, ninety days after service, or a served court order setting further time, whichever first occurs. During that window the bank may transfer covered property or debts to no one but the sheriff, except upon the sheriff’s direction or court order.

After ninety days the levy stands void except for property or debts transferred or paid and matters with a pending turnover proceeding.

Restraint Duration and Contempt

The restraining notice forbids disposal of covered property or debts to anyone but the sheriff until satisfaction, vacatur, or one year after service, whichever first occurs. The notice warns that disobedience is punishable as contempt and must specify the parties, entry date and court, and the judgment amount with the sum then due.

A creditor naming a stranger’s property bears the resulting damages (a discipline worth weighing before a broad notice issues). The restraint binds property acquired and debts coming due during its life.

Seizure of Deliverable Property

Where the debtor’s interest lies in personal property capable of delivery, the sheriff levies by taking the property into custody without disturbing the lawful possession of pledgees and lessees. The sheriff then serves a copy of the execution upon the person from whose possession the property was taken.

The copy is served. The file reflects it.

Transfer and Payment Orders

Service converts the bank from depository into conduit, with no discretion over the destination of covered funds. The direction runs to the sheriff, and the transfer documents follow the funds.

This closing logic sits early: every later protection here operates as an exception to a transfer the levy otherwise commands. What remains for the debtor narrows to exemption, timing and scope, each of which depends on papers served and dates counted.

Notice to the Debtor

Where the execution does not state that notice reached the debtor within the prior year, the sheriff must mail or deliver a copy with notice to each natural person debtor within four days after garnishee service. The mailing goes to the residence, or to employment or another known address where the residence is unknown or the mail returns undeliverable, in an envelope marked personal and confidential that names neither the sheriff nor the debt.

The envelope bears no mark of its origin.

The Exemption Notice Requirement

The exemption notice and claim forms must accompany every restraint or execution touching a natural person’s bank account. The issuer provides the bank the notice, a copy, an exemption notice and two claim forms, all served together.

Failure to serve the notice and forms together with the restraint renders the restraint void, and the institution shall not restrain the account; failure on levy renders the execution void, and the institution shall not levy upon the account.

But the restraint is not self proving, and within two business days after receipt the bank must mail the debtor the copy, the notice and the forms by first class mail. An inadvertent failure by the institution here creates no liability, a distinction counsel should confirm before relying on it.

Protected Funds and Floors

Exempt personal property includes two thousand five hundred dollars of an account holding directly deposited exempt payments, and the execution must say so. Exempt Income Protection Act guidance describes the companion floor: the restraint does not reach amounts at or below two hundred forty times the greater of the federal or state minimum wage, subject to a court review exception.

Income execution caps installments at ten percent within the section’s thirty times and twenty five percent formulas. These protections, if we are being precise, shelter the natural person rather than the entity, and business operating accounts face a thinner shield turning on fund sources and timely claims. In most files we have seen, though the sample is not scientific, the commingled account presents the hardest tracing problem.

Judgment as Prerequisite

None of this machinery moves before judgment. No prejudgment restraint of a business account appears in these captures, and execution issues only upon an entered judgment or order. Whether the gate protects debtors or merely orders the docket is a question worth considering.

The execution reaches the property of the named debtor and the debts owed to that debtor, and nothing else. Delancey Street is a settlement company, not a law firm. FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
