A threat shouted into voicemail carries the same volume as a threat printed on court letterhead. The weight is a different matter, and it is measured in documents.

The claims below are questions for examining a communication, not a census of collector scripts and not a scorecard dividing every threat into harmless and enforceable. The agreement, the forum, and the stage of proceedings determine what requires a response. The call was urgent. The underlying law kept its own calendar.

A Demand That You Pay Today

A payment deadline stated by a collector can be a negotiating position, a date drawn from the agreement, or part of a proposed cure (only one of those calendars binds the owner). Rarely is a deadline stated by telephone the same date the agreement states. A payment deadline conveyed by voice is extremely easy to misremember. Ask which document establishes it and what consequence the creditor asserts will follow.

The deadline (which the collector will describe as final, though final deadlines rarely arrive by telephone) deserves a request for the demand in writing, read and compared with the contract. Do not mistake a voice on the telephone for a court order. If the business can offer a payment, assess what that payment obtains.

A Claim That Negotiation Stops Every Proceeding

A discussion about settlement does not establish that the creditor has agreed to suspend litigation or enforcement. Obtain the terms of any suspension in writing. Delancey Street can assess MCA settlement options, while independent counsel addresses pending legal process. The company is a settlement provider rather than a law firm representing the owner in a case.

Ask the provider to ensure that the proposed arrangement identifies the collection activity being addressed. Counsel should ensure that actual response deadlines remain covered until an effective extension or other relief exists. The creditor’s willingness to listen does not answer what must be filed.

An Assertion That Every Bank Account Is Available

New York CPLR 5222 illustrates a genuine judgment enforcement tool: a restraining notice affecting property or debts under the statute’s requirements, where the scope depends on the debtor’s interest, the recipient’s position, and the applicable protections. A claim that all accounts are available ignores questions of ownership and exemptions. An account belonging to an entity requires a different analysis from a natural person’s account.

Suppose the notice lists a balance of $41,208 against an agreement the owner remembers as half that size. Keep records showing the source of deposits, since a freeze does not prove that every dollar can be paid to the creditor. The freeze lands like a held breath: everything continues except the money.

For a natural person whose bank account is restrained, New York CPLR 5222-A provides a specified exemption notice and claim process, subject to its requirements and exceptions. Whether any portion qualifies as exempt is a question the packet, not this article, must answer. An LLC should not assume that this natural person procedure applies to its operating account.

The freeze notice named an account the owner had closed in March.

In our experience the exemption packet repays an early arrival; the clerk’s window keeps morning hours. Collectors who describe every remedy as available understand that most owners will not check. What the account holds, or held when the notice arrived, are questions for the documents, and ownership and source should be examined before anyone accepts a demand for settlement funded from that account.

Nobody at that number could say which agreement the balance came from.

A Statement That Inventory Can Be Removed

Under New York UCC 9-609, a secured party has specified rights after default, including possession of collateral through judicial process or without judicial process when it proceeds without breach of the peace. That rule requires a valid basis for treating the goods as collateral and applying the remedy. It does not establish that a caller may remove anything at the premises only because the business owes money.

Preserve ownership and security documents, and obtain legal advice about any proposed visit. A brittle confidence on the telephone proves nothing about the asserted interest or the lawful method of enforcement. Counsel will test the threat, verify the remedy, and draft the response that fits the papers rather than the volume of the call.

A Warning About Wages and an Accusation of Fraud

15 U.S.C. Section 1673 limits ordinary wage garnishment through a disposable earnings percentage and a minimum wage calculation, with specified exceptions. The federal formula caps the garnishable portion at 25 percent of disposable earnings or the amount exceeding 30 times the federal minimum wage, whichever is less. Whether the percentage cap or the minimum wage floor governs any particular paycheck is a calculation for the employer’s records and counsel, not for this page. A demand against the business does not establish personal liability or the right to direct the owner’s employer.

Counsel needs the guarantee, the judgment, and whatever enforcement papers the file holds before assessing payroll exposure. The distinction between wages and other receipts matters, so do not assume every payment to an owner receives identical protection. I have advised owners to ignore the tone and read the papers, though the tone is hard to ignore at midnight.

An accusation in a collection message does not establish a criminal charge. Anything the owner says about the underlying transaction may be used in the case against the business. Preserve the exact allegation and obtain advice about the conduct identified. The FTC announcement of its 2022 RAM Capital settlement described allegations including unfair collection practices and threats of physical violence, alongside relief against specified defendants. It shows why collection conduct can deserve scrutiny. The collector called the payment voluntary. Did the caller mean a referral, or only the sound of one?

A Promise That One Payment Ends Everything

A resolution needs written terms identifying the balance, the parties released, and the handling of collateral or proceedings. The payment receipt alone rarely answers those questions. The FTC debt collection FAQ distinguishes business debts from the consumer obligations covered by the FDCPA, so consumer validation and contact rules should not be transplanted into an MCA dispute without a basis, though that exclusion is extremely difficult to verify against any single call without counsel. That exclusion does not establish unlimited collection authority.

Simply ask what the payment settles and collect and preserve the answer in writing. Resist the urge to pay from a restrained account without advice. Any acknowledgment of the balance, even casually, can narrow the options that remain, and threats worded in order to force a same day decision deserve the slowest reading. A first review with Delancey Street can examine whether a negotiated payment is workable and what terms should accompany it, since that is the examination the threat must survive.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
