Default on a COVID EIDL loan rearranges the questions before it rearranges the remedies. The borrower who asks what happens next receives a catalog of federal powers, while the account follows a narrower path set by its status and its servicer.

The SBA page for COVID era programs describes procedures that depend on where the loan sits today. A borrower still serviced by the agency faces different options from one whose account has moved to the Treasury Department.

Current Status of the Loan

Before any forecast of consequences, the file must show whether the loan is current, past due, charged off, or transferred. The SBA loan portal carries the balance, the due dates, and the servicing actions available for the account.

Correspondence should carry the loan number in the subject line with the business name and applicant contact in the body. This is ordinary paperwork to ensure the inquiry reaches the correct file.

Arrears Measured Against the Full Balance

The sum required to cure missed installments is not the same figure as the total obligation, and the two amounts answer different questions. Counsel should establish which figure a demand states and what payment would produce.

A partial transfer sent without that answer may reduce the balance while leaving the delinquency intact. The borrower needs the applicable requirement in writing before funds move, with interest and additional amounts identified rather than assumed.

Payment Assistance While SBA Services the Account

For accounts the agency still services, SBA permits eligible COVID EIDL borrowers to reduce payments by half for six months, once in five years, on a showing of temporary difficulty. Eligibility requires current status with less than ninety days past due, an operating business, and no active bankruptcy, requested through the loan portal.

The page allowed every eligible loan to apply through the portal, with loans first approved above two hundred thousand dollars directed to COVIDEIDLServicing@sba.gov until portal access extends to them. A borrower above that line should confirm the current workflow with the agency.

Assistance does not suspend the economics of the loan. Interest continues to accrue across the reduced payment period, which increases the balloon amount due at the end of the term, and full installments resume when the six months expire. A forecast that cannot support the resumed payment has postponed the shortage without resolving it.

The account was, if precision matters, assisted rather than forgiven. Neither assistance nor charge off cancels the debt.

Referral to the Treasury Offset Program

Where payments fail under either the regular schedule or an assistance plan, the account may face referral to the Treasury Offset Program after one hundred twenty days of delinquency. Offset directs federal payments that would otherwise reach the borrower toward the delinquent balance instead. Offset is an extremely blunt instrument applied with arithmetic.

The notice arrives by mail.

Transfer to Treasury Cross-Servicing

Loans that meet the delinquency thresholds are transferred to the Cross-Servicing Program, and from that point the Treasury Bureau of the Fiscal Service services the account. The agency states that it cannot assist with loans after referral, and borrowers are directed to the Treasury Bureau at 800-289-7388.

The Treasury description of cross-servicing lists the tools the program may use, including demand letters, payment agreements, Justice Department litigation referral, credit bureau reporting, wage garnishment, private collectors, and offset. The referring agency decides which tools apply to a given debt, so the list is a menu rather than a calendar.

Every federal collection letter describes what the agency may do. None of them describes what it will do to this borrower, on this account, in this month.

But the transfer changes the posture of negotiation. Resist the urge to keep writing the originating office, even briefly, once authority has moved; the borrower now faces a collection program whose mandate is recovery.

Charge Off, Reinstatement, and Servicing Requests

A loan in charged off status that has not yet reached cross-servicing can return to good standing. The borrower pays the full overdue balance through the portal, then requests reinstatement at CovidEIDLServicing@sba.gov.

Whether the agency regards a closed business with a remaining balance as a servicing question or a collection file is a distinction the published pages leave to counsel. Ownership changes, collateral release, subordination, and guarantor release each carry a requirement letter with steps the borrower completes first, and anticipated closure is directed to the portal or the servicing center.

Liability, Collateral, and the Evidence File

Notices name the obligor with less clarity than the file requires. The demand may reach the company, an owner, or another person named in the financing documents, and each recipient owes only what the executed papers impose.

Counsel should review and analyze those documents before the owner supplies personal financial information or accepts commitments in an individual capacity. Collateral and guarantee thresholds were not part of the inspected sources, and no figure is stated here beyond what the executed papers show.

Administrative wage garnishment, where the referring agency elects it, permits withholding up to fifteen percent of disposable earnings from a nonfederal employer without a court order, under the process described in the Treasury background on wage garnishment. The debtor receives notice with an opportunity to request a hearing, and a timely request holds the order until the hearing occurs. Whose earnings are subject to such an order on a business debt is a question for counsel on the actual papers.

Private Debt Beside the Federal Obligation

Many borrowers carry merchant advances or other private obligations next to the EIDL balance. Delancey Street is a debt settlement company, not a law firm, and its free confidential initial review gives such owners a place to examine the private ledger, with independent counsel handling the legal work, to ensure the legal work stays in the proper engagement.

The portal keeps the same hours regardless.

The Document That Closes Each Question

A payment receipt alone does not establish reinstatement, release, or discharge. The borrower needs the document that matches the result sought, whether that is reinstatement or a confirmed servicing outcome.

Steps taken, or not taken, after a notice set the range of what remains available months later. Simply keep the account records together and measure progress by papers received rather than calls avoided. The file, kept in this extremely literal fashion, is the one instrument the borrower controls.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
