Full 2026 rankings, city guides, and red-flag checks: Business Cash Advance Settlement.

A North Dakota business with a defaulted advance owns more protection than the collection file admits. The balance on the statement is real, but the remedies behind it are fenced on every side by provisions the demand letter never quotes.

Seven provisions of the Century Code supply those fences, each one read in full from official or chapter text. They begin where the owner lives and end where a receiver might take the keys.

What the Judgment Cannot Touch

Often the exemption schedule is the first document counsel requests. Chapter 28-22 reserves listed property to the head of a family from attachment, mesne process, levy, and execution sale, and the exemption chapter names absolute protections that include family pictures, burial lots, religious and school books, wearing apparel, a year’s provisions and fuel, the homestead, qualifying crops, and the insurance benefits a family rebuilds on.

The homestead sits at the center of that schedule the way a stove sits at the center of a farmhouse: old, immovable, and assumed. The shield is, if precision matters, not a single exemption but a schedule of them, and owners who qualify as head of a family can shield basic livelihood assets from judgment enforcement (how county officers value a year’s provisions in practice is not in the chapter).

The Filing Behind the Advance

Title 41, Chapter 41-09 of the Century Code, the state enactment of secured transactions law, controls attachment, perfection, priority, and default remedies for security interests and sales of accounts and chattel paper. The question it puts to an MCA filing is whether the paper records a true sale of receivables or a secured loan wearing purchase language, and the answer decides what collateral, if any, the funder can reach.

The contract calls the transaction a purchase. The Code asks what the money did, and a funder that skipped perfection understands the omission (it counts on the owner never asking). Before any payment was missed, before counsel saw the advance, the financing statement recorded what the funder owns against the world, which is sometimes less than the first page of the agreement describes.

The filed record, not the contract label, decides the issue.

The Cap on the Paycheck

After judgment, through the exclusive procedure of the chapter, a creditor may reach a debtor earnings held by a third party employer. Chapter 32-09.1 caps the garnishable slice of aggregate disposable earnings at the lesser of twenty five percent or the excess over a statutory floor, with earnings, disposable earnings, and parties given precise definitions in the garnishment procedure. The cap is the worst case, stated in advance.

But the cap is a ceiling, not a promise. Most owners sign the guarantee without reading this chapter. That is understandable. The definitions do the work, and the exposure of an individual guarantor ends where the 25 percent boundary falls.

The Floating Ceiling on Yield

Six percent is the default legal rate unless a different rate is contracted in writing, and the ceiling above it floats: five and one half points over the six month Treasury bill average under the monthly declaration of the banking commissioner, never below seven percent, with compounding barred and any violation deemed usury. Read the usury chapter against the declaration for the relevant month. An outlandish factor rate becomes, upon recharacterization, ordinary usury.

The chapter holds further detail, though the cited sections carry the argument. Whether the declaration for a given month helps or hurts the pending advance is a question worth pricing before talks open. The work is to review and analyze the contract, identify the yield, and build a response that addresses both the stated factor rate and the actual cost of the money. How trial courts apply the floating cap to advances priced as purchases is less settled than the chapter language alone suggests.

Deception and the Attorney General

Misleading marketing, hidden fees, and abusive collection conduct meet a chapter written in broad terms. Chapter 51-15 reaches deceptive sales and advertising practices in connection with merchandise under a broad definition and arms the Attorney General to investigate and enforce, which gives a small business a public complement to private negotiation, as the unlawful practices chapter provides.

The referral costs the owner nothing. The letterhead alone matters. That is the cheapest pressure available before litigation.

Licensed Collectors

Third party collectors pursuing business debts answer to a licensing regime administered through the Department of Financial Institutions, with collection agency defined around persons engaged in debt collection in the ordinary course of business. The collection agency chapter is short, and the check is routine.

Any payment to the collector, even briefly discussed, should wait until licensure is confirmed, subject to what the Department records show. Independent counsel ensures the license check precedes payment. Operating outside the regime creates exposure the debtor side can raise.

Receivership and the Loss of the Keys

A creditor seeking to displace management has a path, and the workout must reckon with it. Chapter 32-10 permits courts to appoint receivers where property or funds face danger of loss, removal, or material injury at the behest of creditors, in mortgage foreclosures, after judgment to carry it into effect, and for dissolved, insolvent, or imminently insolvent entities, as the receivership chapter details. There is a particular silence in a shop in November when the owner understands the receiver answers to the court.

Steps the owner takes, or does not take, in the first week after default decide whether management survives the motion. A creditor seeks a receiver in order to convert disputed cash into court held funds. Simply ask who the receiver answers to before agreeing to anything. Resist the urge to stipulate to a receiver to buy time.

The Code does not cancel obligations. It assigns forums, caps, and floors, and inside those boundaries settlement is arithmetic. Receivership is extremely fast once ordered and extremely difficult to unwind. FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
