The Virginia MCA agreement that selects Richmond paper, Richmond courts, and Richmond remedies has chosen its battlefield with care, and the choice binds both sides.

Counsel reads the confession clause before the payment schedule, because the clause decides where the dispute will be fought.

Virginia restrains private repossession at the peace boundary, caps contract interest at twelve percent unless another regime allows more, condemns a catalogue of supplier deceptions, shields householder goods and a value capped homestead from process, limits wage garnishment by formula, and permits confession of judgment with formalities New York abandoned, and each of these rules cuts in a different direction, which is why the restructuring begins with inventory rather than with argument.

Self Help Repossession Under Section 8.9A-609

Section 8.9A-609 states the self help boundary for blanket lien and receivables funders. After default the secured party may take possession of the collateral and render equipment unusable on the debtor premises, through judicial process or without it where no breach of the peace occurs, and may require assembly at a reasonably convenient place.

The Code grants the possession. It withholds the muscle.

Owners call after the tow truck has left, and I understand why they waited.

But a demand of automatic repossession misreads the condition the section makes central. Resist the urge to surrender equipment in the parking lot at midnight, since what the owner yields, or refuses to yield, in the first days sets the value of everything negotiated later. Often we see the threat letter cite the lien and omit the peace requirement in the same paragraph.

Repossession that needs confrontation needs a judge first. Demands made against the company that skip that step answer for the skip.

The Twelve Percent Default Ceiling

Virginia contract rate ceiling provides that no contract may carry interest on a loan above twelve percent per year except as otherwise permitted by law, then lists the higher rate regimes for finance companies, short term loans, and title lenders, preserves agreed interest where usury cannot be pleaded, allows other lawful fees on top of the stated rate, and reaches evasions pursued by device or subterfuge.

The twelve percent rule sits in these disputes the way a speed limit sign sits on an empty highway at night: posted, enforceable, and treated as advisory until the patrol car appears. The twelve percent figure, which crosses our desk treated as advisory in something like half the files we review, governs unless an exception fits the transaction. That is the entire rate argument, and everything after it is arithmetic.

Commercial borrowers test MCA style charges against the default ceiling and its exceptions, with the device or subterfuge language doing the work where fees wear costumes. The ceiling looks extremely modest on paper and extremely expensive to ignore in practice.

The Prohibited Practices Catalogue

Section 59.1-200 of the Virginia Consumer Protection Act declares unlawful a long laundry list of fraudulent acts by a supplier in a consumer transaction: misrepresentations of source, affiliation, characteristics, quality, and price, bait advertising, failure to honor warranties, deceptive fees, and dozens of subsequently added subdivisions reaching foreclosure rescue and other targeted practices, and the catalogue means exactly what it says.

Most funders know which subdivision they violate. They prefer the owner uninformed. The correspondence arrives with the rhythm of rain on a metal roof, steady and dull, and ludicrous balances gain credibility through repetition rather than proof.

False payoff statements with phantom fees in MCA collection and workout communications sit inside these categories, and the funder inflates the opening number in order to anchor the negotiation that follows. Counsel answers the catalogue with the ledger, matching each claimed charge to a subdivision or to nothing at all. We review the statements, trace the fees, and construct a reply that contests the balance and the collection conduct behind the balance. Suits filed against the guarantor meet the same reply.

Householder Goods and the Homestead Allowance

Virginia homestead exemption permits every householder to exempt selected real and personal property to five thousand dollars, ten thousand past age sixty five, plus a principal residence to fifty thousand dollars with five hundred more per dependent, indexed over time, on top of the poor debtor articles of Section 34-26: family bible, rings, portraits and heirlooms, burial lot with preneed contract, wearing apparel, household furnishings, firearms, pets, prescribed health aids, occupation tools with vehicles to ten thousand, a vehicle to ten thousand, and child tax credit and earned income refund portions, with perfected security interests retaining priority over the exemption.

The schedule is granular because guarantors live in granular detail. Counsel claims each line before the creditor prices the guaranty, and the clerk practices vary by county, in our experience, so confirmation precedes reliance.

Wage Garnishment Limits and Confession Practice

Virginia confession of judgment requirements preserve a device New York closed to out of state debtors in 2019. Confession remains authorized by the debtor or a duly constituted attorney in fact under a power of attorney executed and acknowledged like a deed, with powers embedded in a note needing no separate acknowledgment yet required to name specifically the confessing attorney and the clerk’s office, with substitution by recorded indexed instrument on certified mail notice unless the note gave advance warning. Whether the support scale or the general formula governs a given pay period is a question the payroll records answer.

Section 34-29 caps garnishment of aggregate disposable earnings for any workweek at the lesser of twenty five percent of disposable earnings or earnings above forty times the greater of the federal or Virginia minimum wage, with support, Chapter 13, and tax debts excepted and support on its own fifty to sixty five percent scale. That decides the forum of collection before the merits are briefed, since the designated attorney in fact can convert a disputed balance into a judgment while the owner reads the mail.

Delancey Street, a business debt settlement company and not a law firm, reviews positions of this kind through a free confidential initial review and coordinates with independently licensed counsel for legal work. Simply bring the confession clause with the payment history attached. Counsel will review and test each claimed default to protect and preserve every defense the statutes allow. The objective is to ensure no waiver leaves the office without counsel present, even casually, and to ensure the response meets the judgment threat and the arithmetic beneath the judgment threat.

Virginia rewards the owner who maps the battlefield before the first filing, and the map costs less than the territory. Consultation is where that mapping starts.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
