Full 2026 rankings, city guides, and red-flag checks: Business Cash Advance Settlement.

The Washington business advance that prices itself beyond every ceiling enters the restructuring with fewer advantages than its price suggests.

Counsel concedes the usury point on the first day and wins the file on other grounds, because Washington law rewards the concession.

A commercial code rule restrains the repossession, a usury ceiling sets the benchmark while denying business debtors its shelter, a one sentence prohibition condemns deception in any trade or commerce with the Attorney General behind it, exemption law fences off personal property from execution and garnishment, and a debt adjusting chapter decides which settlement vendors may operate at all, and the seven rules together move the contest from the price of money to the conduct around money.

Repossession Under RCW 62A.9A-609

Washington secured party repossession rule opens the file where most disputes start. After default the secured party may take possession of the collateral and render equipment unusable on the debtor premises, through judicial process or without it where no breach of the peace occurs, and may require assembly at a reasonably convenient place.

The section permits the seizure. It prohibits the struggle.

You sign the papers and then you learn what the papers allow. The rule allows this and nothing more.

There is a particular quiet in a warehouse in January when the equipment sits idle and the notices accumulate on the office desk. Resist the urge to resolve that quiet by surrendering the collateral the same afternoon, since what the owner keeps, or gives away, before counsel reviews the filing decides the bargaining posture for months.

The Ceiling Businesses Cannot Plead

RCW 19.52.020 holds any interest rate lawful so long as it does not exceed the higher of twelve percent per annum or four points above the Treasury bill yield from the twenty six week auction preceding the agreement, barring the taking of greater interest for the loan or forbearance of money, goods, or things in action, with refinements for setup charges, committed rates, open end cycles, and nine percent medical debt interest. The Treasury bill benchmark moves with auctions counsel cannot predict, which leaves the ceiling a moving target in volatile seasons.

RCW 19.52.080 then closes the door it seemed to open. Corporations, trusts, partnerships, joint ventures, and governmental units cannot plead usury, and no person may plead or sue on usury where the transaction was primarily agricultural, commercial, investment, or business, except for consumer transactions of personal, family, or household purpose. A business purpose advance falls under the Washington business purpose usury bar, so the restructuring pushes toward deception, licensing, and unconscionability theories instead. There are refinements for open end credit and committed rates, though in practice they confirm the boundary rather than move it.

The benchmark matters. MCA fees recharacterized as interest are tested against it even where the bar denies the defense, and the test shapes settlement ranges long before any court rules. Our files cluster in the double digits, though no census exists, and extremely few funders welcome the arithmetic once counsel performs it. We review the filings, price the fees, and construct a reply that answers the usury question and the deception question behind it.

The Consumer Protection Act Backstop

RCW 19.86.020 condemns unfair methods of competition and unfair or deceptive acts or practices in any trade or commerce in a single sentence construed against federal FTC precedent. The hook catches deceptive funder, broker, or collector conduct affecting commerce, and conduct of that kind fills the gap the usury bar leaves open.

RCW 19.86.080 arms the Attorney General to sue in the name of the state, including on behalf of residents together, to restrain any prohibited act, including parens patriae actions for residents, with costs and reasonable attorney fees to the prevailing party in the discretion of the court plus restoration and related relief. The Attorney General (which may join the isolated complaint to a public posture the funder cannot settle quietly) changes the identity of the adversary, and funders who bully owners negotiate on altered terms against the state. Collectors draft the misleading statement in order to close before counsel reads the paper.

Conduct the usury statute cannot reach, the deception statute collects.

Engagement letters in these files answer the carve out question with silence. Collection letters in these files share an eerie uniformity, and uniformity of that kind suggests a single author behind many names.

Personal Property Exemptions

RCW 6.15.010 fences itemized personal property off from execution, attachment, and garnishment, subject to coordination with secured interests (the coordination rules repay a careful reading, though counsel confirms the current text before relying on it): wearing apparel, private libraries and media, family pictures and keepsakes, household goods, and further categories in the remaining subsections of the section. The schedule is extremely short on ornament and defines the collection floor for individual guarantors with little fanfare.

Whether exemption law keeps pace with digital stores of value is a question the older categories leave open.

Debt Adjusters and Settlement Vendors

Washington debt adjusting definitions decide who may sell debt relief in the first place. A debt adjuster, whether styled pooler, manager, consolidator, prorater, or credit counselor, means anyone in the business of debt adjusting for compensation, excluding attorneys, escrow agents, accountants, and securities professionals acting incidentally to their professions along with regulated financial institutions. Settlement vendors serving Washington businesses must fit a carve out or comply with the chapter licensing, fee, and conduct rules, and the designated pooler who fits neither has no business sending engagement letters.

Vetting the vendor belongs before signing with the vendor.

I have watched owners sign with unvetted vendors, and the signature costs more than the vetting would have. Delancey Street, a business debt settlement company and not a law firm, reviews positions of this kind through a free confidential initial review and coordinates with independently licensed counsel for legal work. Simply bring the vendor contract with the fee schedule attached. Counsel will review and examine each obligation to protect and preserve every defense the statutes allow. The objective is to ensure no statement about the account leaves the office without counsel present, even briefly, and to ensure the settlement addresses the debt and the conduct around the debt.

Rarely does a funder disclose the vendor rules without prompting, which is why the owner prompts. Statutes of this kind reward preparation over position, and preparation begins with reading. Consultation is where that reading starts.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
