Full 2026 rankings, city guides, and red-flag checks: Business Cash Advance Settlement.

The West Virginia MCA contract that prices a business advance as if the usury chapter did not exist has understood the business exemption and nothing else.

Counsel concedes the rate ceiling on the opening call, then moves the fight to deception, unconscionability, and exemptions, where the advance remains vulnerable.

A commercial code rule restrains the repossession, a trade chapter caps loan interest at six or eight percent before removing business debts from its reach, a consumer credit act condemns deception and arms the Attorney General against unconscionable collection, an execution chapter fences off personal property to fifteen thousand dollars across four categories, and a suggestee statute caps wage execution at twenty percent above a fifty week floor, and the seven rules reward owners who read past the rate question.

Repossession Under Section 46-9-609

Section 46-9-609 of the Uniform Commercial Code states the self help boundary for blanket lien lenders and receivables funders without ornament. After default the secured party may take possession of the collateral and render equipment unusable on the debtor premises, through judicial process or without it where no breach of the peace occurs, and may require assembly at a reasonably convenient place. The peace requirement looks extremely simple until midnight in a warehouse.

The statute delivers the collateral. It denies the confrontation.

Assembly at a convenient place begins as logistics and ends as evidence, since the chosen place reveals who controlled the process. Owners describe these calls the same way. I believe them.

Six months after default, the pattern stabilizes: the demands escalate while the cited authority stays fixed on the lien and silent on the peace. Resist the urge to cure that silence by delivering the equipment before counsel reviews the demand, since steps surrendered, or defended, in the first weeks set the price of everything after. Demands made against the company that skip the peace condition answer for the skip.

Six Percent, Eight Percent, and the Business Exemption

Section 47-6-5 fixes legal interest at six dollars per hundred per year with no unwritten contract for loan or forbearance above it apart from a one dollar minimum, while parties may contract in writing to eight percent including amortized points, with prepayment protections alongside. The ceiling is, to be precise, two ceilings with an exit, and the exit decides most commercial files.

West Virginia business debt usury exemption provides that no interest rate limit, forfeiture, penalty, or rate based liability applies to debt incurred by loan, installment sale, or similar transaction primarily for a business purpose, except that a natural person covered debt must reach twenty thousand dollars or more, with business meaning activity primarily generating gross income apart from farming. An advance of twenty one thousand dollars clears the natural person threshold by a margin smaller than a used compressor, which shows how thin the line runs. That ends the usury discussion, and everything after it concerns conduct rather than price.

The rate argument serves only to be abandoned for stronger ground. Whether a given advance clears the business purpose test is a question the use of proceeds answers, and the answer belongs in the file before the first settlement call. We review the agreement, test the exemption, and construct a reply that answers the rate claim and the conduct claims behind it.

Deception and Unconscionability Under Article 6

West Virginia deception prohibition declares unfair methods of competition and unfair or deceptive acts or practices in any trade or commerce unlawful in a single sentence elaborated by statutory definitions and rule authority. The hook catches deceptive funder, broker, or collector conduct (which the industry will characterize as ordinary risk pricing) without regard to the labels the conduct wears.

Section 46A-7-109 authorizes the Attorney General to sue to restrain a creditor or its agent from enforcing unconscionable consumer credit terms or engaging in fraudulent or unconscionable debt collection, upon findings of unconscionability or likely fraud with likely consumer injury, weighed against factors such as known inability to pay and gross price disparity. Gross price disparity sits in the statute like a loaded scale in a market stall: visible to every buyer, acknowledged by no seller. The disparity is gross before counsel measures it, and funders who pack charges in order to test the owner tolerance for arithmetic meet this section next.

Our files suggest the pattern holds across counties, though no statewide study confirms it, and the confirmation that matters arrives one ruling at a time.

Personal Property Exemptions From Execution

Section 38-8-1 lets a resident individual exempt from execution one motor vehicle to five thousand dollars, household goods with wearing apparel to eight thousand in the aggregate, trade implements with books to three thousand, bank deposits to eleven hundred, and retirement funds subject to excess contribution tax limits, capped at fifteen thousand dollars across the first four categories. The fifteen thousand dollar cap looks extremely modest until it covers the disputed property. The exemption schedule prices the guarantor exposure before settlement talks open, and most collection threats ignore it with a brazen confidence, though seldom does a demand letter inventory these categories before threatening the contents of the house.

Suggestee Execution Against Wages

West Virginia suggestee execution cap lets a judgment creditor obtain ex parte suggestee execution against private employment wages due or to become due within a year, but only where weekly post tax pay exceeds fifty times the federal minimum wage, with the levy reaching twenty percent and no more, weekly pay remaining above the fifty week floor, and one execution satisfied at a time. The statutory suggestee process is powerful within its fence and powerless outside it. The fifty week floor moves with the federal wage, which Congress sets on its own schedule.

Delancey Street, a business debt settlement company and not a law firm, reviews positions of this kind through a free confidential initial review and coordinates with independently licensed counsel for legal work. Simply bring the advance agreement with the exemption inventory and the wage records. Counsel will review and map each exposure to protect and preserve every defense the statutes allow. The objective is to ensure no statement about the debt leaves the office without counsel present, even briefly, and to ensure the plan addresses the judgment risk and the collection conduct around the judgment risk.

Exemptions of this kind favor the owner who completes the count before the collector does, and counting is the least expensive work in the file. What the owner shields, or leaves exposed, before judgment decides what remains to negotiate after it. Consultation is where that counting starts.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
