The call to the employer and the order to the payroll department are different events, and only one of them can move money.
Before the owner explains anything to a supervisor, before counsel can assess the exposure, the question is what the employer received. A phone call and an income execution require different responses.
Obtain the complete message or document rather than a summary passed through another employee. Determine whether it asks for information, demands payment, or purports to serve a legal instrument (which the collector will call routine). Counsel needs the language and the sender before assessing anything.
Keep dates, contact details, and any written confirmation. The caller was, if the notes are accurate, not the funder at all. Collectors tend to call the supervisor or the front desk, where no one is authorized to evaluate process.
If a paper names a case, obtain the court record and compare the parties. The boss calls you in, and the business debt is a workplace problem by lunch. The business owner and the operating company should not be assumed to be the same judgment debtor.
The employer may need to review process it receives through its own channels. Assurance from the owner should not substitute for that review, and a collector demand should not be accepted without identifying its basis.
The FTC debt collection explanation distinguishes the consumer debts covered by the federal Fair Debt Collection Practices Act from business debts. A personal guarantee does not turn an MCA obtained for business purposes into consumer debt.
The statute covers consumer debt.
Do not assume that every federal rule about calls concerning a household bill applies to this account. The call caused real harm. No federal consumer rule governs it. Counsel should examine the debt purpose, the actor involved, and the conduct shown in the preserved messages.
The exclusion from a federal statute does not establish that every communication is lawful. State law and other theories require their own review (and counsel must assess the actual debt, actor, and conduct before naming a remedy). Before sending a form letter copied from a consumer debt website, obtain advice on the applicable rule.
Preserve the communication even where no federal consumer claim applies. The facts remain relevant to whatever remedies may be available.
An entity can appear in the financial life of the owner in more than one capacity. Determine whether the recipient employs the individual or owes a commercial account to the business. A claim concerning customer receivables should not be analyzed as though it concerns the wages of an employee.
If the funder says it holds rights in a payment, request the document supporting that assertion. Consider an owner owed twelve thousand dollars on a commercial invoice while earning a salary across town: the funder interest in the first says nothing about the second. A broad claim that all income belongs to the creditor establishes no scope and no reach.
Identify whether the recipient has been asked to redirect a business invoice, answer questions, or withhold employment income on the strength of a phone call. You do not answer that question by assuming the worst. The owner should not supply competing payment instructions without advice.
Read any guarantee and the judgment, if one exists. A company debt should not be treated as an adjudicated personal obligation on the strength of a second income.
The business and the job can occupy separate folders while the same person worries about both. An extremely useful assessment names what the sender wants the employer to do. Resist the urge to characterize every employer contact as either meaningless or conclusive. The legal review should preserve the distinction the collection message blurs, and test every claim against the paper behind it.
New York CPLR 5231 provides an income execution procedure with service requirements and limits on withholding. A singular feature of the surrounding law is that a restraining notice may not be served on an employer for wages due to the debtor. No phone call starts an execution against earnings.
The statute allows installments of not more than ten percent, a floor of thirty times the applicable minimum wage, and a cap measured against twenty five percent of disposable earnings. A percentage quoted without the applicable earnings figures can mislead. Counsel should examine the execution and the relevant law with the figures in hand.
Other states use different rules and protections, and not until a court acts does the employer owe the creditor anything. Whether a modification succeeds depends on arithmetic this article cannot perform.
Keep pay records and other deductions available for review. The gross revenue of the business and the disposable earnings of the individual are different measurements. Ask which person at the employer handles payroll process, since the supervisor who takes the call is not the payroll office.
Collect and keep every message, every page of process, and the notes showing where each item was sent. Record which documents have gone to counsel or to the responsible department at the employer.
A supervisor summary should not substitute for the recording or the letter. The file should contain the words the collector used, not the words the supervisor remembers.
Resolution of the MCA balance need not pass through the employer, and a settlement assessment with Delancey Street tests that proposition. Delancey Street is a settlement company, not a law firm, and independent counsel handles any execution or contact questions the process raises.
Ask the adviser to ensure the settlement plan requires no cooperation from the employer. Counsel should ensure any income execution is answered through the applicable procedure. The attorney reviews the process, directs responses through proper channels, and keeps business payments separate from the paycheck.
Most collectors know the supervisor cannot authorize a withholding, and call the supervisor anyway. An extremely short conversation can still do real damage. Remarks about the debt at work, even casually, travel beyond the person who hears them.
The debt sits in the payroll file like a stone in a shoe: small beside the business, and felt with every step. What the owner tells the employer, or withholds from telling, should be decided with counsel rather than under pressure.
Simply route every new employer contact to counsel on the day it arrives. One need not decide what to tell the employer before counsel has seen the paper. Settlement can proceed on the business track, though an issued execution follows its own procedure. Owners fear the employer learning of the debt beyond the debt itself, and we address the fears in that order.
Most funders accept 30–60% as a full settlement — with proper leverage.
