Retirement funds become settlement money only when the owner signs the withdrawal.

Before any offer touches those funds, before counsel can assess the demand, the account label decides nothing. An employer plan, an IRA, and a life insurance policy answer to different documents, and the documents come before the decision.

Name the Asset and Its Owner

Three accounts under two names with four beneficiaries named across them is an ordinary household, not an exotic one. Obtain the plan description or policy, the current statement, and the records of contributions or rollovers. Determine whether the asset belongs to the owner, the business, a spouse, or another person.

A claim against the operating company does not explain why an individual retirement account appears in the demand. The balance was, if we are being precise, never money of the company. Counsel examines the guarantee and any judgment for a basis reaching the person or property at issue.

A policy requires care with terms. Owner, insured person, and beneficiary, each holding a different interest, can be three different people. An estimate of the death benefit states no cash the owner can withdraw today.

Employer Plan Protection

29 U.S.C. Section 1056(d) requires covered pension plans to provide that benefits may not be assigned or alienated. That bar is why counsel examines the plan before treating an employer balance as an ordinary account open to a commercial creditor.

Coverage must be established, since the fact that an account is called a 401(k) begins the examination rather than ending it. I have yet to see a plan administrator honor a private creditor assignment. Most collectors know this, and ask the owner to sign the withdrawal.

The statute carries exceptions and qualifications, including provisions for qualified domestic relations orders and specified offsets involving obligations to the plan. An ordinary MCA collection demand resembles none of those circumstances (and a collector suggestion that the exceptions swallow the rule should be read as collection pressure, not as statutory analysis).

A voluntary distribution can change every question that follows. Ask the administrator for the documents explaining the plan and any process it has received, and let counsel assess the asserted creditor right before the owner signs anything, since a signed withdrawal cannot be undone.

IRA Rules Under the Governing Law

But an IRA is not an employer plan, and the employer plan analysis does not transfer by analogy. New York CPLR 5205(c) treats qualifying individual retirement accounts, Keogh plans, and specified rollovers under stated Internal Revenue Code provisions as trusts created by a person other than the debtor, conclusively presumed spendthrift under state law. Qualification and the contribution record matter alongside the balance.

The section preserves rights under qualified domestic relations orders and contains exceptions involving support rights and certain additions to protected assets. Do not move ordinary cash into a retirement account on the assumption that a last minute contribution defeats a creditor. A contribution receipt proves that money moved, and nothing about the legal result.

Preserve rollover records with the current statement, since the institution may not show the source of an older transfer. The original record can decide a dispute about the character of the funds, though such disputes turn on facts this article cannot supply.

Payments after distribution answer to different rules. The account was protected. The deposit entered a different analysis. New York addresses payments from qualifying arrangements in its income provisions, which is why neither automatic loss of protection nor universal continued protection should be assumed.

Whether courts outside New York would treat the same rollover the same way is a question worth considering.

Other jurisdictions and bankruptcy proceedings require their own review. One should not read the New York example as a national IRA exemption, and counsel should determine the applicable framework before any proposed payment changes the position.

Life Insurance as a Separate Inquiry

A life insurance policy cannot be analyzed from the retirement account rules. Ownership, beneficiary designations, and the value provisions buried in the policy riders require separate attention. Ask what interest the collector contends is available and how it proposes to reach that interest.

New York CPLR 5205(i) protects specified rights to accelerate a death benefit or enter a viatical settlement. That particular provision is extremely narrow and should not expand into a statement that every policy interest is exempt from every creditor. Consider a policy running to forty pages, most of them definitions: the exemption question still turns on the interest asserted, not the page count.

Often we see the policy discussed as a funding source before counsel has read it. Before borrowing against or surrendering a policy, obtain an explanation from the insurer of the consequences for the policy and its benefits. A tax adviser should assess tax consequences where relevant, a question on which this article offers no conclusion. Remarks about the balance to the collector, even casually, shape the next demand.

Statements Without Movement

Keep the latest statements with the records showing contributions and rollovers. Preserve distribution confirmations and bank statements together where payments have mixed with other receipts. Counsel needs the complete set before advising on any transfer. A partial file produces partial advice.

Owners volunteer the retirement account at the first meeting. That offer reflects fear rather than arithmetic.

Settlement Review Without Raiding the Future

A settlement assessment with Delancey Street can address whether the MCA obligation can be resolved without touching retirement funds. Delancey Street is a settlement company, not a law firm; independent counsel addresses the protection questions. The label on the statement that started this inquiry should match the documents counsel has now seen.

Ask the adviser to ensure no proposed payment depends on funds still inside a protected account. Counsel should ensure the settlement structure leaves retirement assets out of the funding plan. The attorney reviews the accounts, confirms the protections, and shapes an offer the operating cash can support without them.

An extremely costly error liquidates a protected account to pay a debt that settlement could have reduced. Resist the urge to sign a withdrawal to satisfy a demand letter. A collector presses for that signature in order to reach funds the plan would never release.

Simply bring the statements to counsel before answering the demand. What the owner discloses, or withholds, in that first conversation shapes the strategy that follows. The protection works like a lock that opens only from the inside. The funds saved across decades deserve a slower decision than the demand allows, and we should give them that time.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
