New funding after a restructuring is a question of record, not of waiting.

Lenders underwrite what the file shows: the agreements still open, the filings still recorded, the tax accounts still unresolved, the court history still docketed. Time helps only where time changes the record. Each product below describes what must change before a new application deserves confidence.

SBA 7(a) Loans

The federal guaranty program permits refinancing of current business debt through participating lenders, subject to eligibility rules that examine debt purpose, business viability, and the actual terms on offer, per the SBA 7(a) loan program description. The guaranty protects the lender under its terms. It erases no borrower liability and promises no approval.

An owner carrying recently settled MCA balances should expect the lender to ask for the settlement releases, the termination record, and the bank statements behind both. The paper that closed the old debt opens the new file, the way a key opens a room it was cut to fit, which sounds obvious until an applicant arrives without it.

No published schedule states how soon after settlement a guaranty may issue. Underwriting decides on facts, not anniversaries.

SBA COVID EIDL Balances

COVID era balances occupy a separate track with their own servicing rules. The program page describes limited payment assistance for operating businesses in temporary difficulty, interest that continues during assistance, charge off as a servicing change rather than forgiveness, and compromise only after collateral liquidation, summarized in the current SBA COVID program page. COVID EIDL balances cannot be forgiven through the ordinary compromise form.

A charged off EIDL balance is a balance with a new servicer, not a balance that has disappeared.

New funding while a federal balance sits unresolved means underwriting around a creditor that refers delinquent accounts to Treasury collection. Owners should ensure the servicing status is current and documented before applying elsewhere, or the new lender will discover the federal balance first.

Business Credit Reports

Business reports compile a different record than personal scores. Published bureau material explains that business reports may include UCC filings, judgments, and collections, and that a UCC filing is distinct from repayment reporting, per the bureau explanation of business credit reports.

Settlement followed by a lingering filing reads as unresolved. Termination of the filing is a separate act from payment of the debt.

Bank Term Loans and Lines of Credit

Bank originated products examine collateral, cash flow, and guarantees with little interest in the narrative of the restructuring. One national online lender distinguishes secured term loans carrying a general business asset lien and owner guarantee from unsecured lines, with written release procedures after full payoff governed by the signed agreement rather than by marketing language. Another line of credit product, issued by a chartered bank through a financial technology company, reports repayment history to a business bureau and warns that default may trigger reporting in a guarantor capacity.

These distinctions matter because each one answers a different underwriting question, about the lien that remains, about the guarantee that survives, about the report the next lender will pull, and the owner who treats all bank products as one product will misjudge every application, in order to avoid that error the file should be assembled product by product rather than story by story.

Whether a settled MCA must season before a bank application turns on the lender’s policy, which no public page states. Counsel and the lender’s own checklist govern.

Platform and Revenue Based Financing

Sales based products from payment platforms carry their own repayment mechanics, minimums, and collection methods that vary by product and by acceptance date. The executed agreement controls each term.

Prior restructuring may affect eligibility where the platform reviews bank debits, balances, or existing obligations. The platform answers silence on its own schedule.

Tax Balances Owed to Revenue Authorities

Unresolved tax debt shadows every funding application because revenue authorities hold collection tools no private creditor possesses. Federal guidance describes installment agreements and qualifying compromise procedures, continuing compliance obligations after acceptance, and personal exposure for responsible persons behind withheld employment taxes, per the IRS compromise guidance for businesses. I have yet to see a lender ignore an open tax balance once discovered, though applicants continue to apply as if none will look.

Paying private creditors while tax deposits go unmet reverses the correct order. Current compliance comes first.

Prior Bankruptcy and the New Application

And the court history follows the owner into every new file. Prior chapter, filing dates, and whether the earlier case ended in discharge or dismissal affect later relief under the court guidance on prior cases and new filings, and recently dismissed cases can limit the automatic stay absent further court action. New private borrowing cannot revive discharged obligations, and owners should take counsel before signing anything that characterizes an old balance.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
