A federal form for compromise does not create a federal willingness to compromise.
Borrowers who ask whether a COVID EIDL can be settled in 2026 picture a negotiation resembling private debt settlement, with an offer, a counteroffer, and a discount for prompt payment. The current agency guidance describes something narrower, and the distance between the imagined process and the documented one is where most consulting fees go to die.
The SBA Offer in Compromise requirement letter, last updated in August 2026, states that an offer will be considered only after liquidation of all collateral pursuant to agency guidelines. The same page states that COVID EIDLs are not able to be forgiven. Those two sentences decide more cases than any strategy memorandum. That surprises borrowers who arrived with a percentage in mind. An extremely brief eligibility review costs less than a full settlement proposal built on the wrong program.
Availability of a downloadable form does not establish availability of relief, and advisers who price a settlement proposal around the general compromise process should identify the authority that makes it relevant to this particular loan. There are exceptions in federal practice, though in practice they tend to confirm the rule.
You download the form and then you discover what the form cannot do.
Retrieve the note and loan number, then confirm whether the account is a COVID EIDL, another disaster loan, or a different SBA program. Similar terminology does not establish identical servicing rules, and a result achieved under one program travels poorly into another.
Establish the current servicing office before sending anything (the account may sit with the COVID servicing center, with Treasury cross servicing after referral, or in a charged off status that has not yet moved, and each destination answers a different question). A detailed proposal sent to an office that no longer services the loan produces delay rather than a decision, and delay in this setting favors the balance, which continues to accrue. A collector may press for immediate payment in order to secure funds before the borrower learns the servicing status.
Keep any advance or grant record separate from the loan. The existence of one form of pandemic assistance does not establish the repayment requirements of another, and conflating them in correspondence signals to the reviewer that the file needs education before it needs an answer. The file that treats every federal form as an invitation carries an outlandish optimism about how agencies decide.
The current EIDL servicing guidance describes temporary payment assistance alongside separate servicing actions concerning collateral, ownership, and guarantors. A smaller installment addresses immediate cash flow while the balance remains due. A collateral release concerns a particular transaction without answering every liability question.
Payment assistance presently allows eligible borrowers to reduce payments by 50 percent for six months, once every five years, subject to conditions that include current status, an operating business, and no active bankruptcy proceeding. Interest continues to accrue during the period, and the unpaid amount increases the balloon payment at the end of the term. That arithmetic deserves attention before anyone celebrates the reduced installment. Rarely does a file support the settlement the advertisement promised. Payment assistance is available. Compromise for this loan is largely unavailable.
A durable plan begins with relief that is actually available, with the distinction between a requested compromise and an authorized result maintained throughout the process.
Whether the agency intends this narrow path to widen in a later year is a question worth considering.
The file then moves to the practical question of representation, which is where private help can still matter.
Many EIDL borrowers also carry MCA balances, and those private obligations are the reason the cash that might otherwise keep the federal loan current is gone. Delancey Street review of business debt concerns provides a free confidential initial review of the debt position, with its MCA focus making identification of the accounts part of the initial conversation.
Delancey Street is a debt settlement company, not a law firm, and independent counsel handles legal work including any advice concerning federal relief. The company provides debt settlement services for eligible private accounts, and its engagement does not establish eligibility for a COVID EIDL compromise.
Ask the adviser to ensure a proposed private debt arrangement accounts for the federal loan that remains. Counsel should ensure any correspondence with the agency falls within the appropriate legal engagement. An adviser offering to prepare a federal settlement proposal should explain the present administrative basis for that service, including what happens to the fee if the agency declines to consider the request under the assumed program.
Keep the request and supporting documents with whatever determination arrives. Record any further information required. Maintain the current payment and response schedule while the inquiry remains unresolved, because a pending question does not pause a servicing clock. What the borrower submits, or fails to submit, with the first request decides the speed of the answer. Any statement about the account, even casually, can shape the agency record of the case.
Prepare a forecast that does not assume the requested reduction will be granted. Most borrowers overpay for the proposal before they underpay the loan. In most of the files we have seen, though the sample is not scientific, the borrower who plans around the current obligation makes better decisions than the borrower who budgets the hoped for discount. Show the position under the existing terms and identify the improvement required for continued payment.
Do not liquidate or transfer property to satisfy an adviser’s generalized description of compromise prerequisites. Obtain the required guidance and consent concerning the actual loan, preserve valuations and proposed sale terms, and resist the urge to assume that surrendering the business assets guarantees a release. The result must be established through an authorized determination, and a payment receipt should not be mistaken for a release the agency has not granted.
An extremely confident presentation does not supply the missing authority. Simply ask for the applicable process in writing, review and analyze the response with counsel, and protect and preserve the records that show what was requested and what was decided. The larger objective is a supportable plan built on documented relief, pursued, or set aside, on the basis of evidence rather than expectation.
Most funders accept 30–60% as a full settlement — with proper leverage.
