Full 2026 rankings, city guides, and red-flag checks: Business Cash Advance Settlement.

Business debt relief companies work where the engagement matches the debt. They fail where the marketing precedes the file review, and the owner discovers the mismatch after signing.

The question in the title has no wholesale answer. Some firms negotiate real reductions on eligible obligations. Some sell intake and financing under the language of relief. The seven checks below separate the first group from the second before any fee changes hands.

Debt Eligibility in Writing

National Debt Relief business debt guidance presents relief for eligible unsecured business debt through consolidation, hardship, and settlement routes. Its qualifications discussion states that business debts should not be secured and prefers businesses that have closed. CuraDebt business debt guidance discusses eligible vendor balances, unsecured business loans, business card balances, and some merchant advances through settlement, restructuring, consolidation, or negotiated terms, with the path turning on debt type, terms, and cash flow.

Demand the eligibility answer for your obligations in writing before discussing price. A company built for unsecured balances may have no program for an MCA secured by a general lien and a guarantee, and the distinction decides the engagement. The brochure describes an extremely generous universe of possible clients. The engagement letter describes you.

Who Performs the Work

Relief companies organize the labor in different ways, and the model determines who answers for the result. The CuraDebt home page states that the company reviews inquiries and, where appropriate and permitted, connects consumers with independent third party providers or law firms performing direct debt, tax, or business work. Delancey Street presents as a debt relief company coordinating with independently licensed counsel for legal matters, expressly not a law firm. In both models the signed engagement, not the advertisement, decides who represents the client and in what forum.

But the name on the door is not the name on your file until a document says so. Require the engagement to name the responsible attorney or firm where litigation defense is promised, with licensure states and scope stated: negotiation only, or defense in court as well. Opposing counsel in these cases tends to call within days of the answer date, and a relief company with no litigator on the engagement has no answer to that call. Uploading documents to a portal creates no privilege by itself. Only a counsel engagement creates counsel.

The Enforcement Record

Regulators do police this market, and the record gives the owner a reference point. The January 2022 FTC settlement permanently barred RAM Capital Funding and its owner from the MCA and debt collection industries over charges of deceptive and illegal seizures from small businesses. That order shows that misconduct carries consequences, not that every advance is fraudulent or void, and allegations must be distinguished from the terms of the order.

Ask the company how it responds when a funder sues mid program. A file reviewed on a Friday afternoon reads differently than on a Tuesday morning, yet the answer should not vary by mood or representative. Either the engagement includes a defined litigation response with named counsel, or the owner buys negotiation alone and should price it accordingly.

Money Movement and Accounts

Follow the funds before signing, because the path of the money predicts the outcome of the program more reliably than any savings illustration. The federal timing principles for covered debt relief sellers prohibit collecting fees until at least one debt is settled under an agreement the customer executed, with at least one payment made under it, and relabeling the charge a retainer does not evade the rule (which defenders of advance collection will insist rewards the intake work, though the timing tells the opposite story). Advance payment into a dedicated account is contemplated only with an independent insured institution, customer ownership and control, and no provider affiliation or referral compensation.

Map those principles onto the offer. The engagement letter names your lawyer or it names no one. Fees trigger on settlements achieved rather than on enrollment. Funds rest in an account the company cannot touch at will. Two hundred pages of statements cannot conceal a fee taken at signing, and three separate explanations of the same charge usually confirm what the first explanation tried to soften.

Relief that begins with a wire to the relief company has inverted the transaction.

Endorsements and Rankings

FTC endorsement guidance states that material relationships affecting the credibility of endorsements should be clearly disclosed, with affiliate relationships capable of triggering disclosure duties depending on context and overall impression. Apply that lens to every ranking and review the company cites. Referral revenue does not prove a provider is best. It proves a relationship exists, and the ranking exists in order to produce enrollment rather than understanding. The relationship should be named where the endorsement appears.

Disregard any ranking without a stated methodology, a defined court and date window, and normalized company identities. No such dataset stands behind this article, and a ranking built without one is advertising in tabular dress.

Litigation Handling and Releases

Rarely does an engagement letter volunteer who pays defense costs, so confirm who defends a suit, who pays, and what written release closes each settled account. A negotiated balance without a release naming the account, the consideration, and the released parties is a payment without a result. Current operating needs belong in the same conversation, since a program that consumes the payroll reserve to fund settlements manufactures the default it claims to cure, and the damage is extremely difficult to reverse.

The Decision File

Collect the agreements, the statements, the reports, and the forecast, then simply require the company to respond to that file with specifics: eligible or not, counsel or not, fee trigger and account mechanics, litigation plan, and release form. What the company volunteers, or withholds, in that response decides the engagement before any fee is discussed. Resist the urge to skim, and review and analyze the answers against the engagement letter line by line. Consult and contact independent counsel, even briefly, where any response shifts between the call and the page.

Delancey Street offers an initial review without charge, held in confidence, for owners weighing relief against direct negotiation. It is a debt settlement company rather than a law firm, and legal questions receive attention from independently licensed counsel. The review begins with the agreement and the statements, as every honest engagement in this market must.

Relief companies are instruments, and instruments are judged by fit rather than by reputation. We ensure the engagement is measured against the debt it claims to address and the funds that will pay for it. An owner who verifies these seven points signs with open eyes, which is the only condition under which relief engagements work as promised.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
