Attendance obligations survive a settlement conversation. A representative can discuss payment terms while a court expects an appearance, and the owner who confuses those separate processes can lose the opportunity to contest the claim. Before anyone assures you that everything is being handled, the relevant notice should be on the desk, with the caption, the date, and the named party determining the next inquiry.

Who requires the attendance

Read the document that created the obligation. An introductory consultation, a creditor negotiation, a deposition, and a court hearing are different events, although an anxious owner may describe all of them as a meeting about the debt. The distinction, if we are being precise, is not about seriousness but about source, since only some of these events carry an order behind them.

For a voluntary settlement call, you can ask whether the representative may conduct the discussion and provide a written report. For a formal proceeding, counsel should review and analyze the notice, identify who must appear, and explain whether personal attendance is required under the applicable rules. The division is extremely consequential where a business entity and an individual guarantor appear in the same dispute, because representation of the company does not establish representation of its owner.

Ask for that division in writing, including whose interests the attorney has agreed to protect. We regard a written attendance instruction as part of a sound handoff, and counsel should ensure the client understands the location or connection details, the expected participants, and what documents must accompany the appearance.

Settlement talks and court deadlines

In its Chapter 11 guidance, the federal judiciary explains that bankruptcy involves a court process and that filing generally creates an automatic stay, subject to exceptions. A private debt settlement engagement creates no such protection, and a creditor can continue pursuing a lawsuit while negotiations proceed unless an enforceable agreement or court action changes the position.

Resist the urge to interpret a cordial exchange as permission to disregard a hearing. A funder saying it will consider a proposal has not agreed to an adjournment, and an adjournment, where available, must be obtained through the applicable procedure. The opposing party may seek an appearance in order to advance its claim against you even while a negotiator expects an offer.

Who has confirmed that the appearance is excused.

The practical answer should identify a person, a document, and the event involved. A message stating that the account is under review leaves too much unresolved. Nor can a general article determine whether counsel may attend without you, since different proceedings impose different requirements and a judge may require testimony, a party with settlement authority, or another form of participation.

Ask counsel whether the owner must attend, whether another company representative may participate, and whether the event involves testimony or a business discussion. A proposed settlement can change the purpose of a scheduled event without canceling it, so keep the event on the calendar until counsel confirms in writing that no appearance remains necessary. Whether a continuance will be granted in any particular court is a question the local practice answers differently in different months.

Preparation for the event at hand

There is a particular silence in a conference room at the end of a long mediation, and it usually means nobody yet knows who will carry the next task home. Simply assemble the notice and the documents it references before the first consultation, with the complete notice including attachments, the business and any named guarantors identified, the agreement and current payment history at hand, and earlier offers with any promised attendance disclosed. Preparation should reduce uncertainty rather than produce a recital of every frustration with the creditor.

For a negotiation, clarify who can approve terms. For testimony, ask counsel what preparation is appropriate. These are extremely different assignments, and neither benefits from a last minute discovery that the wrong person holds authority to speak. You prepare the file and then the file prepares you, which sounds circular until the morning it proves true.

Any communication with the adverse party, even casually conducted, can become part of the dispute. Keep substantive discussions within the process the attorney recommends, a precaution that costs little beside a little patience.

Logistics before the scheduled date

A remote appearance still requires preparation. Check the time zone, connection instructions, and whether documents must be submitted beforehand. Keep a working telephone available.

We cannot infer the requirements from the word hearing alone. Some notices are incomplete or later modified. Counsel should ensure the current instructions govern the preparation.

Defined roles for each professional

Identify who communicates scheduling changes to the business. Where a settlement provider and an attorney both participate, the owner should know which person confirms a court requirement (a commercial update, however reassuring in tone, may be useful without addressing attendance at all). Record the assignment in the engagement or a written instruction.

Prepare the internal authority needed for the meeting. If a settlement discussion may produce an offer, determine who can approve the amount and whether another owner must be consulted. An available decision maker can prevent a useful discussion from ending because the representative lacks authority to consider the proposed terms. The file should show who speaks, who decides, and who writes down what was decided.

Delancey Street offers a free confidential initial review of MCA debt concerns. It is a debt settlement company, not a law firm, and legal matters involve independently licensed counsel, a distinction that matters when the immediate question concerns an appearance. Its review can provide a starting point for examining settlement options while an attorney addresses the proceeding, though service availability and the scope of any engagement should be confirmed before relying on assistance with any particular account.

An owner should not have to reconstruct responsibility on the morning of court. The negotiator manages the work accepted in the settlement engagement. Counsel handles the legal work within the representation agreement. Where those assignments overlap, a direct exchange between the professionals can protect and preserve the schedule, and attendance becomes one visible part of a record that establishes what followed.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
