A charge off moved the file to a different desk without forgiving a dollar of the debt.

Borrowers who see the term in the portal mistake a bureaucratic event for a legal one, and the confusion is understandable, because the same screen that reports the status offers no map of where the account travels next. The practical task is to establish where the loan sits today, since a historical payment arrangement, an old agency message, and a Treasury notice can describe three stages of one obligation. The portal label carries a peculiar optimism for a status that changes nothing about collection.

Servicing Status Determines Where to Direct the Request

The current COVID EIDL servicing instructions distinguish a charged off or uncollectible account outside Treasury cross servicing from one that has entered it, and the distinction decides where the borrower should direct a request. Simply obtain the latest account status with the notice supporting it, record when the information was issued, and mark any unclear entry for review rather than replacing it with an assumption.

The term charge off should not be treated as a release, and an accounting designation does not establish that the borrower received a discharge of the debt, which is a point worth stating without qualification because callers invoking the Treasury name exploit the misunderstanding from both directions, some demanding immediate payment at an unverified destination and others selling services premised on a cancellation that did not occur.

If someone claims the account was forgiven, request the document and the authority supporting that conclusion. The loan left SBA servicing. The debt did not leave the borrower. A screenshot without a date leaves the reviewer comparing an old status with a current demand, and the loan number should be visible on every page of the comparison.

Offset and Cross Servicing Are Different Collection Paths

The Bureau of the Fiscal Service describes the Treasury debt collection programs as distinct mechanisms, with offset concerning eligible payments that can be intercepted and cross servicing providing a wider collection framework. SBA states that accounts reaching 120 days of delinquency may be referred to the offset program, while loans meeting further delinquency criteria transfer to cross servicing, after which servicing passes to the Treasury Bureau and borrowers must contact it rather than the agency.

Ask which program a notice identifies and what response it requires, because the relevant deadline and contact may differ from the information shown in an older agency message (collectors describing either program as a single event called being sent to Treasury collapse a distinction the response procedure depends on). A business can lose weeks by sending a detailed request to an office that no longer holds the file. Callers invoking the Treasury name demand payment in order to divert funds before verification.

That delay is not neutral. The balance continues to accrue while correspondence travels between offices, and the file ages into a less negotiable posture with each transfer. An extremely wide gap separates the portal label from the collection reality, and the arithmetic facing the owner is extremely unforgiving where reserves are thin.

Verify the account and payment instructions through an official channel before acting. Any direction to send funds elsewhere, even casually conveyed by telephone, deserves verification before a dollar moves. Payments the business makes, or withholds, while the status is unclear should follow counsel direction rather than collector pressure. The agency referral does not justify sending funds to any caller who uses the Treasury name.

Reinstatement Before Referral

For certain charged off accounts not yet referred to cross servicing, the posted instructions describe paying the full overdue balance and requesting reinstatement after processing. The owner should confirm the account remains within that situation before relying on an earlier discussion of this route, and should distinguish the amount needed to cure arrears from the total outstanding balance, since those figures serve different purposes.

Keep evidence of the payment and the request that follows it. Do not assume the status changes at the same moment funds leave the bank.

Resist the urge to commit the operating reserve before comparing the proposed payment with payroll, taxes, essential suppliers, and the expenses required to complete existing work. If the money would come from a new advance, include that advance collection schedule in the comparison, because retiring a federal delinquency through another obligation may change the pressure on the account rather than resolve it. The forecast should show the business after both transactions, and remaining uncertainty should be stated in direct terms rather than discovered later.

Private Debt Negotiations Stay Separate

Delancey Street review of business debt concerns can be relevant where private MCA obligations consume the cash needed to address the wider debt problem. Delancey Street is a debt settlement company, not the agency or the Treasury, and an engagement with a private provider does not establish that a federal loan returned to ordinary servicing.

Ask whether the proposed service concerns an MCA negotiation, coordination of records, or a referral for advice about the federal obligation. These tasks can be useful together when their limits are apparent, and a general business debt label should not be taken as a promise to obtain a federal compromise or halt collection.

The engagement should explain fees and how the owner receives updates. Ask the adviser to ensure each promised action identifies the party responsible for carrying it out. The owner should ensure every payment instruction is verified through an official channel before funds move. Keep the federal correspondence available to the lawyer assessing it, even when a separate representative discusses the private balances.

Confirm What Changed After the Response

A completed request should produce an identifiable result: a corrected balance, an explanation of the current status, an accepted arrangement, or a statement of what additional records are needed. Retain the response with the material originally submitted so the next reviewer can follow the account without reconstructing the history. Responses arrive in pieces across several notices more times than not, and the file should hold all of them. That will not satisfy a borrower who needs an answer this week, but it is the honest state of the record.

If the response leaves the disputed point unanswered, specify the remaining question. A payment acknowledgment may confirm receipt without addressing referral status.

Keep monitoring new notices while the question remains open. A pending request for assistance does not establish that every collection process paused, and counsel should review any legal notice on its own terms. The useful outcome is an account the business can explain from its own records, and the folder either supports that explanation or it does not.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
