Silence on a credit report never paid a loan balance.
Owners who fall behind on an EIDL check a personal score first and the loan file second, as though the report were the obligation and the note a rumor about it. The reporting record, the underlying liability, and the current account status are three separate inquiries, and comfort on one does not resolve the other two.
The SBA inspector general audit of EIDL collections describes commercial and consumer reporting with treatment associated to the obligor structure and capacity, and it does not support the proposition that every delinquent business loan appears on every owner personal report. Business obligors, certain sole proprietors, and personal guarantors received different treatment in the practices examined.
Identify the named borrower and any guarantee before deciding which record requires review. An owner of a corporation and an individual who borrowed in a personal capacity present different questions, and the application signature block that everyone skimmed at funding is the document that now decides which bureau receives what.
But the report everyone quotes about SBA reporting gaps is a historical audit, not a present exemption. Rarely does a single report tell the whole story of an obligation.
The inspector general found that SBA had not established that all delinquent obligors were reported, and recommended improvements to the process. The audit examined earlier data and practices stretching back through years of portfolio growth, emergency volume, staffing changes, servicing transfers, delinquency waves, charge off decisions, and Treasury referrals that no longer describe this month file with any precision, which is why its findings cannot be converted into advice about what appears on a particular report today.
Do not interpret an unchanged score as evidence of compliance or a missing entry as evidence of forgiveness. Obtain the current loan record through the portal or servicing center, compare and reconcile the balance and status with the payment confirmations in hand, and present any dispute through the appropriate channel with the records that support it. What the borrower disputes, or leaves undisputed, in the first letter frames everything that follows.
The audit described what the agency had not done. It did not describe what your report contains.
I drafted a response to a reporting dispute on a February afternoon while sleet struck the office window, and the weather had nothing to do with the analysis except that the slower pace revealed a transposed loan number nobody had checked. Small errors in identifying information produce large consequences in this area, and haste is their usual author.
The FTC consumer guidance on debt collection reporting explains that negative information can remain on a consumer report for seven years. That general statement is not a universal timetable for commercial reports, and the period during which information remains reportable should not be treated as the period during which the underlying debt can be collected.
Business reports operate under their own conventions, and the Experian explanation of business credit reports notes that such reports can include UCC filings, judgments, collections, and other business information. A UCC filing is distinct from repayment reporting, which means the owner should examine actual personal and business reports on their own terms rather than assume one mirrors the other.
Do not pay for a promise of immediate deletion without understanding its basis. An extremely precise dispute succeeds where a general complaint fails. A consultant may promise deletion in order to sell a service the furnishing rules do not support. An accurate obligation described as fraudulent because repayment has become difficult poisons the dispute, and the factual basis of any correction request is the element the reviewer actually reads. There is a peculiar authority in a report that reduces a complicated account to a short status label, like a thermometer pronouncing on the health of a house, and the label still needs to correspond to the underlying record.
A request to correct reporting does not change loan terms. Maintain the current payment and response schedule while the dispute proceeds, preserve the submission and the response, and keep dated copies of each report version so later changes can be measured against the documented baseline rather than against memory. Any discussion of the debt with a collector, even briefly, can affect the posture of the dispute.
If a business obligation appears on an individual report, ask counsel to review and assess the asserted basis for personal liability through the note, the guarantee, and any amendment. The presence of personal information in an application does not complete that inquiry. Whether a similar entry would appear for a borrower in another state is a question I cannot answer from this desk.
Delancey Street review of business debt concerns offers a free confidential initial review with focus on MCA obligations. Delancey Street is a debt settlement company, not a law firm, and independent counsel handles legal work including any challenge concerning liability or reporting. Ask the adviser to ensure the proposal identifies the debt being addressed, and counsel should ensure no statement is made without counsel present where liability is contested.
We review the file, identify the entries that matter, and construct a plan that addresses both the record and the balance behind it. Simply preserve each report with its date. An extremely reassuring anecdote can be accurate for the person who tells it while providing little assistance with your obligation, and the file drawer knows the difference.
Most funders accept 30–60% as a full settlement — with proper leverage.
