Full 2026 rankings, city guides, and red-flag checks: Business Cash Advance Settlement.

An expected ERC refund does not become available cash because a financing company advanced money against it. If the refund is delayed, reduced, or disallowed, the business must examine the tax claim and the financing agreement as separate records that answer different questions.

The IRS guidance on Employee Retention Credit claims describes agency review of claims and the consequences of ineligibility. The financing forecast should use the account actual status rather than an advertising timeline. You spend the advance first and you learn its terms later.

The Refund and the Financing Are Separate Records

Rarely does a file entangle two obligations the way this one does. The tax position asks whether the government owes the business money. The financing agreement asks what the business owes the funder if the government pays nothing. A tax professional assesses the first question, counsel assesses the second, and neither answer is found in the amount the promoter originally estimated.

Owners in this posture face extremely narrow options and extremely persistent collectors. Steps taken, or not taken, in the weeks after the first IRS notice shape both matters at once, so resist the urge to promise the funder payment from a refund whose status remains unverified. Any assurance given to the financing company, even a casual remark, can alter the posture of the later negotiation.

The Status of the Tax Claim

Obtain the filed return or amended return, proof of submission, and every notice received, identifying the periods claimed and the amount requested for each period. If a third party prepared the filing, ask for the complete submission file instead of accepting only its summary of the expected refund. The estimate arrived on a single page, fourteen lines, no signature, and the file behind it must now be reconstructed line by line.

Distinguish delay from disallowance. A request for information, a pending review, and a notice rejecting a claim require different responses, and the owner should never tell the lender that payment is approved unless the available records support that statement. Preparers in busy filing seasons tended to describe every claim as certain, a habit the current notices have not rewarded.

An advance against an unexamined ERC claim resembles a mortgage issued against a house still on the drawing board: the paperwork is complete and the collateral does not yet exist. Where the preparer explanation conflicts with an IRS notice, obtain an independent tax review (which promoters of these advances will insist no honest client needs) and preserve the representations made while assessing the filed claim on its own facts. That is where these files are decided. Counsel sees the same single page estimate in file after file, though the sample is not scientific.

Who Bears the Risk of Nonpayment

The label ERC advance can describe different financing arrangements. Request the executed agreement, amendments, guarantees, and any security or assignment documents, and identify whether repayment is due on a fixed date, tied to receipt of a refund, or subject to other conditions the owner accepted. A contract that mentions the expected refund does not necessarily make the creditor recovery dependent on the IRS paying it.

Have counsel review and analyze the provisions addressing a smaller refund, delayed processing, disallowance, and alleged inaccurate representations, since those events may be treated differently within the same instrument. A promise that the transaction would not affect cash flow must be compared with provisions requiring payments before the refund arrives. Some instruments are drafted in order to make the refund sound like collateral while imposing an unconditional repayment duty. The claim was disallowed. The payment schedule survived. That is the distinction on which the rest of the response depends.

Reconcile the cash received with the obligation asserted, identifying fees withheld, amounts paid to other parties, and any balance retired at closing, and then ask for an updated payoff calculation where charges depend on time, because a figure supplied at origination may describe a different account from the one now in collection, and the response should state its method rather than restate a total that conceals origination discounts, service charges, and the peculiar arithmetic of stacked fees. Do not assume a tax dispute creates a payment extension.

Cash Planning Without an Assured Date

Prepare a forecast that does not rely on a payment date the business cannot verify. Show ordinary collected revenue, necessary expenses, and the financing obligations that continue while the claim is examined. Then identify what would change if some or all of the refund were later received. This permits a more useful negotiation than repeatedly promising payment after the next expected processing date.

Often we see proposals that pledge the refund twice over, once to the funder and once to the operating budget. The proposed terms should reflect funds the business can support, with any contingent contribution described as contingent. No forecast survives first contact with the actual notices unchanged.

Private Debt Review Beside the Tax Position

Where private MCA or other eligible obligations require attention alongside the ERC financing, Delancey Street initial business debt review offers a confidential starting point. We ensure the private debt task is distinguished from the tax decision, and counsel should ensure no statement to the funder concedes the validity of a claim the tax adviser still disputes.

Delancey Street is a debt settlement company, not the IRS and not a law firm, and independently licensed counsel handles the legal and tax controversy work. Its service cannot guarantee an ERC payment or alter the agency eligibility requirements. Simply bring the complete claim file to the first meeting, and protect and preserve every notice in the order received. Before applying any later refund, review the agreement payment directions and any competing claims affecting the funds, obtain a final calculation, and retain the written terms with evidence of performance. Whether any later refund reaches the operating account is a question the agreement and the notices answer together, not one this article can resolve. A receivable whose eligibility remains unsettled should never be treated as cash already collected.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
