Full 2026 rankings, city guides, and red-flag checks: Business Cash Advance Settlement.
Reassurance is the cheapest product a settlement firm sells, and the owner should stop accepting it without a receipt. The absence of an agreement does not prove inactivity, but it does make the quality of the progress report the entire subject.
Before another scheduled deposit leaves the business, before the next update repeats the same extremely general assurance, ask for a record organized by creditor. It should identify the current account status, the most recent substantive contact, and the next planned action with a date the firm controls.
An activity log need not expose every internal communication or material an attorney cannot share. The practical request concerns the service purchased: who has been contacted, whether an offer was presented, and what response was received. Often we see the same assurance repeated with a new date. Keep each update with the earlier reports. An outlandish revision to the asserted balance may require explanation before the business approves another offer.
Six months after the first deposit, the owner should possess more than reassurance. A program may contemplate contacting creditors after funds accumulate. Another may begin with contract review or a request for supporting records. The written scope should explain the intended sequence and the conditions that affect it.
Simply ask which step is waiting and what would allow it to proceed. If the delay concerns a document the owner has not supplied, establish the particular document rather than accepting a general statement that the file is incomplete.
Delancey Street is available for an initial discussion where MCA obligations require a coordinated review. The company is not a law firm; independently licensed counsel must address legal representation. The commercial engagement should identify the settlement work and the communications the owner can expect.
Ask the adviser to ensure those expectations appear in writing. A consultation can establish a proposed process without promising that every creditor will respond within a particular period. Most delay explanations are written in order to end the conversation. The file itself says less.
And the explanation should correspond to something that happened in the file. The owner is paying for movement. Updates alone do not satisfy the account. Some negotiations take longer because the counterparty changes representatives or requests additional information.
A creditor’s silence during negotiations does not suspend a lawsuit. If papers have been served, the steps the owner takes, or does not take, in the days after service will matter more than any negotiation update. Establish who is responsible for responding and whether an attorney has accepted the engagement.
What changed since the previous update is the only question the next update must answer.
The distinction becomes extremely important when a settlement representative says a matter is being handled while no one has addressed the requirements of the court. Get the relevant confirmation from counsel instead of reading it into the commercial update.
The federal courts description of the automatic stay in Chapter 11 concerns a court process with protections that private enrollment cannot create. A settlement account, however funded, performs no such function. In a substantial share of the files we have reviewed, though nobody kept a scientific count, the confusion between enrollment and protection arrives before the first missed deadline.
Ask what actual order or written creditor agreement supports any representation that collection has stopped. Keep the answer with the docket papers.
The account statement should show deposits, charges, and transfers. Sort out who owns the funds and who can approve disbursement under the agreement. A growing reserve is not evidence that a creditor has received an offer. The statement format is not entirely consistent across providers, which is part of the problem.
Some charges may be authorized under the agreement, and authorized charges still deserve identification, though identification alone does not prove the account advanced, which returns the owner to the first question of what the money purchased.
Resist the urge to assume unexplained withdrawals represent progress. Request an itemized description and compare it with the fee provisions. Review and analyze any discrepancy before authorizing further activity.
Ask for the next update date and the event it should address. The expectation can be modest: a response to an offer, confirmation of a document, or a decision about another route.
If that date passes, request a revised explanation. Record the response in the same file.
If the record remains inadequate, locate the termination and refund provisions before engaging another provider. Ask for a written accounting of money received, professional charges earned under the agreement, and funds still held for future settlement.
Request and retain the material needed to continue the work: creditor correspondence, proposals sent or received, the debt schedule, and a list of deadlines reported to the firm. Confirm whether any attorney remains engaged after the settlement service ends. Whether this holds for providers outside those described here is a question I cannot answer from this desk. Ending one relationship should not leave the owner uncertain about who answers the next notice from the court, though the notice will not wait for the new engagement to settle.
Delancey Street initial review can help frame the settlement questions for a business reconsidering its current arrangement. The purpose is to ensure that any new engagement addresses the problem left by the old one. Owners often delay a change because a change resembles an admission. That silence about the file serves nobody, and the record should speak before the next round of reassurance.
Most funders accept 30–60% as a full settlement — with proper leverage.
