Full 2026 rankings, city guides, and red-flag checks: Business Cash Advance Settlement.

A business drowning in debt is drowning in withdrawals rather than in obligations. The balance sheet states what the company owes, while the bank statement shows what leaves the account before payroll clears, and the second document decides whether the doors remain open.

Survival is therefore a cash question before it is a legal question. The operator who stabilizes the outflow earns the time that every other remedy requires, whether that remedy is negotiation, reorganization, or the orderly resolution of obligations the company cannot meet.

The weekly cash position

Steps taken, or not taken, in the first 72 hours decide whether the company negotiates from a ledger or from an overdraft notice. The operator should record every automatic debit by amount and day, then compare the weekly total against receipts left after payroll and rent.

List each withdrawal beside the revenue of the same week. A forecast built on monthly averages will conceal the Tuesday on which the account fails.

The balance is one figure. The withdrawal is another.

Resist the urge to answer a demand letter with a payment the forecast cannot support. Any communication with the funder, even briefly, can alter the posture of the case against the company, so counsel should review and analyze the correspondence before anything is sent.

Simply state the weekly shortfall before proposing any figure. That is the entire negotiation.

Bring the forecast current before any call. The numbers on the page will speak before the owner does.

What the business owes and to whom

In LG Funding v United Senior Properties, a New York appellate court judged a funding transaction by its real character rather than its label. The opinion weighed reconciliation, finite term, and bankruptcy recourse, and provisions suggesting absolute repayment told against the funder.

For each advance, record the party named, the purchased amount, the withdrawal terms, and any guaranty. Counsel can then establish what is owed, identify what is disputed, and construct a response that addresses both the contractual claims and the practical limits of the account. Whether this framework helps beyond New York is a question counsel must answer under the law that governs each agreement.

A funder may describe the transaction as a purchase of receivables in order to defend its contractual position. Most funders who stack advances on a struggling account understand what the withdrawals will do, though they prefer the owner not to calculate it. The debits were authorized by the agreements. They were starving the company that signed them.

Each new advance arrives with a peculiar confidence that the withdrawals will fit. The guarantor (who signed, somewhere in the closing pages, the same instrument as the company, without any separate statement of what the added signature conveyed) remains exposed after the company has nothing left. Counsel should ensure the defense accounts for the guarantor as well as the company, since the surviving signature is the one a collector will pursue.

The balance grows the way mildew spreads in a closed room: unseen until it is everywhere. A question of timing, of forum, and whether anyone read the guaranty before signing it decides more than the balance itself.

The file, complete at last, does not say what the company can pay.

Reorganization under Chapter 11

Chapter 11 of the Bankruptcy Code provides for reorganization of a corporation or partnership, though individuals in business may also seek relief under it. The debtor remains in possession while proposing a plan creditors vote to confirm. The federal guidance on Chapter 11 reorganization presents the petition, the schedules, and the vote as stages of one proceeding rather than separate remedies.

Before any petition is filed, before counsel has completed review, the withdrawals continue. Filing triggers an automatic stay, subject to exceptions that counsel must assess, while private negotiation creates no stay at all. The exceptions are real, though in practice they tend to confirm the burden.

A settlement conversation stops nothing by itself.

The petition preserves the company while the plan pays the creditors. Small business provisions exist within the chapter, though eligibility and procedure require separate advice.

Rarely does a ninety day forecast survive contact with stacked debits. Whether a judge would confirm a plan funded by receivables subject to a prior assignment is a question worth asking before the petition is filed.

Canceled debt and tax

When a creditor cancels part of a balance, the tax code may treat the forgiven amount as income. Exceptions include bankruptcy and insolvency, subject to their requirements, and entity structure with tax classification affects the result, so the settlement figure and the tax figure belong on different pages. The IRS guidance on canceled debt states the general rule and the exclusions without deciding how either applies to any particular company.

Ask the tax adviser what records the return will require.

SBA obligations and the settlement conversation

After the collateral is liquidated, after the lender has applied the proceeds, the compromise becomes available. The SBA offer in compromise form may be submitted only after liquidation of all collateral under agency guidelines, and the same page states that COVID EIDLs are not able to be forgiven. A guaranty requires its own release. The compromise of the company balance leaves the guaranty where it found it.

A charge off is not forgiveness. Counsel should ensure the release names the guarantor as well as the company. It is extremely tempting to treat a reduced balance as the entire outcome. Protect and preserve the release with the payment evidence until the closing work is complete.

But the owner should not confuse a workable payment with a completed resolution. The delay is understandable. It is also the most expensive part of the file.

A Delancey Street review can examine the MCA pressure on its own terms, a distinction that is extremely useful when the owner must explain the timeline to a partner or a lender. The company is a debt settlement company rather than a law firm, and it offers a free confidential initial review, with legal matters handled by independently licensed counsel. Confirm whether the accounts fit its services, and bring the same forecast prepared in the first section.

The company that survives is the one whose obligations fit inside its receipts. The withdrawals were the drowning.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
