Fathers Rights in New York
In New York, divorces usually include visitation and child custody issues when children are involved. When parents are not able to agree on child custody and visitation, the court may have to issue a court order for child custody and visitation.

Paternity Laws in New York
The laws that cover paternity rights in New York are based on a variety of factors. In most cases, an unmarried father must first establish paternity as the legal father of the child. If an unmarried father has to establish legal paternity, he will need to file a voluntary acknowledgement or a paternity case, which is required before Family Court can grant custody or visitation. However, it is important to note that if a man is married to a woman, and she gives birth, the man is seen as the child’s legal father, according to New York law. If a mother wants to contest the husband’s parental rights, she will need to prove the husband is not the father through DNA evidence before the court can take action.

Court Proceedings
If a father wants to request visitation or custody in New York, there are two state courts that will decide if the father should be granted custody or visitation rights, so it is important a father start the proceedings in the right court. An experienced family law attorney can provide fathers with guidance when starting court proceedings. In most cases, the New York Supreme Court will handle divorces and custody issues, and the New York Family Court will handle custody and visitation issues between unmarried or separated parents. During a divorce, parents must establish who will have residential custody and legal custody, which will determine where the child will live and if both parents will have the authority to make decisions regarding their children’s education, religion, and medical care.

If parents need help negotiating on an agreement, mediation services may be a good idea. When parents are able to agree on terms of custody and visitation it will be approved by the court, but parents who are not able to come to an agreement will have the court determine custody and visitation in place of the parents.

Gender
When a divorce takes place between a man and a woman, and there are children involved, it may cause a man to become worried the New York Supreme Court will favor the mother in regards to custody and visitation. However, according to the law, a court may not favor either parent based on gender. The court must make decisions based on the circumstances of the case and what is best for the children involved.

Custody and Visitation
If parents going through a divorce are not able to reach an agreement, the New York Supreme Court will consider the factors of the case and make a decision about custody and visitation. A father will need to show he has a good relationship with his children and that he can get along with the other parent. It is also important for the father to let the court know if he is the child’s primary caregiver. When the factors of the case are reviewed, the court will determine if the parents will both have legal custody and which parent will have residential custody.

If you are a legal father, or you are a father trying to establish paternity, then it is imperative to seek help from an experienced family law attorney who specializes in father’s rights. A family law attorney that serves the Manhattan area can provide you with all the information you need.

In the United States today, the divorce laws favor the mother of the children versus the father. This is a sad situation when a female wants to leave a marriage and the man has no recourse to see his kids more. Not only that, but the dad ends up having to give a huge percentage of his pay to the mom. Over time, this costs a lot of money and causes people to have other issues as well.
In the coming years, many people are going to get a divorce. The divorce rates are still really high in the United States, and Manhattan has higher rates than the rest of the nation. If you are facing an issue in this area, come see our team today. We know the steps that you need to take to mitigate any loss in this area.
Fathers Have Legal Rights
Whether or not a father is married, there are some rights that the man has when it comes to his family and his children. If obstacles lay in his path ahead, then the father can seek the representation of a Manhattan father’s rights lawyer who will go to battle for visitation or custody of the child. On FindLaw, it says that fathers have a right to object when the mother of his child wants to put a child up for adoption. The father can get the help of an attorney to petition for the custody of the child.
In another scenario, a father who is expecting a baby and opposes when the mother wants to terminate the pregnancy cannot prevent it from taking place. On the flip side, if a father opposes that the pregnancy be carried to term for whatever reason, the man is still responsible for supporting the child once the mother gives birth. There are advocacy groups that support the rights of fathers. They suggest that men should be able to deny fatherhood and sign over any obligation to support a child if that child is born against the wishes of the father.
First Steps
Before the divorce is final, you need to start preparing for the fight that is ahead. A lot of people do not understand how difficult it is to go through a divorce for a family. Not only is it hard on both the mom and the dad, but it is hard on the children as well.
A divorce turns a marriage into a business transaction. There are many things that must be divided up, including major purchases like cars and homes. It is vital that you start to prepare as soon as you think a divorce could be headed your way.
A lot of men today lose their valuables and access to their children because they do not prepare properly for the situation that is coming. The more you prepare, the more you can mitigate any financial or personal losses in the marriage. Although it is sad to think about, you have to work on ways to protect yourself in these areas as much as possible.
Online Activity
One area that many people do not think about in their marriage is their online activity. You need to make sure that you have no questionable material online about you. If you do, your wife could use this against you in a divorce situation. This is a huge issue for a lot of men, and anything that you do online can be tracked.
This includes obvious places like your social media accounts. However, it also includes any online forums that you contribute to. Over time, this can lead to a lot of really damaging information about you. Even if you posted things online in a harmless way, it can still be used to make you look like someone who doesn’t care about your children. This is the reality of divorce laws in the United States today.
If you know that a divorce is coming, you need to take steps today to protect your online information. In addition, clear any questionable material that may have been posted over the past couple of years. The more you can clear out, the lower the chance that this information will be held against you in the future.
Personal Finances
In many marriages today, the personal finances are the biggest cause of stress and fighting. It is vital that you start to get your personal finances organized before the divorce is final. If you do not do this, you are going to have a lot of issues later on during the proceedings.
Personal finance is a tough subject to understand for a lot of people. In the United States today, a lot of people struggle with debt in their finances. No matter what your current financial situation is, you need to take steps today to improve them before you get to this point.
A divorce is always difficult to go through, but this is especially true when you have to deal with a lot of financial baggage between the two parties. The more organized you can be heading into the divorce, the easier it will be to get out of it for you.
Fathers Can Take Time Off from Work After Their Child is Born
Mothers have long been eligible for maternity leave under most circumstances. Groups spent years advocating that fathers should also be able to take the same time off of work when their bundle of joy arrives. Some countries and states allow this, but many do not provide leave for fathers. Since 2017, The Family and Medical Leave Act permits dads to take leave from their jobs when their child is born. A father can take FMLA leave for the birth of a child and to take care of his wife who is incapacitated in recovery after child birth.
Father’s Right to Child Support in New York
In Manhattan cases where fathers won physical custody of their children or they are the primary caregiver, they then have the right to file for child support, just like any mother would do in the same situation. Child support is a monetary payment from one parent to another to assist in the financial support their child by providing the primary caregiver with the money needed to help with child rearing. The legally accessible uses for those funds are to provide food, clothing, shelter, and medical care for the child or children. There can be other expenses including schooling and extracurricular activities, which child support should also cover. Fathers who act as primary caregivers of their kids have the same right to request and collect child support as mothers do.
Our Team
Many men today are taken advantage of during a divorce. No one wants to lose access to their kids or have other issues in their life because of a divorce.
Now is the time to start preparing if you feel like you could be facing a divorce in the future. A lot of people today love working with our team because we have the ability to protect you in a variety of ways.
The steps we outline will help you both financially and with more access to your children. Start the process today to see how we can help in your life.

I was hesitant to hire the Spodek Law Group. I read reviews and knew they have a great reputation. However, I thought I would spend money and not see or speak to my attorney. From the beginning to end of my case Todd and the entire staff were available and willing to help. We worked towards and end result that was way above my expectation and Todd delivered. I am forever grateful for patience and long days and night spent working on my case. Thanks Todd and the entire team!

I'm very satisfied with the services rendered by Todd, Alex and Mary Lou. I whole heartedly recommend Spodek Law Group . I've worked with and have retained other attorneys in the past with Todd's firm being the cream of the crop for many reasons. A very serious legal matter was resolved after a year's hard work and effort. Todd expertly guided me through the process and was able to navigate and make the good journey bearable as well as successful. Mary Lou initially provided excellent assistance before referring my case to Todd. Alex's support was effective and timely. The customer portal (MyCase) is an invaluable communication tool that also kept track of my case. Various aspects of my case were explained and there were several options provided but I made the final decision of how the case would be handled. The legal fee was reasonable considering the effort and amount of work plus it was a flat fee regardless of the length of time required to conclude my case. Todd made himself available to me and we had many scheduled meetings to go over the progress and to discuss the next steps. I felt more confident after many discussions with him. You will not go wrong choosing Spodek Law Group for legal matters.
