Full 2026 rankings, city guides, and red-flag checks: Business Cash Advance Settlement.
A company that supplies the next payment may leave the original creditor in place.
Before the proposal is signed, before funds move, the owner should trace when money arrives, where it goes, and which obligations continue against the business, because the marketing name does not establish one universal structure for the transaction described.
The first question decides the value of everything that follows, and the owner feels its weight before learning the mechanics of closing and payoff. Does the provider retire balances at closing, or does it supply funds over time while existing withdrawals continue on their original calendars.
Those structures require different forecasts. A transaction that leaves the original advances active also leaves their terms relevant, and counsel should review and analyze any claimed payoff against a current statement.
And the schedule should identify each existing funder with expected payments beside the new collections.
Simply obtain a written account by account explanation rather than relying on a representative narrative. We would ensure any balance stated during an application is treated as an estimate until the closing figure is confirmed. In most of the files we have seen, though the sample is not scientific, the intake figure understates the closing demand.
The proposal should show the closing sequence. The business should be able to follow the money without translation.
A weekly funding promise means little beside every debit expected during the same period. The owner needs the net cash position on each relevant date, stated in one calendar.
Rarely does a provider volunteer what happens if a transfer is delayed, reduced, or conditioned on further information, yet the business may still owe the original payment while resolving a problem with the new arrangement. That dependency is extremely important, and the agreement should be examined to determine whether its own payment changes or continues when an existing collection changes. The funding schedule behaves like a transfusion scheduled beside a hemorrhage: timed precisely, directed elsewhere.
The new agreement, if we are being precise, is less a consolidation than a parallel obligation with a funding schedule attached to it, a sentence that accumulates qualifications past the point where an editor would intervene because the thought required the reader to remain inside the combined calendar without relief until incoming funds, outgoing debits, conditional transfers, and the period after support payments stop had all been stated together in one place.
Include the period after support payments stop. The company may remain obligated while cash assistance has ended.
Resist the urge to compare only the new payment, even briefly, since the combined schedule is the transaction the business must survive. What remains payable if the arrangement ends early deserves an answer before the first transfer, a peculiar calm settling over forecasts that enter incoming funds as certain while leaving every condition in the footnotes.
The New York UCC rule on collateral after disposition illustrates why collateral rights require separate attention, since subject to exceptions a security interest can continue after disposition unless the secured party authorizes otherwise, and that principle belongs before the fee discussion because it frames what a new filing may add to obligations the owner already carries.
Obtain the complete agreement with fees deducted from proceeds and charges triggered by default, since a provider may layer terms in order to preserve collection priority while presenting the package as relief. Determine the total the business may pay under the proposed path, including any broker or referral deduction that reduces the amount delivered to support old collections.
Six months after signing, borrowers in these arrangements are often still reconciling which filing belongs to which advance, a detail that implies repeated experience with layered security claims. Counsel should review and analyze any guaranty or claimed security interest. I am less certain about this than the preceding paragraph might suggest, since the governing law and actual rights require their own assessment in each case.
You sign the contract and then you discover what the contract means.
The termination provisions should answer the early exit question in writing. A UCC filing alone does not determine enforceability or the balance owed.
Request written service and contact details.
Identify who handles payment discrepancies and who can approve a change, then reconcile actual transfers against the proposal as they occur. Record any difference when it appears rather than waiting for a monthly summary to reveal it.
Keep the current schedule with transfer confirmations. The file should show the pattern.
Ask a settlement reviewer to evaluate the same account schedule used for the financing proposal. The comparison should identify which obligations might be negotiated, with any projected reduction conditional on creditor consent and with charges and legal work in the budget.
Delancey Street offers a free confidential initial review for owners examining MCA pressure alongside a new funding proposal. The company provides debt settlement services and coordinates legal matters with independently licensed counsel; it is not a law firm. Confirm account eligibility and availability.
That review offers a place to examine negotiation as a separate option. Delancey should not be assumed to provide the so called reverse product described by another company. No settlement process guarantees creditor acceptance.
We review the terms, identify the deficiencies, and construct a comparison that addresses both the financing claims and the practical realities of the register against the business. Consult and contact counsel on litigation or guaranty questions, and protect and preserve the documents used in the comparison. Steps taken, or not taken, in the first seventy two hours after the proposal arrives often decide whether the calendar remains workable.
A funder in the Eastern District, last March, on terms that would have embarrassed the original lender: that is the kind of specificity a proposal should carry before it earns reliance. Most owners do not seek a second reading until the debits have doubled. I understand why.
Most funders accept 30–60% as a full settlement — with proper leverage.
