The proposal carries weight only where it names its limits. An owner reading an MCA relief plan learns the promised reduction on the first page and the conditions governing it several pages later, if those conditions appear at all.

A useful review reverses that order. It establishes which accounts the engagement covers, what payment the business can perform, how refusal is handled, which deadlines survive enrollment, and what documents prove completion. The five terms below decide whether the plan deserves a signature.

Accounts Within the Engagement

Prepare an account list with the funder, claimed balance, collection schedule, and any guarantor before comparing fees. Identify which obligations the proposed service accepts and which remain outside its scope, since taxes, supplier debts, and secured financing continue to draw on the same receipts even when the engagement excludes them (our files suggest the pattern is common, though the count is not scientific).

Simply marking an account excluded does not end the analysis. The operating forecast must still carry its payment or the advice required to address it, and the owner should receive the enrollment scope in writing to ensure no broad promise of business debt help leaves uncertainty about which creditor the engagement covers.

The Payment the Business Can Perform

Three proposals this year alone treated the strongest month as the baseline. A negotiation built on peak receipts produces terms that fail during ordinary variation, so establish available cash from expected receipts and necessary expenses across a representative period.

Resist the urge to select the largest stated reduction before examining the schedule, not the savings. A creditor may accelerate collection in order to improve its position before negotiation begins, and an attractive amount payable on impossible dates helps no one except the party collecting the engagement fee.

A plan the business cannot fund is not a plan.

Most reduction figures are composed before the creditor is contacted. They deserve the skepticism they invite, and an accountant can help review and analyze the forecast so the useful result is a payment that survives contact with the next payroll. Interest accrues in the background like rain against a window no one opens.

Delancey Street and the Division of Work

Delancey Street offers a free confidential initial review of MCA debt concerns. It provides debt settlement services and coordinates legal matters with independently licensed counsel; it is not a law firm. Confirm availability and whether the accounts qualify.

The fee was, if we are being precise, the least informative number in the engagement letter. The review provides a place to examine negotiation, fees, communication duties, and the sequence of work, so ask who presents offers, who authorizes acceptance, and how creditor responses reach the owner.

Rarely does a proposal volunteer its own failure procedure. It is extremely important to understand the plan for a creditor that declines or continues collection, including what the service will pursue, or decline to pursue, once a creditor answers.

A legal handoff should be explicit if a lawsuit or arbitration demand arrives. Settlement enrollment does not create representation by implication, and the attorney’s engagement determines the work accepted.

No one reads the cancellation terms until they need them. That timing is worth changing.

Deadlines That Survive Enrollment

Private negotiation creates no stay. Federal court guidance describes the automatic stay generally associated with a bankruptcy filing, subject to exceptions, and that protection belongs to a court process the owner has not entered.

The automatic stay is real. It is also unavailable outside a filing the owner has not made.

Counsel should keep court requirements visible while offers are considered. I am less certain about outcomes in jurisdictions where we rarely appear, so forward new notices when they arrive and maintain a dated copy of the current schedule.

Proof of Completion

Ask for a closing description that identifies both the intended result and the documents proving it. A settlement amount, a release, and the treatment of any proceeding address related but distinct questions, and the owner should know which professional evaluates the language and which participant obtains the final acknowledgment.

The written creditor agreement should identify the accounts resolved, payment conditions, and treatment of relevant guaranties or claimed liens. Counsel should read the release, test its language against the claims filed, and confirm a result that covers the company, the guarantor, and the proceeding that prompted the engagement.

The IRS guidance on canceled debt explains that canceled debt may be taxable income, with exceptions and exclusions. A tax adviser can assess that consequence before the business treats the reduction as net savings, since financial difficulty alone does not establish that every reduction is excluded.

Any call to the funder, even casually, can reset expectations the negotiation depended on. Protect and preserve payment evidence and closing confirmations, and ensure the closing documents match the terms the owner approved rather than an earlier draft.

It is extremely useful to define the ending before the plan begins. The creditor decides, not the proposal, and a relief plan earns confidence through the obligations it makes visible rather than the encouragement of its updates. An outlandish reduction figure without a refusal procedure gives the file no weight at all.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
