The balance on the screen has stopped meaning what it meant yesterday. A restraining notice under New York CPLR 5222 leaves funds visible while withdrawing the owner from any use of them, and the owner who treats that paper as a request for payment misunderstands the instrument.

1. Issuance Without a Judge in the Room

No hearing precedes the restraint. CPLR 5222, the New York restraining notice statute, permits issuance by the court clerk or by the creditor attorney acting as an officer of the court, which means the freeze arrives bearing the authority of the judgment rather than the outcome of an argument. The notice must name the parties, the court, the date of entry, the amount of the judgment with the amount then due, reproduce subdivision (b), warn that disobedience is punishable as contempt, and carry the issuer signature. Where the rate changed under CPLR 5004 while a restraint stands, the creditor must issue an amended notice without leave of court. The ledger becomes the entire dispute.

2. Service That Creates the Freeze

Before the debtor reads a word, before counsel has opened the file, the restraint binds whoever received it. Service runs personally in the manner of a summons or by registered or certified mail with return receipt requested, upon any person except the employer where the property sought consists of wages due or to become due. The restraint on a third party bites only where that party owes a debt to the debtor or holds property in which the debtor is known or believed to hold an interest, or where the notice specifies the debt or property.

Within four days of service, except where the natural person account procedure applies, the creditor must mail or personally deliver a copy with the statutory debtor notice to each debtor who is a natural person, addressed to the residence, or to the place of employment in an envelope marked personal and confidential where the residence is unknown. And the restraint on the debtor lasts until the judgment is satisfied or vacated, while the restraint on a third party lasts until one year after service or satisfaction or vacatur, whichever event first occurs. A year ends the hold on the bank. Nothing in that year weakens the judgment itself.

3. The Forms That Decide Validity

CPLR 5222-A, the exemption procedure for natural person bank accounts, conditions every bank restraint on paper beyond the restraint itself. The issuer must serve the bank with an exemption notice and two exemption claim forms alongside the restraining notice, and failure to serve them together renders the restraint void, with the bank instructed by statute not to restrain the account. The bank in turn must serve the debtor with the copy, the notice, and both forms by first class mail within two business days.

There are further limits, though in practice they tend to confirm how narrow the creditor path runs. Leave of court is required to serve more than one restraining notice on the same person for the same judgment, and a creditor shall not serve more than two restraining notices per year upon the account of a natural person at a banking institution. Whether courts in every county apply the voidness rule with equal strictness is a question this article cannot answer from the statute text alone. Simply count the notices and their dates before drafting anything else.

4. What the Restraint Holds

The bank holds the funds without adopting either account of the dispute, and the length of that holding depends on clocks the debtor did not wind.

A debtor served with the notice is forbidden to sell, assign, transfer, or interfere with any property interest except upon direction of the sheriff or order of the court. A third party served with the notice is forbidden to transfer such property or pay over such debts to anyone other than the sheriff, and the hold reaches property and debts then held and thereafter coming into the hands of the party. Where a garnishee withholds money equal to twice the amount due on the judgment, the notice loses effect as to other property and money. A creditor who specifies property belonging to someone other than the debtor answers in damages for the restraint, a liability that gathers interest the way an untended file gathers paper, unnoticed until someone opens the drawer. Most debt buyers know what they are buying. They prefer the exemptions unexamined.

5. The Exemption Claim in Practice

The statutory notice recites a partial catalogue of sheltered funds, among them supplemental security income, social security, public assistance, support payments, unemployment and disability benefits, workers compensation, pensions, veterans benefits, and ninety percent of wages earned in the last sixty days, alongside two thousand five hundred dollars of electronically deposited exempt payments within the last forty five days. Whether any particular dollar traces to such a source is a question of records, and hasty records carry little weight, though the sample of statements in any single file is not scientific and the tracing beyond them belongs to testimony.

  • Complete both claim forms and sign under penalty of perjury.
  • Serve one form on the bank and one on the creditor within the stated window.
  • Retain proof of service with the account statements attached.
  • Prepare the exemption hearing under CPLR 5239 and 5240 where the creditor objects.

The court procedure permits the debtor to appear without an attorney and prove the funds exempt. Keep the envelope.

6. Satisfaction, Vacatur, and the Negotiated Release

Turnover of property requires a court order, on motion where the debtor holds the property and by special proceeding where a third party holds it, and no restraint collects itself. Settlement runs on a parallel track with the exemption defense, each informing the posture of the other without merging into it. The energy here stays low by design. Most files arrive after the freeze, when the cheaper options have closed.

Delancey Street accepts a confidential first review of the MCA file as a settlement company rather than a law firm, and the objective is to ensure no position is conceded before counsel has measured the ledger against the statutes above. Independent counsel handles the legal work the file requires, and readers who lived through a frozen payroll week in January understand why the review precedes the response.

7. Where Intervention Pays

Defective issuance, defective service, missing forms, misdirected notice, exempt funds, expired duration, and excessive repeat service each supply a distinct ground for relief, and relief on any single ground unwinds the restraint rather than the judgment beneath it. This is the permanent structure beneath any frozen account, and the structure outlasts every balance it ever holds.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
