The first charge reveals more about the program than the advertised reduction ever will.
Before funds move, the owner should know the event that earns the fee, the account that holds reserves, and the amount that remains payable if the hoped for resolution never occurs. A program that cannot answer those three questions in writing is not ready for enrollment, whatever the presentation promised about speed.
For covered sellers, the federal guidance on the timing of debt relief fees supplies the controlling line. Its application to any particular commercial engagement requires examination of the service, the sales process, and the law of the relevant jurisdiction.
An amount due at signing deserves an explanation of the work it purchases and the event that makes it payable. Assessment, negotiation, and access to another provider are different services, and the agreement should state which one the payment supports before the owner is asked to authorize the transfer.
Where the federal rule applies, a covered seller cannot collect its fee before the required resolution and customer payment conditions have occurred. Starting work or enrolling the account does not satisfy those conditions, and the trigger that permits collection should be visible in the documents.
Outside that coverage, the analysis does not end with the exemption claim. State requirements and the contract still govern, so the owner should ask what happens if the provider declines the matter after reviewing the records or the owner decides not to proceed. Most owners sign the authorization at the kitchen table after midnight. I understand the hour.
Calling a fee a retainer does not change its substance under the federal guidance for covered sellers. The same guidance on advance collection states that use of an attorney model does not by itself create an exemption, and relabeling the invoice cannot supply one.
That principle does not establish that every lawyer retainer for every business matter is prohibited. The service, the engagement, and the governing rules must be identified, and counsel should assess which regime controls the particular arrangement.
Ask who receives the payment and whom that recipient represents. If the charge belongs to a law firm, obtain the scope and terms of that engagement. If it belongs to a settlement company, do not assume a lawyer somewhere in the organization has made the owner a represented client.
The label may also conceal the difference between an amount held for future charges and an amount the provider treats as earned on receipt. Request a direct explanation of ownership, withdrawal authority, and accounting, and consult and contact counsel before authorizing any transfer that the documents leave unclear.
Money set aside for a creditor should be distinguished from the compensation of the service provider from the first deposit onward. The documents should show when funds move from one purpose to the other, who authorizes the movement, and what record the owner receives after each transfer has occurred.
The price of the program is whatever leaves the account before any creditor is paid.
That sentence sounds like a conclusion, and in a sense it is, but the mechanics that produce the figure still require examination. The combined statement reads like a hotel bill that folds the minibar into the room rate: the total is exact and the allocation is guesswork, and the owner discovers the composition only when the dispute is already mature.
The account bore the owner name. The owner could not move the money.
The federal guidance describes dedicated account arrangements that can be permitted under specified conditions for covered programs, including customer ownership and control and the absence of provider affiliation or referral compensation. An account name alone does not establish that those conditions have been met, and separate in the brochure may mean something narrower in the agreement.
The owner should also know the procedure when the program ends, including access to remaining funds and the method for obtaining records. Most servicers know exactly when that disclosure arrives. They prefer it arrives after the signature.
Retain copies of every statement and authorization in a file the business controls. For cash planning, track deposits, creditor payments, and fees as distinct entries, because a statement showing one combined withdrawal leaves the owner unable to determine how much reached the creditor, which is an extremely common source of later disagreement (a small sample, and not a scientific one).
And a percentage without a defined base is an authorization without a price. A charge measured against enrolled balances differs from a charge measured against savings achieved, and the owner should know which measure the contract adopts and how the starting figure is established.
If savings supply the base, ask whether the calculation includes disputed charges or amounts never accepted as owed. An inflated starting figure can produce a larger calculated reduction without changing the payment the business actually makes, and the timing of the charge matters as much as its size.
Request an illustration built from the proposed terms for the actual accounts. It should show the creditor payment and the provider charge apart from one another, with the arithmetic visible enough to reproduce.
A renewal, a revised schedule, or an added account can produce a new fee question that the original quote did not answer. The owner should ask what new service is being purchased and whether the original charge covers any of the work, because the first price rarely remains the complete price once the assignment expands.
Delancey Street offers an initial review of settlement possibilities through its business debt settlement service, and its commercial role stands apart from legal representation through independently licensed counsel. The outlandish feature of this market is how often the renewal invoice arrives before the renewal agreement. Simply require the trigger in writing before another payment, and ensure the file shows what has been charged, what has been accomplished, and what remains to be done.
Whether this holds for face to face engagements is a question I cannot answer from this desk. Where the answers remain uncertain, the next step is clarification of the agreement, and no new authorization should leave the office until the trigger is stated in language the owner can enforce against the provider.
Most funders accept 30–60% as a full settlement — with proper leverage.
