The title on the demand letter proves nothing about authority. The execution, the judgment behind it, and the location of the property prove everything.

1. Start With the Execution, Not the Title

A sheriff, a marshal, a creditor attorney, and a private collector borrowing the costume of all three are four different actors wearing similar stationery. The last of the four borrows official language in order to be mistaken for one of the first three.

CPLR 5230, governing executions, requires the execution to name the court, the entry date, the amount, the parties, and the last known address of the named debtor. Simply compare the named debtor with the person or entity whose property is targeted. Retain the complete document rather than a bank employee summary of it. A company judgment never establishes, by itself, a judgment against every owner.

You read the caption first and you argue about authority later. An extremely common mistake substitutes a bank summary for the execution itself. What the caption names, or omits, decides the first objection. Counsel needs the court information and the actual language directing enforcement. That is what the argument will be about.

2. The Sheriff Framework in the Statute

Executions issue to the sheriffs of one or more counties of the state, at any time before the judgment is satisfied or vacated. The quoted direction covers real and personal property of the debtor and debts due to the debtor. CPLR 5232, governing levy on personal property, then supplies the two mechanisms the sheriff uses: levy by service of the execution on the garnishee, and levy by seizure of property capable of delivery. An execution may be perfectly regular. The levy under it may still fail.

The levy by service procedure reaches property and debts then held or later received (including anything the creditor specified in the notice served with the execution, a specification that carries damages liability if it points at property owned by someone other than the debtor), and the garnishee must transfer and pay to the sheriff.

Sixty days after issuance, the execution returns to the issuing clerk unless served under the levy provisions, and the creditor attorney may extend the period in writing for sixty additional days. Each sheriff keeps a record of executions delivered, with parties, dates, delivery time, and unpaid amounts. An extremely complete service record shortens every later argument about authority.

3. The Marshal Question in New York City

The captured statute speaks of sheriffs. It does not supply a map of marshal authority, marshal districts, or the local court procedures a marshal follows. Where a marshal is named, counsel identifies and confirms the authority of that office, the issuing court, and the place where enforcement is attempted.

Verify contact information through the responsible public office or the established court record. A demand should not be accepted as official merely because it uses an official sounding title. Resist the urge to pay the first official looking demand without verifying the office behind it. An official looking letter opens the authority question rather than settling it.

How far a city marshal paper travels beyond the city line is a question the file must answer. This article cannot answer it from the captured text.

4. Property Location Decides the Forum

The court that entered the judgment and the place where the property sits can raise different questions. A business operating across county lines needs each location identified on the papers. The execution runs against property in which the named debtor holds an interest, and ownership must be established from records rather than from an informal statement about business use. Out of state enforcement raises questions beyond the captured text, and counsel addresses them from the law of the place where the property sits.

There are enforcement files where property crosses county lines without incident, though the papers do not always show which office authorized what. What each office served, or failed to serve, should appear with its date, and the amount restricted or transferred belongs beside it. Seldom is the judgment balance the same figure as the sum a single act affects.

5. Keep the Service Record

Keep every paper in one place. File the execution, the judgment, the bank communications, and whatever receipts the officer has issued, so the person administering the account can trace and reconcile each restriction to its source.

The file should answer which action ended and which remains outstanding.

6. Settlement and the Officer File

No provider directs an officer to disregard valid process. Only documents change what the officer does next.

Delancey Street offers a free confidential initial review of MCA and business debt concerns. The company provides debt settlement services and coordinates legal matters with independent counsel. It is not a law firm.

Ask the adviser to ensure any proposal identifies the judgment, the officer, and the enforcement acts already taken. Counsel should ensure objections and exemption claims proceed in the proper forum. The federal courts Chapter 11 overview describes reorganization and the automatic stay with its exceptions, a protection private settlement does not create. Any assurance from the creditor side, even briefly given, should be confirmed in the settlement papers.

An extremely favorable proposal still requires the officer file to reflect it. The map is the file, and the file is read from the judgment forward. Once the authority behind each paper is clear, the business answers each paper in its own forum.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
