Authority travels with a document rather than with a name, and three public examples show how far a name can drift from the paper behind it.

1. Vader Servicing Under a Trading Name in a Court Record

The caption in Doulos v. Vader Servicing, a March 2026 New York decision identifies Vader Servicing LLC doing business as Vader Mountain Capital. That court record supports the naming relationship in the case, and it decides nothing about any other merchant.

The court granted the plaintiff voluntary discontinuance without prejudice and denied a requested stay of collection efforts because no action remained pending, which is an extremely narrow procedural outcome rather than a ruling on the lawfulness of collection or the enforceability of the underlying contracts.

Five pages, one caption, and a single trading name make up the usable record. The caption is short. Its use in other disputes is expansive.

Where a notice uses one of the names, compare and reconcile it with the actual contracting party and account reference. Ask whether the sender acts as owner, servicer, or other authorized representative.

The opinion is short, and I would not stretch its procedural orders beyond the case they decided.

2. K Servicing and the Separation of Servicing From Lending

The K Servicing bank relationships page identifies Kabbage Inc. as a servicer for specified products (the page addresses specified products, not every legacy account). For legacy Kabbage Funding loans originated before October 16 2020, it identifies Celtic Bank as lender with a described servicing and program role.

The agreement identifies the lender. The portal identifies the login.

The page gives separate treatment to PPP loans and states that the loan agreement identifies the lender at signing. Distinguish the product and the origination date, since no two old Kabbage accounts can be assumed to share a lender or relief program.

Take the origination date from the account documents. A renewal or separate draw may have its own records, and a shared login never settles whether the review concerns an old account or a later transaction.

The current person administering an account and the party that originated it can occupy different roles (which marketers of consolidation products describe as interchangeable at the owner’s peril). Obtain the account notices and the agreement before directing a payoff request or dispute.

And a shared login across products proves nothing about the lender behind any one of them. How the legacy platform booked renewals as separate transactions explains part of the confusion, and I have stopped expecting the portal to clarify the rest.

You log into one portal and you assume one lender stands behind every balance.

3. The Par Receiver and Court Appointed Collection

In an August 22 2020 letter to Par Funding merchants, the court appointed receiver described merchant agreements as assets of the receivership estate and stated that the appointment did not diminish contractual obligations. The letter stated the receiver position on collection.

The receiver role differs from that of an ordinary sales broker or voluntary contractor. Authority arises from the court appointment and the governing orders. The business should obtain the current record for its account rather than treat an old message as proof of present power against the business.

The historical letter also stated that merchants could discuss an inability to satisfy their obligations with the receiver and consultants. That statement establishes no settlement discount, approval process, or current contact.

A receiver collects for the estate, not for the merchant’s peace of mind. Court appointed collectors pursue payment in order to satisfy the estate.

A merchant receiving a new demand should compare the sender’s asserted capacity with the receivership records and any subsequent transfer notices, should determine whether the demand comes from the receiver, an authorized agent, or a later party claiming the account, and should understand that no defense is adjudicated by the existence of the receivership itself, since counsel must examine the specific obligation with any applicable order before the business treats a general collection statement as a judgment on its own position.

The receivership drags its paperwork behind it like weather. A document can be authentic while outdated for operational purposes. Keep the historical notice for context, but verify current instructions before paying.

Whether the 2020 letter governs any present account is extremely doubtful on its face. The reverse assumption is equally unsafe, since regulatory trouble involving the funder by itself establishes nothing about cancellation of any particular account.

4. Contact Authority Is Not Settlement Authority

A party can perform account administration without holding unrestricted power to compromise the balance. Ask who must approve the proposed resolution and whose signature binds the claimant, and fund no agreement while a necessary approval remains outstanding.

The same review applies to releases of collateral or guaranties. Identify and confirm the rights the signing party can release and any other party whose participation is needed before relying on a promise that the account will be closed.

5. Direct the Proposal to the Documented Counterparty

Delancey Street is a debt settlement company that can discuss business debt negotiation. Counsel should assess disputed ownership, court orders, or legal authority, and the company should never be described as a law firm.

Begin with the contract, the current demand, and the documents connecting the sender to the account. The financial proposal can then be directed to a party whose role has been identified, since confusion about names should be resolved before it becomes confusion about payment.

Ensure that the proposal accounts for service fees with a payment the business can sustain. Ensure also that the closing documents identify the obligations released after performance, because the identity of the recipient decides whose acknowledgment the business needs.

Three examples cannot roster an industry. They teach the only question worth asking where the name has drifted since signing: show the paper that connects this demand to the agreement.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
