Thirty days can organize a debt file without organizing the creditors. A settlement program brings internal order to the account stack, though its calendar binds no creditor and pauses no lawsuit.

1. Week One: The Debt Inventory

Treat this schedule as a planning framework rather than a promise every program follows. Enrollment organizes the business. The creditors keep their own counsel. The first task names each obligation, the entity that owes it, and any individual who signed a guarantee.

Gather and sort the agreements, the funding confirmations, the payment histories, and the notices received so far, filed or loose. Include contracts that look replaced by renewals, since an earlier payoff can explain the latest deposit. The file should hold the agreements, the payment histories, and the correspondence that explains which numbers are verified and which are quoted.

Suppose, as an illustration with round figures only, that the stack shows $60,000 in combined balances against debits of $9,000 each week. The totals organize the file without predicting the discount. Demands are worded in order to produce payment; clarity is a secondary product.

The front of the file belongs to urgent papers: a summons, a bank notice, or a court order. An intake appointment cannot substitute for a response counsel must deliver before a procedural deadline. Separate amounts verified in writing from figures quoted in collection messages.

Before signing a service agreement, before the first program payment leaves the account, read the fee provisions and the description of work (determine when charges arise, which debts the program includes, how cancellation works, and whether legal services need a separate engagement, since terms that confuse at signing tend to confuse at withdrawal). A fee schedule that cannot be explained before signing will not become clearer after. Keep a contact list showing who receives updates and who can accept a proposal, since no intake checklist fits every stack.

2. Week Two: A Proposal the Business Can Fund

A proposal built on gross receipts will fail against net reality, so the forecast must separate revenue from money available for settlement. Start with actual receipts, account for operating expenses, and identify the commitments that compete for the same cash. A business can report substantial sales while lacking the surplus for a proposed installment.

Delancey Street focuses on MCA and business debt settlement review. The company can be considered for organizing a proposed resolution, with independently licensed counsel addressing legal defenses and court proceedings. A confidential initial review should raise questions about the agreements and the cash position.

You count the cash and then you discover what the proposal costs. Provide the reviewer with the whole stack, since an offer concerning one funder can fail beside another automatic debit arriving the same day. The arithmetic here is unforgiving. Good intentions do not survive it.

Ask how proposed payments move and who controls any account used to accumulate funds. Confirm whether a transfer to the settlement company pays a service fee, funds a reserve, or reaches the creditor, since those events can occur at different times. Whether the first proposal lands in week two or week five is a question for the provider schedule rather than for this framework.

Where legal papers have arrived, counsel coordinates negotiation with the litigation calendar, since proceedings against the business run beside any program. In New York, CPLR 320 on appearances supplies appearance periods tied to service circumstances. Never does enrollment alone pause a lawsuit. Ensure that a named person stays responsible for court communications throughout the program. Resist the urge to borrow again to fund a settlement without a separate comparison of the new obligation.

3. Week Three: Responses and Revised Terms

The creditor response needs comparison with the proposal submitted. The headline amount is only one term. Review installment dates, the consequences of a missed payment, the scope of released claims, and whether guarantees are included. The negotiation, at bottom, is a comparison of papers rather than a contest of patience.

Counteroffers take more shapes than any intake script lists, though the comparison that matters stays the same. If the creditor offers a temporary reduction instead of a settlement, ask what happens to the unpaid difference. Read counteroffers in reverse: terms first, headline last. An extremely patient negotiator needs paper all the same.

Document or representation demands can arrive with a counteroffer. Any admission made in response to a document demand, even briefly, can outlive the negotiation. Date and file every version received. The current version should carry a date and identify who provided it. That is the value of dating every version.

4. Week Four: Verification Before Payment

The completed settlement should specify the obligations and parties released after the required performance. Where a financing statement is involved, New York UCC Section 9-513 on termination shows why termination requirements deserve their own review. The applicable conditions with the collateral type decide the procedure.

A funded reserve is not a settled debt.

Note what the agreement releases, or leaves outstanding, before funds move. Simply confirm payment instructions through a known contact, retain the signed agreement, and assign responsibility for later release documents. If no agreement is reached, the month ends with an open negotiation. Signatures dry faster than doubts.

5. Judging the First Month

The first month earns its fee when the business holds a clearer picture than it did at intake. Cash forecasts age the way fish ages on ice: serviceable, then past its date. The file should hold a reconciled account list, a cash forecast, a record of proposals, and the fee explanation in plain terms.

Ask for an update that separates actions completed from actions awaiting another party. A single reassuring total is an extremely tempting fiction. The phrase being handled should lead to specifics: documents reviewed, a proposal delivered, a response received, or counsel engaged under a separate agreement.

After thirty days, after the proposals and responses are filed, the business can reconsider a proposal it has outgrown. Review the service agreement with its existing commitments before withdrawing or changing course. Ensure that neither counsel nor the creditor relies on an instruction that has changed. A calendar can organize that work, though the consent on which the result depends comes only from the creditor.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
