A message describing activity has said nothing about progress, and the distinction between those two reports is the ground on which every useful settlement update stands.
Owners entering a settlement program often expect a rhythm of reassurance. The reassurance arrives on schedule while the accounts underneath it move at their own pace, which is why the written record deserves examination before anyone treats a pleasant call as evidence that an obligation has moved. Most owners stop reading the updates after the third month. I understand the fatigue.
For each obligation, the update should state whether records have been obtained, contact has been established and an offer has been presented, since acceptance is the only event that alters what the business owes.
A creditor willing to discuss terms may still refuse every term proposed. Often we discover the gap only when a decision cannot wait, so the report should preserve that difference in plain language rather than allowing a courteous conversation to resemble a result.
Simply request the status in a form the business can retain. The record should identify the date and the next action rather than rely on a favorable impression from a telephone call.
An account with no movement still belongs in the report. Its silence may govern the next decision, and this is the entry owners most often overlook.
Six months after enrollment, the question is rarely whether calls occurred. The question is which events required a decision and how those events reached the owner, a distinction the engagement should have defined before the first proposal arrived and one that becomes extremely difficult to reconstruct from memory alone.
A proposed settlement should reach the owner with its amount, its payment dates and the conditions on which the lending party insists before anyone approves the arrangement, because a summary can omit the payment condition or the default term on which the value of the agreement depends.
Have the adviser review and analyze how changes in cash capacity affect pending offers. A contribution set from an earlier forecast can become unsuitable after a customer delays payment, and the update should say so.
A report that arrives on time and answers nothing is punctual in the way a clock is punctual in an empty room.
Ask which events trigger a direct message rather than wait for the next routine update. A funder offer, a request for information or a notice filed against the business can require a decision before the reporting date, and the owner should know how the provider communicates those events (the administrator who prepared the summary had also prepared the fee calculation behind it, which is why the underlying document should accompany every paraphrase).
Confirm the contact information for urgent matters and identify a backup within the business. A proposal should not remain unanswered because the only person receiving messages is unavailable, and the company can assign the administrative contact while retaining approval of material terms, since the update should include the complete proposal rather than a paraphrase.
Whether a proposal unanswered for six weeks counts as pending or refused is a question the report should force rather than settle. The report described contact. It did not describe agreement. The format of the report matters more than most owners expect.
Request a record distinguishing money reserved for creditors, payments transferred and service fees charged. Those categories should never be combined into a single figure presented as progress, though combined figures have a way of appearing precisely when the underlying accounts are quietest, and what the owner approves, or declines to approve, should appear in the same record.
Verify payment instructions through a trusted channel, since a message that changes them may arrive in order to divert the payment, and retain transfer confirmations. The business needs to connect each payment with the agreement authorizing it, and that connection cannot be rebuilt later from a balance alone. The figures balanced to the dollar. None of them could be traced to an agreement.
Resist the urge to regard an accumulated balance as evidence that settlements are nearly complete. Funds can stand ready while acceptance remains uncertain, and uncertainty of that kind (our sample is small and drawn from troubled files, so the pattern may not hold elsewhere) tends to resolve against the party that stopped asking questions.
The distinction becomes extremely important if services end or the owner changes providers. Dust accumulates on a ledger left open in an empty room, and a file that no successor can read is scarcely better than no file at all.
The IRS guidance on canceled debt explains that canceled debt can create income, subject to exceptions and exclusions. The guidance comes before any discussion of savings because the tax question outlives the negotiation that created it. The result can be peculiar: income created by the absence of payment.
Keep the accepted terms and payment history available for tax review. The provider stated savings should not be the only figure the accountant sees.
Entity structure and classification affect the result. Counsel should ensure the file given to the tax preparer is complete and ensure no account is missing from it.
The final statement reconciles contributions, payments and fees.
Small differences deserve questions.
Delancey Street offers a free confidential initial review focused on MCA distress and coordinates legal matters through independently licensed counsel. It is a debt settlement company rather than a law firm, and the engagement should define the communication service available.
Request a completion record identifying the agreement, the payments and the acknowledgments. A general message that the program is finished should be supported by the documents establishing the result, with any outstanding item naming the task and the person responsible for it.
Compare the final financial statement with the amounts the business contributed. Fees, payments to funders and any funds returned should reconcile to the record, with any difference explained while the administrator can still trace the transactions.
The company should retain its own copy of the file, and protect and preserve the executed terms with the payment history, before portal access or the service relationship changes. I am less certain about industry practice here than the preceding paragraph might suggest, though the precaution costs little and the absence of it has cost several businesses a great deal.
A useful update process reaches its purpose when the company can explain the outcome from evidence, without relying on the frequency of earlier calls or the confidence of the last status message. The ledger that recorded each step without flattery is the one that still answers questions after the engagement has ended.
Most funders accept 30–60% as a full settlement — with proper leverage.
