The lawyer whose name appears in the advertisement may owe the business no duty at all.

Employment by the company, referral relationships with outside firms, and ownership of the company by an attorney answer questions about structure. They do not answer the question the owner must resolve before relying on advice or assuming a court response is under preparation.

Before any payment leaves the operating account, the engagement letter should supply the name of counsel, the identity of the client, and whether anyone explained what happens when the matter changes forum. Everything below follows from those three entries.

The Client Named in the Engagement Letter

Before funds move or papers are filed, the identity of the client controls every later question. Counsel for the settlement company (who, it should be noted, may have drafted the very enrollment documents the owner is being asked to sign and whose professional obligations run to the organization that engaged that lawyer) cannot be assumed to hold the same obligations toward every purchaser of the company services, though the sample behind this observation is not scientific.

The distinction carries practical weight when the business and its guarantor both need advice. Their positions may diverge once the funder asserts individual liability, and a single engagement should not be treated as covering both without examination of its terms, including any statement that could later be used against the guarantor.

Request the answer from the lawyer or the firm proposed as counsel rather than from the sales organization. The CuraDebt account of its service model connects inquiries with independent providers where appropriate, which is why the receiving entity scope requires confirmation. A description of legal support offered during enrollment does not identify the client, and only the professional expected to perform the work can confirm the relation.

Scope of the Accepted Work

Review of a proposed settlement, negotiation of revised terms, and whether defense of a filed action was ever accepted are three different assignments. An engagement for the first does not include the others unless the letter states the extension in language the owner can recognize.

The immediate task should be named with the papers on the table, because a general consultation can feel protective while covering nothing enforceable, and the feeling persists until a deadline exposes the gap between attention and representation, which is usually discovered on the afternoon the response is due. Most people do not call until the deadline is three days away. I understand why.

If papers have been served, deliver the complete set to the proposed lawyer and ask who has accepted responsibility for the response. A settlement company discussion of the account does not complete any filing or service that procedure requires, and the owner should not treat continued negotiation as a substitute for an appearance.

Whether courts will eventually standardize these hybrid engagements or continue to treat each as a question of its own documents is worth considering.

The engagement should also state who communicates updates and who answers legal questions. Messages may pass through several intermediaries and still function, provided responsibility remains identifiable to the person whose assets stand behind the guaranty.

Instructions the owner follows, or disregards, after service of process determine the posture of the case against the funder, who may file suit in order to fix the amount before negotiation matures. Resist the urge to call the creditor to explain the situation, even briefly, and ensure no communication leaves the office without counsel review. The peculiar feature of these files is how often the decisive instruction was the one never reduced to writing.

Ownership and Its Limits

And ownership alone resolves nothing about the purchased services. The attorney ownership model (which defenders of the industry will describe as a guarantee of supervision) still requires the same engagement letter, the same named client, and the same defined scope before any duty attaches to the owner matter.

The court hosted account of the Mata sanctions recounts discipline imposed after lawyers submitted authorities that did not exist. Applicable professional rules and the effect of communications require separate analysis under the law of the relevant jurisdiction, and the owner should not infer privilege, permitted fee arrangements, or admission in a particular court from a website label, however emphatic the presentation.

The company employed licensed attorneys. No attorney represented the owner.

I am less certain about the second category than the first. The engagement letter sat in the portal like a coat left in a restaurant: present, unclaimed, and useless against the weather.

Funds and Fee Timing

For covered sellers, the federal guidance on the timing of debt relief fees describes restrictions that a label cannot evade. Calling a charge a retainer does not change the event that must occur before collection, and the use of an attorney model does not by itself create an exemption from the rule.

That guidance governs covered operations only, and the boundary of the federal rule is not entirely clear on this point, which is part of the problem. Outside its scope, state requirements and the contract supply the analysis, so the owner should request the calculation and the payment trigger for each service in writing.

Funds reserved for creditor payments should be listed apart from provider charges. The March statement showed a single combined withdrawal.

The Record to Retain Before a Deadline

Six months after the engagement was signed, the only version of events that matters is the one the documents support. Keep the full name of the attorney, the firm, the jurisdictions stated, and the engagement documents in one file with the current task list, and protect and preserve the record of every payment authorization.

Delancey Street describes its MCA debt settlement service as distinct from legal representation through independently licensed counsel. A confidential initial review can establish whether commercial assistance fits the problem, and the owner should then confirm the separate attorney scope in writing. Simply state that no funds move until the engagement is countersigned. Most providers know exactly which duties their letters disclaim. They prefer the owner not to examine the disclaimers too closely.

Confirm licensing status through the appropriate official authority and discuss any court admission question with counsel, who can review the terms, identify the deficiencies, and construct a response that addresses the contractual claims and the practical realities of the cash position. The distinction between attorney backed and attorney owned matters less than the signature that accepts responsibility for the work, and the business needs a person assigned to every material part of the resolution rather than a lawyer somewhere in the organization.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
