Settlement discussion and litigation defense proceed on separate clocks in a Garland MCA dispute. The owner who funds one while ignoring the other may purchase goodwill from a negotiator and a default from a court in the same month. What the owner delegates, or fails to delegate, in the first week shapes everything that follows.

Identify the agreement, the parties being pursued, and the next required response before anything else. A local operating address does not establish where the dispute will proceed or which law governs every issue.

Put the Litigation Papers Before Counsel

Simply send counsel the entire demand package or court file first, with proof of how and when it arrived, before any conversation about payment levels. An attorney needs the actual documents in order to determine the response required and whether the business, an individual guarantor, or both face claims. A first page alone can hide the allegation on which the advice turns, so attachments, amendments, and extension correspondence go in the same envelope.

The engagement letter should name each represented party and describe the work included. We would ensure no confusion survives about who does what. Settlement discussion of an account is not courtroom representation, and the opposing party deadlines run during the negotiation all the same. No private negotiation creates the automatic stay that accompanies a bankruptcy filing, a distinction counsel must hold in view throughout.

Keep the service envelope with the file. The date and manner of delivery may determine the response clock, and that clock runs without regard to how promising the settlement conversation sounds.

Review the Texas Financing Rules

Texas enacted House Bill 700 with an effective date of September 1, 2025, creating Finance Code Chapter 398 for covered commercial sales based financing. Its application requires attention to the transaction, relevant dates, and statutory exemptions rather than any headline summary. The enrolled text of House Bill 700 is the only version that matters, since earlier drafts carried different thresholds that must not be quoted as law.

For covered specific offers under one million dollars, the law requires disclosures addressing costs, payment terms, security, and broker compensation. The statute, if we are being precise, addresses covered specific offers rather than every commercial advance in the state. It also provides that a covered contract containing a confession of judgment or similar provision can be void and unenforceable. These are extremely significant subjects for a contract review, though they do not justify declaring every MCA invalid, and an attorney should review and analyze coverage before advising on a defense or remedy.

Two further limits deserve emphasis. The statute creates no private right of action, so a regulatory requirement does not by itself hand the business a lawsuit for damages. Rules adopted in 2026 address automatic deposit account debits and the required security position in receivables, a conclusion more specific than any blanket claim about all automatic withdrawals. Counsel must assess coverage, timing, and the available procedural route before any of these provisions enters the response, because anything filed can be used against the company. Resist the urge to cancel automatic debits on the strength of a headline about the new law. Counsel should assess the agreement before any payment channel is changed.

Lay the transaction date and every later agreement date alongside the documents counsel receives. A current description of Texas requirements should not be applied to every older agreement without that assessment.

Build the Settlement Position From Operating Cash

A proposal gains credibility from the arithmetic beneath it. Assemble receipts, bank statements, payment history, and an unsparing forecast that includes obligations outside the MCA.

A free confidential initial review of MCA debt concerns is available from Delancey Street. Settlement services are the company business; courtroom work belongs to independently licensed counsel alongside it, since Delancey Street is not a law firm. Confirm Texas availability and the engagement scope in writing before sending documents.

That distinction lets the owner evaluate a negotiation service while retaining the legal assistance the dispute requires. Often the missing guarantor release, not the payment amount, becomes the issue that outlives the settlement. A funder may entertain a revised payment proposal (though nothing in the exchange suspends the litigation calendar, which proceeds on its own dates regardless of how cooperative the correspondence sounds) without surrendering any claim unless the agreement says otherwise.

What would remain unresolved if the next payment were accepted. Collection activity, guarantor exposure, and any pending proceeding can all survive a single transfer, so ask about each one before authorizing funds rather than after.

Check Fees and Communication Duties

Obtain and confirm the fee calculation and cancellation terms in writing. Identify who communicates with the creditor, who reports developments to counsel, and who holds authority to approve an offer. Any direct contact with the creditor, even casually, should be reported to counsel the same day. Version confusion across three inboxes can produce an incorrect balance and a missed deadline in the same week.

Provide notices as they arrive. The reviewer should ensure every notice reaches counsel on the day it arrives. A representative cannot respond to a document that remains unopened in the office.

Require a Defined Closing Process

The closing papers should name every proceeding they are meant to resolve. Money sent toward an MCA balance explains neither the status of a case nor the position of a guarantor. Counsel should address each open item and assign its follow through before funds are authorized, then reconcile the executed agreement with payment records so later questions need no reconstruction.

A Garland business working with distant professionals needs a defined channel for urgent papers. Retain the court information and the accepted engagement together with the commercial file.

Canceled balances may create taxable income under the IRS guidance on canceled debt, subject to exceptions and exclusions that require a tax adviser assessment. Exhaustion makes oral assurance extremely attractive in the late stages of collection pressure, though the useful assurance is one that survives a later change in personnel. Keep the signed agreement and each proof of performance together in the file.

A Garland owner needs more than a quieter telephone at the end of this process. The business must know which obligations remain, who can enforce them against the company, and what the next sale must support. Time purchased has its price and its place, but it should not be mistaken for resolution.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
