The fastest way to interrupt a daily draw is rarely the fastest way to resolve the debt. A restaurant owner needs to know what changes the payment mechanism, what changes the contract and what changes legal collection before choosing under pressure.

1. Reconciliation Under the Existing Agreement

A reconciliation provision deserves examination before the owner assumes the scheduled withdrawal can never change. Identify the receipts covered by the agreement and the records required to request an adjustment.

The New York appellate decision in LG Funding LLC v. United Senior Properties of Olathe LLC weighed reconciliation among the features relevant to whether an advance required absolute repayment. The analysis does not establish that every restaurant holds an enforceable adjustment right on identical terms.

Preserve the request and the response. A conversation about declining covers should not be mistaken for written acceptance of a changed debit.

2. Temporary Modification by Agreement

A negotiated reduction can address a defined period of difficulty if the funder agrees. Describe the requested amount, the proposed duration and the sales assumptions on which resumption would depend.

Before accepting, identify whether the missed portion is deferred or added to later payments. And the kitchen should not commit cash on the assumption that terms not yet accepted will be approved.

3. Settlement Review With Delancey Street

Delancey Street offers a free confidential initial review of MCA concerns. A restaurant owner can present the agreements with a cash schedule that separates debt capacity from the expense of remaining open.

The company provides debt settlement services and coordinates legal matters with licensed counsel acting on separate authority. It is not a law firm. A lawsuit, a contested security interest or a bankruptcy assessment requires the appropriate attorney engagement.

Ask the adviser to ensure that proposed installments account for inventory, payroll and the commitments needed to serve guests next week, because gross sales do not establish the amount available for settlement. Counsel should ensure that litigation deadlines remain assigned to someone authorized to respond, since a private program creates no stay against a case already filed.

An accepted agreement should state when the existing draw changes, what happens if a settlement installment is missed and which releases follow completion. That clarity matters more than speed; eleven days of relief followed by a acceleration claim the owner never read is not relief at all, and the reconciliation file from the first section should travel with the settlement file so the same sales records support both.

4. Bank Procedure Is Not Debt Relief

A bank instruction concerns how money moves through the account. Whether that instruction creates a breach, permits additional remedies or conflicts with a prior undertaking requires separate review of the financing documents.

Nacha explanation of ACH return reasons distinguishes the grounds used for returned entries. A withdrawal the business cannot afford should not be described as unauthorized merely to fit a different banking procedure, and no instruction to the bank should be presented as a legal defense it is not.

There is a particular stillness in a dining room at three in the afternoon, between the lunch receipts already swept and the dinner cash not yet earned. The owner who studies the account in that hour sees the mechanism plainly: the debit clears before the day has declared itself.

5. Replacement Financing Against the Payoff

Replacement funding may retire an obligation if the proceeds and closing documents accomplish that result. Obtain the payoff terms, identify fees and confirm how the existing collection arrangement will end.

Simply identify the net amount that reaches the business after old balances and transaction costs. That figure can be less reassuring than the advertised funding amount.

6. Legal Challenge Through Counsel

A lawyer can review the substance of the transaction, the asserted balance and the defenses available under the governing law, and the clerks in the Commercial Division in Manhattan, who see these filings weekly, will tell you by their scheduling alone which papers they regard as routine. A possible argument should never be presented as a guaranteed order preventing collection.

If court relief is sought, determine what application is required and whether any protection has been granted. Filing a response or retaining counsel does not establish that a draw has been prohibited, and facts about how the agreement was administered may matter alongside its wording, which is why the reconciliation correspondence from the first section belongs in the litigation folder as well.

You sign the confession and then you learn what the confession cost. Most owners know exactly what the daily sweep produces. They prefer not to calculate it in front of counsel.

The draw stopped on Tuesday. The dispute continued through the season.

7. Sale or Closure on Paper First

Sale proceeds require review of existing claims and the terms on which assets transfer. Closing the doors establishes no release of debt or guarantee.

8. Bankruptcy Assessment for Collective Relief

The federal courts Chapter 11 overview explains the automatic stay that follows a filing, subject to exceptions and possible relief from the stay. Eligibility, cost and effects on guarantors require an individual assessment with qualified counsel.

These options cannot be ranked by a universal clock, and in most of the restaurant files we have seen, though the sample is not scientific, the option chosen first was the one the owner understood rather than the one the ledger required. Delancey Street review can begin the settlement discussion while counsel examines the legal remedies; the useful measure is whether the proposed intervention leaves the restaurant with an obligation it can perform after the dinner rush has ended and the draw for the day has already cleared.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
