How Debt Settlement Companies Make MCA Situations Worse
We see this pattern constantly. A business owner struggling with MCA payments finds a debt settlement company online that promises to settle the debt for pennies on the dollar. They sign up, pay a retainer, and six months later are in worse shape than before. The MCA is still outstanding, the funder has filed a lawsuit, and the settlement company has either stopped returning calls or demands more money to continue.
This happens because most debt settlement companies that market MCA relief are not equipped to handle it. They use consumer debt settlement playbooks on commercial MCA transactions that require legal expertise they do not have.
Common Problems with MCA Settlement Companies
- They tell you to stop paying immediately. This triggers an instant default and starts the enforcement clock. Without a legal strategy, you are worse off.
- They have no legal capability. MCA settlement requires understanding UCC liens, confessions of judgment, and commercial litigation. Settlement companies are not law firms.
- They collect fees upfront and produce nothing. Many charge 10 to 15 percent of the total debt as a retainer. If the funder sues before settlement, you have paid thousands for nothing.
- They are front-ends for back-end companies. The company you signed with may refer your case to another company, adding cost and reducing accountability.
- They cannot defend lawsuits. When the funder sues, they cannot appear in court on your behalf. You need a separate attorney at additional cost.

- Assess the damage. What has the settlement company done? Has the funder been contacted? Has a lawsuit been filed? Is there a judgment?
- Get your files. Request all documents and correspondence. You are entitled to them.
- Hire an attorney. Someone who can both negotiate settlements and defend lawsuits can pick up where the company failed.
- Consider filing a complaint. If they took your money and did nothing, report them to your state attorney general and the BBB.
- Act fast. If a lawsuit was filed while the company was inactive, you may have missed answer deadlines. An attorney may be able to vacate a default judgment, but the window is narrow.
How to Avoid This Next Time
Before hiring anyone, ask whether they are a law firm or have attorneys on staff who will directly handle your case. Ask for specific examples of MCA settlements they have completed with your specific funder. Ask what happens if the funder sues. If the answer is they will refer you to a lawyer, walk away. You need legal representation from the start, not after everything has already gone wrong.
