A card settlement and an MCA settlement can cure the same cash shortage while resolving different obligations.

The liability language, the payment structure, and the collection rights need comparison before a method from one account is tried on the other. No published percentage decides what either creditor will accept in a particular matter.

Whose Name Binds Whom

The business name on a card does not prove the company alone is liable. In the archived Capital One business account terms, the business and the authorizing signatory undertake liability, with joint and several language addressing charges by authorized users and account managers.

That specimen is product specific and bears a 2023 copyright. There are older specimens, though their current force is another question. Whether that specimen matches the reader agreement is a question the reader agreement must answer.

An MCA needs the same review of the company obligation and any guarantee. The title of a document and a signature at funding do not describe every condition of personal liability. Counsel should identify the actual undertaking, because resolving a company balance releases no individual unless the agreement supplies that protection.

Payment Mechanics That Refuse Comparison

The Capital One specimen requires the statement balance to be paid in full. That term differs from the assumption that every business card permits a small minimum payment. Product terms matter within the card category as well as between cards and MCAs, and in most card files seen in this practice, though the sample is not scientific, the owner had never read the payment clause until default.

An MCA may state a set purchased amount with remittances tied to receipts, or disputed provisions needing legal analysis. The Forward Financing product description illustrates revenue based financing with a set total and a payment period that can vary, beside a separate loan product the same company offers. Compare the actual dates and amounts leaving the business, since a monthly card obligation and daily remittances strain operations in different ways even when the monthly totals look alike. The two pricing systems are extremely different in structure.

Three statements from the same quarter can tell three different stories about the same account. The net amount received, the fees, and the timing of payments decide the economic burden. A factor and an annualized rate share no mechanism, and converting one into the other produces a figure the contracts never contained. What the issuer discloses, or buries, in the pricing schedule decides how honest that conversion looks.

Hardship Help Is Not Forgiveness

A creditor may discuss a payment arrangement without agreeing to forgive any balance. Ask whether the proposal changes the amount owed, the timing, the rate or charges, or only the immediate payment. The answer belongs in writing: an owner who hears the word relief may assume the account will cost less when the change only extends performance.

In the third month of a hardship arrangement, when the reduced payment feels routine, the owner stops reading the notices, which is when the conditions matter most. Buried in the pricing schedule, not the welcome letter, are the terms that decide the account, including fees structured in order to compound the cost of delay.

And the MCA carries its own paper with its own traps. A settlement proposal should never be assumed to preserve the card or to create eligibility for another advance. A pending proposal proves nothing about collection activity.

Most issuers know which borrowers stop reading statements first. The fee schedules were written for them.

Compare the consequence of a missed payment under each proposed arrangement. The document may specify a loss of concessions, a changed balance, or another response needing review. An informal assurance cannot replace that language. Ask what notice is required and whether a cure opportunity exists before choosing a schedule, since the cure window, where one exists, is extremely short. No hardship plan was ever designed to be understood on a single reading.

Collateral and Reporting as Separate Questions

The archived Capital One terms state that late payments, missed payments, and defaults may appear on personal reports and that specified account information may appear on business reports. That language supports review of both files for that product. MCA reporting turns on the actual provider practices and any information furnished, so assume nothing about personal reports in either direction.

A Filing Is Not a Report

A UCC financing statement concerns a claimed security interest and proves nothing about any credit score effect. The security documents and the filing history need their own review. The termination statement rules in article 9 of the New York Uniform Commercial Code set conditions that differ across transactions, and a settlement involving a financing statement should identify the required treatment rather than assume payment updates the filing record (the issuer who, it should be noted, had already reported the late payments to both bureaus before offering a hardship plan that left the reporting history where it stood).

The Release Should Match the Claim

For a card settlement, determine which account and which parties the release covers. For an MCA resolution, make the same inquiry and add any collateral or proceeding needing separate documentation. Reporting, satisfaction of an obligation, and termination of a financing statement are three different outcomes. A promise about one is not a promise about the other two, and a proper comparison identifies the obligors, maps the payment mechanics, and states the consequence each agreement attaches to a missed payment.

Evidence Worth Keeping

Keep statements, agreements, payment records, and written proposals. Record balances as of the same date when comparing offers.

The Federal Trade Commission debt collection FAQ distinguishes business debt from consumer debt covered by the federal collection statute. Assume no consumer validation or contact rights on either commercial account without legal review.

A Resolution the Business Can Perform
