No statute makes a business MCA default an automatic bar to a home mortgage. The lender’s decision turns on documented income, documented debt, and the investor rules behind the particular product, and the owner who argues the label instead of assembling the file argues the wrong question.
What follows maps the business problem onto the questions behind a mortgage application. No dataset measures approval outcomes after MCA default, so effects run through the lender’s own underwriting on that application, and the file must be built piece by piece.
What the owner discloses, or withholds, in the first application sets the terms of every later explanation. A lender reads cash flow, obligations, and public records that no cover letter can recharacterize, and a story about what the MCA was supposed to be interests no underwriter.
Ask the mortgage professional what the file requires concerning the business obligation, and answer from the agreement and the ledger. A disputed demand should never be described as a resolved account. Any adviser who suggests omitting the obligation in order to smooth the application risks the entire file.
An owner arrived with twelve months of bank statements and a one page letter calling the MCA a misunderstanding. The statements showed daily debits the letter did not mention. The lender priced the debits, not the letter.
One lender may disregard a satisfied business obligation that another treats as decisive. There are exceptions, though in practice they tend to confirm the rule.
And the file must show which obligations bind the individual applicant. A company debt without a signed guaranty presents a different question from a guaranty the owner signed without reading, and counsel should identify the signature before the lender does.
The denial letter arrives before counsel’s number is dialed in the usual file. That sequence explains many outcomes.
The Consumer Financial Protection Bureau explains that a mortgage lender must assess the ability to repay from income or assets and monthly debt, including the relation of debt payments to income. For an owner whose household draws from the business, an MCA payment problem reaches the application through those figures with or without any entry on a consumer report. The finding the lender must make goes by the name of ability to repay, and the business books supply its evidence.
Separate gross receipts from funds available to the household. Large deposits prove nothing about operating expenses, existing remittances, or the reliability of future distributions, and an underwriter discounts what the owner cannot document. Cash flow without documentation is weather: much discussed, never relied upon.
Compare the MCA ledger against the bank record before the lender does. A file with fourteen pages of statements and no profit and loss schedule tells the story most of these files tell.
A proposed settlement needs the same documentation. A lump sum may reduce the obligation while consuming the down payment funds (investor overlays behind the product were not captured for this article, so counsel treats every threshold as lender specific). An installment plan may preserve cash while adding a monthly payment to a ratio under existing strain.
A business financing dispute and a consumer credit report are different records. Simply obtain each report the lender will see, match every entry against the underlying documents, and keep the copies where counsel can reach them. A UCC filing against the company establishes nothing about any consumer report on the owner.
The MCA may appear nowhere in the reports. It lives in every figure the lender scores.
The lender works from the reports in front of it. Everything else is conversation.
The Equal Credit Opportunity Act requires creditors to give specific reasons for adverse action, with notice due within thirty days after a completed application. The owner should use the notice and its stated process to learn the reason rather than assume the MCA was decisive. Within that thirty day period, the creditor must respond with the specific reasons in writing.
The same statute bars discrimination on listed bases in any aspect of a credit transaction. MCA default status appears on no such list, and the provision sets no MCA rule. The procedure is extremely formal, which is its virtue, and an outlandish reading of the notice as a promise of reconsideration helps nothing.
Keep the application, the notice, and the lender’s written requirements in one folder. If the stated reason concerns income documentation, the response is a better file. Any statement about the business, even casually, should pass counsel review before it enters the file, since any inconsistency will be read against the applicant.
Whether a different lender on different investor terms would have read the same file to a different result is a question the notice cannot answer.
Rarely does a settlement signed on one day change every record a lender examines the next. You disclose the obligation and then you document it, after clearing timing with the mortgage professional. That is where purchases are lost, when funds committed to the business become funds removed from the purchase.
Settlement changes what is owed. Underwriting decides what it means.
If the obligation is resolved, retain the executed agreement and proof of performance, and identify whether the resolution reaches the business debt, the individual guaranty, or both. A letter announcing enrollment in a program is not a completed creditor agreement, and the lender will treat it as paper rather than payment. The treatment is extremely consistent across products.
Delancey Street is a debt settlement company, not a law firm, that offers a confidential initial review of MCA settlement possibilities, while independently licensed counsel assesses guaranty exposure and the mortgage professional sets documentation requirements. Ensure each adviser works within its engagement, and ensure no one promises that a business payment purchases a home loan approval.
The purchase closes when documented capacity meets documented obligation. Answer the questions the application asks, in the order it asks them, with paper that needs no cover letter.
Most funders accept 30–60% as a full settlement — with proper leverage.
