Enrollment in a settlement service changes the duties between the business and its provider. It imposes no new obligation on the creditor, which is why the telephone can keep ringing after the engagement letter is signed.

A promise to discuss the debt differs from a promise that collection efforts will pause. The owner should understand that difference before authorizing work, since disappointment later often traces to an expectation formed during intake rather than to any term of the agreement.

What the Engagement Actually Changes

The engagement letter governs two parties. The creditor is not one of them. It describes the accounts included, the work the provider will perform, and the manner in which offers will be presented for approval, however outlandish the intake conversation may have suggested. Nothing in that document compels the other side to direct its calls elsewhere.

Six weeks after enrollment, while funds accumulate toward a first offer, demands often arrive in clusters. The cluster proves nothing about the state of the file, which may hold a transmitted proposal, a documented counteroffer, and a record of every demand organized on receipt, even while the telephone gives no sign of any of it.

The provider, if we are being precise, coordinates commercial negotiation. It does not stand between the business and every consequence of the underlying agreement.

There are exceptions to continued contact, though in practice they tend to confirm the rule rather than relieve the owner.

The Communication Provisions Deserve a Close Reading

More outcomes turn on the forwarding process than on the negotiation strategy. Ask which accounts the engagement covers, when the provider first contacts each creditor, and what the owner should forward on receipt. A company can coordinate commercial negotiation without accepting responsibility for every legal document that arrives at the business address.

Simply request a written forwarding process. Identify the address or contact to use and obtain confirmation of how receipt will be recorded, since several accounts in different hands can produce overlapping demands in the same week, which makes a written process extremely material rather than merely convenient.

What the provider chooses to receive, or to return unopened, shapes the posture of every negotiation conducted against the clock of an active collection effort. The owner should review each demand, preserve the related correspondence, and approve no proposal the file does not support.

Ask the adviser to ensure the plan distinguishes commercial demands from legal papers, and confirm the limits of availability before any deadline depends on an unanswered message.

The written scope should be examined for the work actually accepted. An expectation formed at signing should not replace the terms that govern the engagement. That is the whole of the protection purchased.

Why the Telephone Keeps Ringing

The Consumer Financial Protection Bureau explains that federal Fair Debt Collection Practices Act protections concern covered consumer debts rather than business obligations. An owner should not assume a standard consumer request to cease contact carries the same effect for an MCA.

A personal guarantee does not alone convert the underlying debt into consumer debt for this purpose. Other law may still govern particular conduct, and the identity of the caller, along with the purpose of the debt, decides which rules apply.

Resist the urge to read that limitation as permission for deception or unlawful threats. Collection pressure is applied in order to produce commitments before counsel examines the file. Most collectors understand the boundary precisely. They rely on the owner not to.

Keep every message and maintain the log of dates, since the significance of particular conduct may remain uncertain until the facts are examined, though the record can be preserved now.

The creditor may call throughout the negotiation. The negotiation may still succeed.

Court Papers Are Not Routine Updates

A summons, an arbitration demand, and even an enforcement notice that arrives without warning answer to a different calendar than a settlement discussion. Private negotiation suspends no deadline, and a private arrangement is not a court order. It creates no court ordered pause of the kind that can accompany a bankruptcy case, as described in the court overview of reorganization and the automatic stay (exceptions apply, and counsel must assess them). No notice should sit unexamined, even briefly, while its deadline is unknown.

Give the complete papers to counsel for review and analysis. Obtain confirmation of who prepares the response. Retain the confirmation with the file.

Progress reports rarely mention the papers at all. I have stopped expecting them to.

Judge the Engagement by the Work It Performs

And the assessment should connect the service purchased with the work and documents supplied. An organized file, a transmitted proposal, and a counteroffer documented with its date are identifiable work, while the number of calls reaching the owner establishes nothing about whether that work occurred.

The evening cluster of calls is noise beside the file, which remains the measure, since it alone shows what was offered, what was refused, and what evidence the other side has gathered against the company.

Where the concern involves a fee, a missing document, or a representation made during enrollment, such as we handle all creditor contact, identify the specific issue with the supporting communication and request a response through the agreed process, which is extremely practical where frustration tempts a broader complaint. Return to the intake letter before forming a judgment. Delancey Street offers a free confidential initial review for businesses whose current arrangement is unclear. The company is a debt settlement company and not a law firm, and independently licensed counsel handles any legal question the review surfaces.

Where the owner considers changing providers, review cancellation terms and file access before acting, since ending one relationship ends neither the underlying obligation nor the legal task attached to it. Counsel can ensure the transition preserves the record and ensure no deadline passes unassigned in the interval.

A consultation can begin with that record and an honest account of what the current engagement has produced. Continued contact deserves attention, though it belongs beside the complete file rather than in place of it, and silence, when it finally arrives, should not be mistaken for the agreement that ends the obligation.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
