The Alaska business that survives its funding dispute is the business whose owner understood the exemptions before the judgment existed. Collection law in this state protects defined slices of home equity and earnings with a precision that rewards early measurement.

Collection and Enforcement by the Secured Party

After default, or sooner where the parties agreed, a secured party under section 45.29.607 of the Alaska Statutes may direct account debtors to pay it, take the proceeds to which it is entitled, enforce the rights of the debtor against obligors, and apply or redirect the balances of deposit accounts under its control, with the section addressing even the recording of a security agreement for the exercise of a mortgage without judicial process, and the breadth of that grant is exactly why its notice and good faith limits deserve the closest attention in any Alaska file, since every direct to customer collection by a receivables funder must pass through them. Collection Agency Licensing

In 2019, before most owners had heard of revenue based funding, Alaska required every person conducting a collection business for compensation to hold a license. Section 08.24.090 of the Alaska Statutes bars unlicensed collection of claims belonging to others, solicitation of collection rights, and pursuit of payment on the claim of another within the state, subject to carve outs for attorneys and salaried in house credit staff, as the licensing provision provides.

Usury and the Twenty Five Thousand Dollar Line

Money due and unpaid in Alaska bears at most ten and one half percent absent agreement, while contracted interest may not exceed the greater of ten percent or five points above the advance rate of the twelfth district member banks on the commitment date. Loans above twenty five thousand dollars stand outside the contract cap entirely.

That dividing line decides which advances face the cap at all. A purported purchase of receivables that a court recharacterizes as a loan must answer under section 45.45.010, and the forfeiture provisions nearby give the inquiry its weight, though their precise text awaits confirmation from counsel (the section language beyond the rate cap being a matter for the file rather than this article).

The reconciliation clause functions the way a smoke detector functions in a cannery that has already closed for the season: technically present, operationally beside the point where debits never adjusted to receipts.

Unfair Trade Practices

Section 45.50.471 declares unfair methods of competition and unfair or deceptive acts in trade or commerce unlawful, with an enumerated list long enough to cover the commercial analogues of the consumer cases litigated under it. Misleading term sheets belong here. Hidden fees belong here. Misrepresentation of the funding product as a purchase rather than a loan belongs here.

The broken rhythm of those short findings is deliberate, because deception claims are inventoried before they are argued. Rarely does a court need more than the documents to see the shape of the misrepresentation.

Private Actions and Treble Damages

Section 45.50.531 permits anyone suffering ascertainable loss of money or property from a practice declared unlawful to sue for the greater of treble actual damages or five hundred dollars per unlawful act, with additional proper relief, on notice to the Attorney General pleaded in the complaint and within a two year limitations period running from discovery, in extremely plain terms.

The treble damages measure converts a deception claim into settlement weight. Funders understand multiplication, and that understanding prices more cases than any motion.

The Homestead Exemption

An individual may exempt up to fifty four thousand dollars of interest in Alaska property used as a principal residence. Co owned homes divide the protection by proportion, execution sales require court confirmation, and the owner holds a right to repurchase before confirmation.

For personal guarantors this shields a defined slice of home equity from judgment enforcement. The number is modest. It is also exact, and exact numbers settle cases.


Earnings and Liquid Asset Exemptions

Individual debtors may exempt weekly net earnings up to three hundred fifty dollars, under formulas the section supplies for monthly and twice monthly pay, or, for earners without periodic wages, up to one thousand four hundred dollars per month in cash and liquid assets including receivables and deposits. Creditors pierce these shields only for narrow categories of claims.
