A collector’s accusation does not become an arrest warrant because the message contains the words fraud or theft.

Before the next payment leaves the account, the owner must separate three questions the caller has fused into one demand: what the contract requires, what conduct is alleged, and what proceeding exists beyond the call. The caller benefits from the fusion, and the owner pays for that confusion in the weeks that follow.

The Accusation and the Proceeding

A demand that invokes fraud may describe a civil claim for misrepresentation, threaten a referral to an authority, or misuse legal language in order to obtain payment before the owner obtains advice. The vocabulary alone does not establish which of those situations the owner faces. A funder can report alleged conduct to an authority. Whether the facts support any criminal proceeding is a separate question governed by applicable law, and no private caller acquires a power of arrest from a funding agreement.

The debt may be valid. The threat that collected it may still be unlawful. Those two sentences can both be true about the same telephone call, and the owner who perceives that possibility is already thinking more clearly than the caller intends. What the owner discloses, or withholds, in the first conversation will shape every later one, which is why the first conversation should be short.

You pick up the phone and the debt sounds larger than it did on paper. Rarely does a caller volunteer the docket number of the case he claims to describe, though he will repeat today until it sounds like a filing date. Ask for the number and verify any asserted proceeding through contact information obtained elsewhere.

Why Collection Threats Drew Federal Attention

The FTC announcement of its January 2022 settlement with RAM Capital Funding and its owner described allegations of unauthorized withdrawals and unfair collection practices, including threats of physical violence, alongside industry bans and other relief against the settling defendants. That history establishes that collection conduct in this market has drawn scrutiny from an enforcement agency. It does not prove a different funder committed the same acts or that a complaint will produce relief in any individual dispute (the precise scope of that order is a matter for the order itself, which counsel should read before citing it against a different company).

Most funders know the location of the line between collection and intimidation. They prefer it to remain blurry. A threat left in voicemail ferments; by the third replay it has become a fact in the owner’s mind, which is why counsel wants the recording itself rather than a description of how the calls felt, and why the dates, the numbers, and the exact words matter more than the general impression that the callers were aggressive, because the interval between allegation and proof is where collection pressure lives, and the owner is asked to fund a settlement of charges that have not been filed.

The debt was commercial. The fear was personal. The distinction mattered more than either party admitted.

Restraining Notices and Information Subpoenas

A threat can overstate arrest exposure while an enforceable civil obligation remains unresolved. The business still needs a response to a genuine lawsuit, a judgment enforcement notice, or a court order, and disbelief in the caller does not dispose of the underlying case. New York CPLR 5222 authorizes restraining notices and states that disobedience is punishable as contempt of court. Counsel should examine service, scope, exemptions, and the available procedure for relief, since transferring restrained property can create a separate problem. Counsel will read the notice, trace the underlying judgment, and construct a response that addresses the restraint and the debt in the order the court requires.

The statute permits issuance by the clerk of the court or the creditor’s attorney acting as an officer of the court, so the absence of a judge’s signature is not, if we are being precise, evidence of anything at all. Most owners call counsel after the restraint arrives, not before it, and I understand why.

Under New York CPLR 5224, specified judgment enforcement discovery includes depositions, production of books and papers, and an information subpoena answered in writing under oath within seven days after receipt. Whether a given message crosses the line from pressure into an actionable threat is a question this desk cannot answer without the recording; did the caller describe a real instrument, or only the sound of one?

Settlement Discussions and Their Limits

Delancey Street can assess a negotiated resolution of MCA debt, including the balance claimed, the payment capacity of the enterprise, and the existing collection posture (the intake works best when the owner brings the agreement, the bank records, and the messages themselves). The company is a settlement company, not a law firm. If a genuine criminal inquiry is involved, independent counsel must address it.

A payment proposal should not be treated as assurance that an authority will take no action. Ask the provider to ensure that the proposal names the civil obligations and parties it covers. Counsel should ensure that release language, admissions, and any pending proceeding receive separate attention. Settlement becomes extremely difficult to evaluate when the only stated reason for payment is fear of an unspecified arrest, so require the proposed payment recipient to match the agreement and verify transfer instructions through an established channel before funds move, since recovery of a misdirected payment is extremely uncertain. There is a peculiar comfort in a quick payment and the hope that the matter closes, though it rarely does. Payment terms and release terms are separate documents more often than owners expect.

The File Counsel Needs

Simply preserve the papers and deliver the complete packet to counsel: the agreement with its attachments, the bank records, the messages with their dates, and a chronology of what was said and what was paid, so that counsel can review and analyze the file before responding. Do not send an improvised explanation, since those admissions may be used against you. Resist the urge to explain the transaction over the telephone. Any statement to the collector, even casually, can narrow the options that remain. That decides more cases than any argument, and it costs the owner nothing but the discipline to collect and preserve the record before the next call arrives.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
