Liability on a Chase Ink balance is decided by the signed agreement, not by the business name printed on the card.

Before the next statement closes, before a collector assigns the account a story it has not earned, the owner should regard the application and the mailed Cardmember Agreement as the reliable record of who promised payment and on what terms.

Cardmember Agreement Records

The Chase Cardmember Agreement portal publishes sample agreements drawn from recent consumer offers and directs each cardmember to request a mailed copy of the specific agreement or consult the pricing and terms for the offer itself. The samples describe offers made to strangers. Nothing in those pages identifies the obligor on this account.

The portal is, if we are being precise, a library of other people’s contracts.

No sample agreement ever named the person who owes this balance.

The portal is thorough. It contains nothing about this account.

Suppose the mailed copy arrives nine days after the request. Consider this a hypothetical illustration, not a timetable drawn from any source. The sample downloaded in the meantime answers none of the questions that matter, and the ledger in the online dashboard reports balances without identifying the person who owes them.

Months after the account was opened, an amendment mailed to the business address may have altered the payment terms. Retain the executed application, the agreement, every amendment, and the statements tied to the disputed balance.

Personal Liability and the Signature

The signature page carries the entire weight of the personal exposure. An owner who signed the application as the authorizing party may have assumed an individual obligation even though every purchase served the company, and the distinction turns entirely on the words accepted when the account was opened.

That undertaking can take the form of direct joint liability rather than a separate document bearing the title guarantee. Counsel should identify the signatory, the business entity, and the scope of the promise, since a person who authorized the account occupies a different position from an employee permitted to use a card.

A guarantee form used by another issuer illustrates the mechanism; it does not establish the wording Chase accepted for this account. State law and the signed agreement govern liability, and no other issuer’s specimen can substitute for the Ink terms.

Most owners call counsel only after the second missed payment. The delay is understandable.

Do not assume that an employee purchase falls outside the account obligation merely because it violated an internal expense policy. Any remark to the issuer about the balance, even casually, can alter the posture of later discussion, so resist the urge to explain the account by telephone before counsel has reviewed the file.

Whether the file holds the executed application or only a record of digital acceptance is a question worth pursuing. The answer decides how the case against the guarantor, if one ever comes, will be framed.

Hardship Inquiries Without a Published Program

No Chase business card hardship or settlement program was verified in the sources inspected for this article, and the plural promise of options in the requested title should be read with that limitation in mind. Hope placed in an unpublished program sits in the file the way dust sits on a closed ledger: visibly, and without effect.

An inquiry about payment relief remains possible; it proceeds as an account specific request, not as enrollment in a documented program. The owner states the hardship, proposes figures drawn from the agreement, and asks what the issuer will accept in writing.

Before the first demand letter, before counsel has calculated the exposure, the owner should have learned the precise payment the agreement requires and the date it falls due. A negotiation conducted without those figures concedes the only ground that matters.

In most of the accounts we have seen, though our sample is small and weighted toward matters that reached counsel, owners discover the acceptance procedure only after the first missed payment. Whether every Ink product uses the same procedure is a question I cannot answer from this desk.

Collection Conduct and Business Purpose Debt

CFPB guidance on the limits of collection law explains that the Fair Debt Collection Practices Act covers debts incurred for personal, family, or household purposes, while business debts fall outside that statute in most cases, as does collection by the original creditor in most circumstances. A collector who treats that exclusion as permission to use any tactic has misread the boundary as an invitation.

The exclusion does not authorize deception or threats, and other state or federal provisions can still apply to the conduct. Preserve every letter, record the date and substance of each call, and let counsel assess the actor and the behavior rather than the label on the debt.

Keep every envelope.

Records to Assemble Before Counsel

Rarely does a file arrive complete, and the gaps decide the strategy as much as the contents. The owner should gather the application, the agreement, amendments, statements, notices of product or ownership changes, and the correspondence log, then review and analyze the set with counsel before responding to any demand.

Steps taken, or not taken, in the first days after default shape what room remains to negotiate. I have yet to see a downloaded sample settle an argument about who signed for an account, and the mailed copy repays the patience its request requires.

Delancey Street operates as a debt settlement company, not a law firm. Owners who wish to review and analyze the account may contact the company for a confidential discussion of settlement paths, while independent counsel addresses questions of liability and defense, and the objective throughout is to ensure no statement is made without advice and to ensure the mailed copy anchors every decision. The closed ledger still names its obligor.

A business card dispute rewards the party who kept the paper. The paper is nearly always recoverable, and recovery begins with a single written request.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
