Full 2026 rankings, city guides, and red-flag checks: Business Cash Advance Settlement.
A crop expected value does not establish the cash available for tomorrow MCA payment.
Six months after planting, a farm can hold a field of real value and a bank account unable to cover the week. Any plan for MCA debt must account for the cost of producing and collecting farm revenue, with proposed FSA financing evaluated under the actual program rather than treated as an automatic exit.
Identify the work and expense remaining before the farm receives payment. The projected harvest date may differ from the date money becomes available under the sales arrangement, and the forecast should keep expected yield, price, and collection timing identified as separate assumptions.
A change in one assumption can affect the proposed settlement even if the other figures remain unchanged. Review the obligations already incurred for inputs, equipment, and labor, since a forthcoming receipt should not be treated as unrestricted cash before those commitments and any legal restrictions have been examined.
The forecast should also identify income outside the principal crop cycle. A smaller continuing receipt can matter to operating cash, but it should not be assumed to support installments larger than the amount left after its associated costs. Where a sale remains uncommitted, distinguish a planning estimate from a contracted price so the adviser understands the basis of the proposed funding source.
And the field, if we are being precise, does not recognize a creditor installment date at all.
The Farm Service Agency farm loan overview describes direct and guaranteed ownership and operating loans for qualifying farmers and ranchers who cannot obtain commercial credit. Eligibility and permitted purposes require review. The existence of the program does not establish that a particular MCA can be refinanced.
The agency distinguishes direct loans it makes and services from guaranteed loans made through conventional agricultural lenders. A borrower should identify the actual lender and servicing contact before requesting changes, and should not import an SBA loan rule into an FSA transaction merely because both involve a federal agency.
Before including anticipated proceeds in a settlement offer, before promising a payment based on an application, confirm the proposed use with the program or lender. An application is not an approval.
The FSA overview also describes repayment ability and collateral requirements for direct loans. Whether a farm under MCA pressure meets those requirements in a given season is a question the local office answers on facts, not one the settlement proposal can answer by assertion.
Collect the security documents associated with farm financing. Identify the assets and receipts described rather than assume that every loan covers the same property, because a land mortgage, an equipment agreement, and an interest asserted against crops can require different legal analysis.
New York UCC Section 9-315 addresses continuation of interests in collateral and identifiable proceeds, subject to authorization and exceptions. It provides a general framework, not a complete answer to agricultural lien or crop sale questions, and counsel should identify the consents and releases needed for any proposed disposition.
The price a buyer offers should not be treated as available settlement money before the rights attached to it are examined. If the asset is needed for the coming production period, compare the sale with the expense of replacement or outside services. A balance reduction can leave the farm with another operating cost.
A reconciliation clause in an MCA functions the way a rain gauge functions in a county the rain decided to skip: technically present, operationally meaningless, and consulted mostly for form. Counsel should review and analyze the effect of a new security grant before the owner signs another financing document.
Delancey Street offers a free confidential initial review of MCA concerns. A farm can present the advance documents and a schedule showing expected receipts, remaining production costs, and other financing commitments.
The company provides debt settlement services and coordinates legal matters with independent counsel. It is not a law firm and does not administer FSA loan approvals. Agricultural finance and legal disputes require the relevant professional engagement.
Ask the adviser to ensure that proposed payments reflect the actual cash cycle of the farm. Counsel should ensure that any collateral or agency related condition receives the necessary review. Review fees and which obligations the service will address, since an MCA negotiation should not be assumed to modify an FSA or bank loan.
Read the agreement for the receipts included in its calculation and any reconciliation procedure. A seasonal income pattern should not be assumed to change the required debit without reference to those terms, and the forecast should distinguish an accepted modification from a proposal awaiting consideration.
Preserve the request, supporting records, and response. Resist the urge to treat a projected crop payment as certain because the current withdrawal feels unmanageable. The business needs an offer that acknowledges the contingencies it cannot control.
An extremely useful comparison identifies which expenses would continue if collection were delayed. The farm may need to maintain animals, equipment, or land even while a particular receipt remains outstanding, and an extremely lean season still demands feed, fuel, and the loan installment. Steps the owner takes, or does not take, before harvest shape what the negotiation can offer after it.
Simply identify the stage of any funding application rather than describe it as an available payoff. A funder that accelerates collection against a farm in order to seize the harvest account before other creditors act narrows its own options as well as the borrower, and counsel should examine the debits, challenge the overreach, and construct a record that protects and preserves the farm position through the season. Fourteen pages of funding documents once decided a case I watched turn on a single paragraph about receipts. Rarely does the shortest document in the file matter least.
Any remark to the lender about expected yield, even briefly, can become the figure the proposal is measured against. The peculiar mathematics of farming means solvency and illiquidity can share the same acre, and the owner should consult and contact counsel before the planting loan renewal conversation begins.
Most funders accept 30–60% as a full settlement — with proper leverage.
