A delivered load is not yet money. For a hotshot or box truck operation carrying MCA debt, the interval between delivery and collection decides whether the daily debit clears or fails.

The truck earns revenue on the highway and collects it in an office weeks later, and the advance agreement collects from the account as it stands each day. That mismatch, more than the price of the advance, is what forces owners into default.

1. Reconstruct the Payment Sequence for Each Load

Begin with work already performed. Match the rate confirmation to proof of delivery, the invoice and any request for additional documentation, then establish whether the customer has accepted the invoice and when payment becomes due under the applicable terms.

A missing signature creates a different problem from a disputed charge, and a customer whose payment is overdue requires a different response from one whose contractual payment date has not arrived, so treating every delay as slow payment conceals the action each situation needs.

In 2019, before the recent wave of state level commercial financing disclosure rules, many small carriers signed advance agreements without any standardized cost disclosure at all. The payment sequence below should be built from the actual documents, not from recollection of what the broker said on the phone.

Keep the original documents together. An estimate entered into a bookkeeping program does not establish that a broker approved the amount or received every item required for processing, and the resulting schedule should distinguish amounts billed, amounts accepted and funds available for business use.

2. Receivables Timing and Collection Control

Federal guidance on receivables financing treats receivables as collateral whose quality depends on reserves, dilution, disputes and collection control, all of them contract questions. A broker receivable owed to a small carrier should be examined the same way, as an asset of uncertain date rather than cash at rest.

The reconciliation clause in an MCA agreement functions the way a spare tire functions on a truck with a cracked axle: present, properly inflated, and beside the point while the larger failure continues (the clause, which defenders of the advance industry will insist is freely negotiated, governs only the adjustment procedure the owner actually invokes with records the funder accepts).

That explains the timing trap and the error behind it. Owners forecast from dispatched miles while funders debit from collected balances, and this gap widens every week the broker pays on thirty day terms against debits that clear each morning.

The New York appellate decision in LG Funding LLC v. United Senior Properties of Olathe LLC weighed reconciliation behavior, finite term and recourse among the features relevant to whether an advance required absolute repayment. The analysis does not establish that every carrier holds an enforceable adjustment right on identical terms, and counsel should review and analyze the signed agreement before any request is made.

You run the load and then you learn when the load pays. The discipline that follows is unglamorous: invoice the day of delivery, confirm acceptance within days, and record the promised date where the person who dispatches the next truck can see it.

3. Daily Debits Against Weekly Collections

The advance debits on the calendar stated in the agreement. The broker pays on the calendar stated in the rate confirmation. Where those calendars diverge, the account absorbs the difference until it cannot.

Often we see owners cover the gap with a second advance before the first one has seasoned. Rarely does a lender describe that sequence as rescue.

Map the next thirty days of debits against receivables with confirmed dates. What the carrier chooses to disclose, or to withhold, from the funder during negotiation will shape the proposal that follows.

The useful question is not whether revenue exists but when it becomes spendable cash. Three accepted invoices payable on known dates support a proposal; a dispatch board full of quoted work does not.

4. Fuel, Maintenance and Payroll Before the Funder

A truck that cannot fuel cannot earn, and an owner who directs every collected dollar to the advance will soon own a current advance and a idle truck. The operating budget must carry fuel, insurance, maintenance and driver pay as obligations that precede any settlement installment.

Identify the weekly cost of keeping each unit moving. Compare that figure with the debit schedule and the collection dates established above.

Some owners discover at this stage that the business can perform its contracts or service its advances, but not both at once. The honest answer, reached early, costs less than the same answer reached after the account has been swept to zero.

A carrier willing to park a unit rather than run it at a loss preserves the receivables already earned. That choice feels like retreat while it functions as triage, and the creditors will lump it with every other concession unless counsel frames it first.


5. Settlement Review With the Full Ledger
