Full 2026 rankings, city guides, and red-flag checks: Business Cash Advance Settlement.
A freight decline can expose a payment structure that prior receipts had concealed.
It cannot by itself prove why a particular carrier defaulted or what a funder understood when it approved another advance. Volume data supplies context for the setting, while the loads, the margins, and the payment dates supply the explanation for the account.
Most carriers call after the second stacked advance. I understand why the first one felt necessary.
In May 2025, the American Trucking Associations reported a 0.3 percent monthly decline in its advanced seasonally adjusted index for April. The ATA release on April truck tonnage described an uneven freight market rather than a uniform result for every carrier, and that qualification matters more than the headline figure.
The release also explained that its indexes are dominated by contract freight and rest on membership surveys, with the reported figure marked preliminary (a trade survey, and not a census of every lane). An owner running spot market loads on a particular corridor should not treat the national number as a reading of that lane.
The tonnage index declined. The default was a matter of the carrier ledger.
The release supplies a historical indicator. It does not measure MCA defaults, identify any funder underwriting decision, or establish the present condition of every trucking segment, and the data are not entirely conclusive on this point, which limits what any single release can prove about a financing failure.
A load can increase gross receipts without leaving enough to support the financing attached to the business. The analysis should compare the revenue with fuel, driver compensation, tolls, and the other direct costs of that work, then account for the expenses that continue between loads, including insurance, equipment payments, and necessary maintenance.
Record when the customer becomes obligated to pay and what documentation the payment requires. A completed delivery with missing paperwork can remain outside the expected collection schedule, and the withdrawal may arrive while the carrier is still resolving the administrative defect.
If factoring is involved, compare the invoice, the advance, the reserve, and the later adjustments as one sequence. A deposit from the factor should not be counted as additional revenue on top of the underlying invoice, and the settlement budget needs the amount the business can retain after the transaction is reconciled, which drifts further from the gross figure every time a disputed load enters the month, until the forecast describes operations that no longer resemble the bank record and the owner is planning payments from money already consumed by the prior week fuel bill.
A delayed payment can require the owner to fund another trip before receiving cash from the previous one. Model that overlap from actual invoices and expenses rather than assuming a profitable month produces cash on the day a withdrawal is scheduled, and give expected receipts different treatment from cleared funds.
A fixed withdrawal against variable settlement behaves like a fuel surcharge in reverse: the carrier pays more per mile precisely when the miles pay least. Use lane level records where they exist, because a fleet average may conceal a route that produces little after repositioning and waiting time.
Separate a temporary interruption from a continuing margin problem. The former may involve an invoice expected to clear, while the latter requires a change in the operating plan as well as a debt decision. Most funders know exactly what a soft market does to a fixed withdrawal. They prefer to price the advance rather than refuse it.
In LG Funding LLC v. United Senior Properties of Olathe, LLC, a New York appellate court examined repayment structure through reconciliation, term, and bankruptcy recourse. The decision illustrates why the label on the agreement does not complete the legal analysis, and counsel should begin from the wording rather than the product name.
For a carrier with lower receipts, the immediate document question is whether an adjustment or reconciliation process exists and how it operates in practice. Preserve requests, supporting sales records, and the funder responses, because opposing counsel in these collection matters tends to open the first conference with the bank record rather than the contract.
The market explains the setting. It does not decide the case.
A reduction in revenue should not be assumed to alter a scheduled withdrawal without the required process, nor does the presence of a reconciliation clause establish that every disputed payment was proper. The industry condition can help explain a financial change, but a request supported by deposits and load records provides a more specific basis for discussion than a general statement that trucking is difficult, and that is where negotiation begins.
A provider may present new financing while the carrier remains under strain. The offer should be examined for net cash, total obligation, and payment burden rather than accepted as evidence that the business can sustain it.
Approval does not reveal the provider internal reasoning. Without its underwriting record, the owner should not assume whether the decision reflected confidence in recovery, collateral expectations, or another consideration. There are carriers for whom another advance worked, though the files that prove it rarely reach a settlement office.
Delancey Street can assess settlement options where another advance would deepen the burden. It is a settlement company rather than a law firm, and independent counsel evaluates contract defenses and legal process. The settlement statement arrived on Tuesday.
Retain load confirmations, delivery records, customer payments, factoring statements, and the financing history in one file, and mark disputed or delayed receipts in the forecast. Update the figures when a payment clears or a cost changes, and collect and collate the original documents behind every revision.
A national indicator can explain part of the setting without determining the future of a particular operation. Whether the same reading holds for parcel carriers is a question I cannot answer from this desk. Steps the owner takes, or avoids, in the fortnight after the first missed withdrawal shape the posture of the matter against the funder, who may accelerate in order to fix its position before the carrier stabilizes.
A first discussion with Delancey Street can begin from that operating record, with attention to what the business must retain to haul the next load and what any agreement would resolve. Simply bring the ledger rather than the narrative, and ensure the comparison states how much of each payment belongs to tomorrow operations before committing it to yesterday financing. The crooked line in these files usually runs through the forecast, and the forecast repays correction while correction is still possible.
Most funders accept 30–60% as a full settlement — with proper leverage.
