A settled MCA costs more than the number the funder accepts. Fees, taxes, and the conditions of performance set the actual price, and each deserves a line in the comparison before the owner treats a projected reduction as money saved.

1. Establish the Starting Balance and Available Cash

Identify the agreement, payments collected, fees, adjustments, and the current amount demanded. Ask for clarification where the figures do not reconcile. A proposed reduction needs a defined starting point before its meaning can be assessed, in most files of this kind, though no dataset proves the point.

Build a cash forecast after essential expenses and other debts. Simply distinguish funds held now from receipts expected later. The available amount should reflect the capacity of the business to perform, rather than the figure the owner hopes will end the discussion. An extremely favorable percentage can conceal a difficult lump sum requirement.

2. Examine Delancey Street Service and Charges

Delancey Street offers an MCA focused settlement review and a free confidential initial conversation. It describes coordination with independently licensed counsel for legal matters. The company itself is a debt relief business, not a law firm.

Use the review to confirm eligibility, included accounts, fee calculation, and the events that make charges payable. Ask about cancellation, funds held for settlement, and costs associated with separate professionals. No universal fee or saving should be assumed without the written proposal. The fee question comes before the savings question.

Ask how the fee is calculated and when it becomes payable. The answer often reveals work the engagement does not cover (particularly where a lawsuit already exists and the lending party has retained counsel), and that discovery changes the comparison more than the fee itself. A settlement service and an attorney may work alongside one another, but the division of responsibility needs to remain visible.

Before enrolling, before treating the estimated creditor payment as the total cost, identify every amount the business would need to provide. An extremely clear budget separates service fees from funds intended for the counterparty and preserves money required for operations. What the owner discloses, or withholds, in the first call shapes everything the file later permits.

Ask the provider to ensure the offer approval process is written down. We should ensure any legal proceeding has counsel responsible under an accepted engagement. The initial review describes a proposed course of work. It does not establish acceptance by the funder.

3. Present the Offer and Evaluate the Counterproposal

A proposal identifies the payment, timing, and conditions sought. The funding party may accept, decline, request additional information, or suggest different terms. Any statement to the funder, even casually, can alter the posture of the negotiation. The budget of the business should determine what revisions it can support.

Review and analyze the complete counteroffer. A larger installment, narrower release, or unfavorable default provision can change the value of a reduced balance. A narrow release may be drafted in order to preserve claims the owner assumed were resolved. Counsel should examine terms affecting legal exposure, including guarantees and pending proceedings.

The federal courts explain that filing generally creates an automatic stay, subject to exceptions, in the federal courts description of the automatic stay. Private settlement enrollment does not provide that protection. An existing legal deadline needs attention while the commercial offer remains under consideration.

Counsel reads the counteroffer before the owner prices it.

4. Account for Taxes and Records

The IRS explains that canceled debt guidance treats forgiven amounts as taxable income, subject to exceptions and exclusions. The tax adviser should assess the actual business and transaction. A provider estimate does not establish whether an exclusion applies. The tax answer may differ from the estimate by an amount worth knowing before signing.

Compare the proposed settlement against the complete cost of carrying out the agreement. A percentage without a stated base resembles a street sign without a street: it points, but it does not locate. Ask whether professional fees are calculated from enrolled debt, an amount described as savings, or another measure. Include legal services outside the settlement engagement, and ask who handles any lawsuit response.

The creditor accepted the amount. The file stayed open another six weeks for the release.

But performance and completion run on different clocks. Retain the signed agreement, payment instructions, and transfer confirmations. Match each payment with the required date and amount. Keep drafts separate from the executed terms so the company can identify the obligation it actually accepted. I have yet to see an owner regret asking for the fee base in writing, though many regret the opposite.

5. Verify the Release Before Closing the File

Resist the urge to mark the process complete when the final debit leaves the account. Obtain the confirmations required by the agreement and address any remaining collateral or litigation documents through counsel. Payment and administrative completion may occur at different times. Whether a funder that refused last quarter accepts the same number this quarter is a question the file cannot answer.

The release should identify the intended debtor and any guarantor receiving protection. A company settlement can leave other exposure unresolved unless the document addresses it. The owner should understand which obligations remain rather than infer a broad result from a favorable ledger (a closer reading than most owners expect).

Some negotiations may end without agreement, and the fee consequences should have been clear before enrollment. That possibility belongs in the cost comparison. A business can value a defined service while recognizing that the counterparty decision remains outside its control. Most providers know exactly what their fee calculation rewards. They prefer the owner not to ask.

Delancey Street initial review begins with the actual contracts and available funds. The useful settlement is one the company can complete at a tolerable total cash outlay, with a release that achieves the intended result. The final calculation should explain what the business paid and what it received in return.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
