The name on the website is marketing. The name on the agreement is the claim.

1. August 2020: The Kabbage Acquisition Excluded Prior Loans

In its August 17 2020 acquisition announcement, American Express described an agreement to acquire Kabbage operations with an express exclusion of the preexisting loan portfolio. That exclusion matters to any owner trying to identify who handles an older balance.

In August 2020, before the current financing product existed under its present brand, the portfolio distinction was already drawn. A current product page therefore proves nothing about who owns a historical account.

The K Servicing bank relationships page gives a separate description of servicing roles and identifies lenders for particular legacy products, with product and date distinctions that reinforce the need to read the loan agreement. An agreement signed before October 16 2020 sits on one side of a servicing line that the page draws with care.

Whether every legacy account found the same servicing home is beyond what these pages establish. Brand recognition is an extremely poor substitute for the assignment record, and a changed label is a records question before it becomes an ownership conclusion.

2. May 2021: The Described Yellowstone Business Takeover

The New York Attorney General Yellowstone settlement explanation states that Delta Bridge Funding, also known as Cloudfund, took over the Yellowstone business in May 2021. That is the office description of the history. It supports no assumption that every agreement under those names receives identical treatment. A shared business history is not a shared release.

The same explanation distinguishes the Yellowstone settlement from claims involving Delta Bridge and Cloudfund. The distinction turns on scope rather than on lineage, and scope is where an owner seeking relief should look first, because the named creditor and the covered entities decide eligibility while the broader story of who took over what only explains how the names arrived in the same file.

Its April 2026 update states that the latter parties were outside the settlement. The business connection remained a matter of public record. Counsel should examine any uncertainty about whether a particular obligation is included.

History explains the names.

3. A Stated Former Name on a Current Funding Website

The Bizcap funding website gives its former name in its footer as NewCo Capital Group, as observed in 2026. That is a direct public representation of the brand history, while supplying no effective date for any legal or servicing change.

The site also distinguishes the business from the San Francisco company of similar name. That distinction matters when searching for records or contact information (at least on the records inspected, the similarity ends at spelling), since similar spelling never proves that two businesses share ownership or responsibility for an account.

Keep every version: the old notices, the current footer sentence, and the dated copies that show when each appeared, since the business may one day need to explain why a document used a name the site no longer shows.

A rebrand works like a repainted storefront on a street the owner stopped visiting years ago: recognizable in photographs, unhelpful for finding the current entrance.

That discipline, applied to every notice, is the entire lesson of the three examples. A borrower holding a NewCo agreement should compare the original document with current communications before inferring anything about the obligation.

Identify and verify which legal entity asserts the claim, whether ownership or servicing changed, and the record offered to support the change. A notice identifying a new payment destination should be verified through an established channel before funds move, since money sent on brand familiarity alone is difficult to recover once applied against the wrong account.

Where a settlement is proposed, make sure the release identifies the actual party and the covered agreement. A familiar brand name may be insufficient where the document leaves the legal claimant unclear.

Untangling shared names takes longer than the file suggests. It always has.

4. Rename, Assignment, and Servicing Change Are Separate Questions

A rename concerns how an entity is identified. An assignment concerns rights transferred, while a servicing change concerns who administers an account. Often we treat a press release as a payment instruction, and the three examples show why those categories should remain separate.

Request and examine the document relevant to the change asserted. A press release about an acquisition cannot replace an account specific notice where ownership or payment authority is disputed.

5. What a Changed Name Requires of the Owner

Delancey Street is a debt settlement company that can discuss negotiation of business obligations. Counsel should assess disputed ownership, enforcement rights, or the scope of regulatory relief, and the company should never be described as a law firm.

Bring the original agreement, the current demand, and the notices explaining the name change. Successor entities may assert old balances in order to collect them, which is lawful unless a defense or release defeats the claim. The review should begin with the account the business holds, not the current marketing product under a familiar name, and a settlement proposal needs an authorized counterparty.

Ensure that any accepted resolution identifies the obligations and persons released. Ensure also that payment and closing instructions come from a verified source, since an extremely small ambiguity in the payee line can redirect the entire payment.

What the owner pays, or withholds pending verification, should follow the documents rather than the brand. Keep both labels in the file. Names change faster than obligations, and the owner who files every version of the name meets the new brand with old evidence.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
