A signed guaranty outlives every argument about its fairness. California law still leaves the collecting party with less to seize than the judgment amount implies.

The eight protections below come from the exemption statutes as written. They shield a judgment debtor property from levy once judgment enters on the guaranty.

Home Equity Under Section 704.730

Section 704.730 of the Code of Civil Procedure sets the homestead protection as the greater of the countywide median sale price for a single family home in the prior calendar year, capped at $600,000, or a $300,000 floor, with annual inflation adjustments from January 1, 2022. The homestead, if we are being precise, protects a cushion of equity rather than the house itself, and no guaranty judgment reaches that cushion regardless of the deficiency.

The debtor asserts the protection in the levy proceeding itself, before the collecting party prices the equity above the exemption. The homestead exemption statute carries the amended figures effective at the start of 2025, and figures in this series remain subject to statutory adjustment. Rarely does the cushion cover the entire equity.

The deficiency balance sits in the file the way sediment sits in a pipe, unnoticed until the pressure changes.

Private Retirement Plans Under Section 704.115

The protection of Section 704.115 reaches private and union retirement plans, profit sharing plans, self employed plans and individual retirement accounts, and tax qualified funds held for retirement, disability, or death benefits, with amounts returned to the member after payment keeping the shield.

For self employed plans, individual accounts, and certain qualified funds, the exemption extends only so far as necessary for the support of the debtor and family at retirement, which practitioners call the support test. The calculation is extremely sensitive to the retirement horizon the court assumes. The retirement plan exemption statute states that test beside a limit that periodic payouts face collection only through withholding at garnishment equivalent rates. In most files of this type, though the sample is not scientific, the fight centers on the support calculation.

The Paycheck Already in the Account

The paycheck in the account is often the first asset seized and the last one the creditor keeps. Earnings paid within the thirty days before levy and traced into a deposit account hold their protection after deposit. Amounts already subjected to withholding stay exempt in full, so what the debtor kept, or failed to keep, in the way of pay records decides the tracing fight.

Tracing pulls in the pay dates, the deposit slips, the account statements for those thirty days, proof that other funds never mingled, and the arithmetic tying each dollar to earnings beyond the reach of garnishment. The paid earnings exemption statute conditions the shield on that proof. The collecting party times its levy in order to catch the account just after payday. Resist the urge to move the money, since movement destroys the trail the exemption requires.

Life Insurance and Annuity Benefits

Unmatured life policies, including endowment and annuity policies, stand exempt without any claim, though loan value falls outside that grant. The aggregate loan value carries its own exemption up to $13,975, and each spouse holds a separate exemption the two may combine.

A guarantor facing a bank levy should have counsel pull and review the policy schedule before surrendering a contract for cash. The life insurance exemption statute preserves a position the family purchased decades before the guaranty existed. Most guarantors call after the levy. I understand why.

Tools of the Trade and Business Equipment

Tools, implements, instruments, materials, uniforms, furnishings, books, equipment, one commercial motor vehicle, one vessel, and similar property used and reasonably necessary in the trade by which the debtor earns a living stay exempt up to $8,725 in aggregate equity. The amount doubles when both spouses share the same livelihood. Sale and insurance proceeds hold the shield for ninety days after the debtor receives them.

A guarantor who works with equipment for a living should inventory it before the creditor does.

The commercial vehicle protection inside this section is subcapped at $4,850 per earner. The tools of the trade exemption statute states that boundary plainly. Whether the sublimit stretches to a vehicle with family uses is a question worth considering.

Motor Vehicle Equity

The car that carries the guarantor to work is the asset the statute prices with unusual precision. Aggregate motor vehicle equity stays exempt up to $7,500, with sale proceeds holding the protection for ninety days. A debtor who owns only one vehicle keeps that sum without filing a claim.

The motor vehicle exemption statute measures equity against standard used car guides.

Household Furnishings and Personal Effects

Furnishings, appliances, provisions, clothing, and other personal effects stay exempt when put to personal use at the principal residence. The household goods exemption statute weighs how common the item type is and whether a given piece holds extraordinary value.

The creditor may inventory the house, the accounts, the cars. The statute protects this.

Public Retirement Benefits

Most buyers of defaulted guaranty paper know exactly what they purchased, and they prefer not to examine the exemptions too closely. All amounts held or distributed for public retirement purposes, with all accrued rights under a public retirement system, stand exempt without any claim. Practice varies more than the statute suggests.

The public retirement exemption statute reserves its only opening for support judgments. The protection is absolute. It is also narrow.

Delancey Street, a debt settlement company and not a law firm, offers a free confidential review for guarantors facing enforcement of a personal guaranty. Simply bring the judgment and levy papers so the adviser can ensure the workout plan respects the exemptions shielding these holdings, while independent counsel review and analyze any claim the creditor asserts against them. An extremely candid inventory saves months of motion practice, and any contact with the collecting party, even briefly, should run through counsel.

The exemption statutes do not forgive the guaranty; they decide which parts of a life the collection system may not convert into payment, and that boundary holds whether the promise seemed prudent or peculiar at the signing. Counsel ensure the claims reach the court before the sale date.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
