The car on the lift belongs to the customer while the lift belongs to the bank, and the invoice between them belongs to a dispute.

A repair shop facing MCA debt should sort property before sorting payments. Possession of a vehicle establishes custody, not ownership, and the financing provider cannot borrow the shop repair claim as a collection shortcut.

Customer Vehicles and Shop Property

List customer vehicles apart from tools, equipment, and stock the business owns. Where a demand describes all property at the location, have counsel measure that language against the collateral description in the agreement and the rights the shop was able to grant (the descriptions are broader than the agreements behind them).

Retain the repair authorizations with records identifying each customer. Those papers may support an unpaid repair claim without establishing anything about the MCA. The bays were full. The account was overdrawn.

A vehicle awaiting collection, a financed alignment rack, and an unpaid invoice each point to a different analysis. Treat them as one pile of assets and the response will answer the wrong question.

Repair Claims Under State Law

An unpaid repair account may raise a lien question under state law. Requirements, possession, and enforcement procedure vary by jurisdiction, and counsel needs the authorization, the invoice, the communications about disputed work, and the possession record before assessing what remedy exists.

An asserted lien is not a license for threats the procedure does not support. Handle the customer dispute through the applicable process. Nor should the owner assume the MCA provider inherits a repair right because the shop holds an unpaid invoice; any assignment or security interest requires its own analysis.

Where another party holds an interest in the vehicle, pull the ownership records before deciding anything from the fact that the car sits on the premises. Priority is a paper question (which collectors calling about the MCA balance will rarely concede), and the answer usually lives in documents no one has yet opened. That is usually where the matter turns.

Do not reach for a construction lien form on the theory that every claim called a mechanic’s lien follows one process. Vehicle repair and improvements to real property can sit in different legal regimes entirely.

Tracing the MCA to Its Documents

New York rules on proceeds of collateral address continuing interests and identifiable proceeds, subject to exceptions. They do not place every vehicle or every invoice in the funder hands. Read the purchase agreement with any separate security agreement, and note the receipts or property described with the governing jurisdiction, at least as far as the file shows.

A financing statement examined beside those documents still does not establish the amount owed or settle enforceability. If the funder claims an unpaid customer balance, separate that receivable from ownership of the customer car; a claim about money and a claim about the vehicle are not interchangeable. The same applies to payments received after the repair.

Keep credits for customer payments visible in the MCA ledger. Identify leased equipment apart from owned tools. Ask for the basis of any asserted remedy rather than inferring it from a broad reference to a filing. Most demands describe everything and prove nothing.

Collections and Reconciliation Timing

In the LG Funding appellate decision, a New York court weighed reconciliation with other contract features. The decision invalidates no shop advance by category.

Find the reconciliation procedure and the receipts it measures. Completed work awaiting payment belongs in the request; estimates the customer never authorized do not. Parts and payroll can create a shortage where covered revenue never fell. I am less sure of the collection week than the schedule implies.

Submit accurate records and retain the response. Morning light through the bay doors marks another day of the remittance.

Settlement Scope and Floor Instructions

Delancey Street can review the advance through a merchant cash advance settlement review, beginning with a free and confidential discussion. Bring the agreement with a ledger built from actual collections.

The company is a settlement provider, not a law firm. Independently licensed counsel handles legal representation and should address lien rights or collateral disputes. Equipment financing, customer repair disputes, and the MCA obligation should not be assumed under identical terms, and the proposal should preserve funding for repairs already authorized.

The shop ordinary work depends on knowing which car, which invoice, and which obligation belongs to whom.

Whether a negotiated outcome survives the first disputed customer invoice is a separate question. Most owners assume the paperwork will hold. I understand the assumption. Consultation is where this conversation begins: the settlement should name the account resolved with the conditions for release, staff should never decide a vehicle release from an MCA collection call, and the executed terms belong with the final ledger as evidence the arrangement was completed.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
