The estimate on the work order becomes cash only after the insurer approves the repair and directs payment to the shop.

A body shop negotiating MCA debt from expected insurance proceeds should separate approved work from disputed supplements before offering any figure to the lending party. The ledger and the funded amount rarely match, and the distance between them is where settlement proposals fail.

Insurance Estimates and Approved Payments

The weight of the negotiation rests on a single schedule, so build a repair level record that names the approved work only beside the original estimate for each job. Supplements awaiting authorization, customer deductibles, and any prior balance still on the books belong in distinct columns.

Who decides the payee? The payment documents answer before the negotiation begins. Insurers issue checks to the shop, to the vehicle owner, or to both names on one instrument. Rarely does an insurer redirect payment on a phone call alone.

Keep customer authorizations with the repair file. The file should show what work was approved and who approved it.

The MCA Agreement and the Financing Statement

Counsel should review and analyze the purchase agreement with any separate security agreement before interpreting the financing statement. The provider may describe purchased receipts while asserting a security interest under a separate document. Counsel should review the terms, identify the deficiencies, and construct a response that addresses both the contractual claims and the practical realities of the repair cycle.

New York rules on collateral after disposition address continuation of a security interest and attachment to identifiable proceeds. Subject to stated exceptions, the provision states no universal winner between an insurer payee dispute and an MCA provider, which leaves the outcome to the documents behind each demand. Whether this holds outside New York is a question I cannot answer from this desk.

The contract was, if we are being precise, a purchase of future receipts with remedies that resemble lending. That resemblance decides nothing by itself. The provider drafted the default provisions in order to preserve collection options that the marketing never mentions, and most funders know what their filing covers. They prefer it unexamined.

Where the lending party points to particular insurance proceeds, obtain the accounting behind the assertion. Shops that opened their books to the first caller, before counsel had reviewed the demand, have spent months reconstructing what those calls conceded, and every premature disclosure becomes evidence used against the shop. Trace each payment to its repair without treating every deposit as proceeds of the same job; in most of the files we have seen, though the sample is not scientific, at least one deposit resists that tracing.

A claim against the shop receivable proves nothing about ownership of the customer vehicle. Those are distinct assets with distinct parties. That confusion is expensive, and the financing statement sat in the file like a parking ticket on a towed car: present, documented, and beside the point until someone reads it. Keep equipment financing visible as well, since a creditor claiming a spray booth or frame machine holds a position unrelated to any single repair, and the vehicle identification numbers stay on the repair order rather than in the funder file.

Supplements, Chargebacks, and Customer Balances

Weeks after the estimate was written, the supplement still awaits authorization while the daily withdrawal continues. An unresolved supplement should remain apart from approved work in every forecast the shop prepares.

The shop may regard the additional repair as justified. The insurer has not yet agreed. Retain photographs, authorizations, and whatever communications support the requested change, and identify any customer deductible on its own line. Assembling the supplement file takes longer than owners expect.

There are adjustments a provider will accept without documentation, though in practice they tend to be few. A shop that promises supplement money to a funder resembles a contractor pledging a change order the owner never signed. Both spend authority they do not hold.

Often we see the estimate treated as a promise, and any side understanding with the adjuster, even casually, should reach counsel before it reaches the funding party. I have yet to see a supplement dispute resolved inside an MCA negotiation, though both sides keep acting as if it might. A proposal that depends on an outcome the shop does not control is extremely fragile, and that comparison belongs in the file before any offer goes out.

Reconciliation Requests and Payment Adjustments

The New York decision in LG Funding, LLC v. United Senior Properties of Olathe, LLC weighs reconciliation and other factors when evaluating whether repayment is absolute. Its analysis offers no blanket defense for every business receiving insurance payments, and its application to collections driven by insurance payments is extremely narrow.

Read the agreement procedure for requesting an adjustment under the so-called reconciliation window. Identify the covered receipts and the records needed to show a change during the relevant period. Submit accurate information and preserve the response.

The spreadsheet is not the contract.

Steps the shop takes, or does not take, in the first weeks after default shape every later option. And the budget should continue to record the obligation while the dispute is assessed, since blocking a debit does not establish that the underlying obligation has disappeared. Resist the urge to send the full repair file with the first response. That repair level schedule from the first section earns its keep here.

Settlement Review and Closing Records

For the MCA portion, Delancey Street can assess the account through a merchant cash advance settlement review, beginning with a free and confidential discussion. Bring a collection summary that separates approved amounts from disputed supplements, with the MCA documents beside it.

The company is a settlement provider, not a law firm. Independently licensed counsel handles contested collateral claims with payment direction questions. Protect and preserve the payment records at the account level, since no MCA discount alters the insurer dispute by itself.

The closing file carries the entire negotiation, so the engagement should ensure the insurer dispute and the MCA negotiation proceed on separate tracks. Counsel should ensure revised payment directions reach every party holding funds. Simply retain the executed terms, payment confirmations, and the final repair ledger as the account stood at signing, with credits for money received during negotiation documented rather than estimated from the amounts on the original bills.

Most owners do not call until the account is overdrawn. I understand why. The shop converts damaged property into completed repairs, and the ledger deserves the same discipline: uncertain collections become a performed obligation only when the records distinguish promise from payment. Peculiar confidence in an old estimate has ended more than one negotiation. Consultation is where this conversation begins, and the prepared file sets the terms of that discussion.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
