The own site describes a private business debt relief company based in New York, and states that Delancey Street is not a law firm. No state or federal enforcement action surfaced in the sweep, a search result that proves nothing about the future.

Being named changes what the next phone call is.

When the summons names the owner, if we are being precise, the calendar matters more than the complaint. Delancey Street opens a confidential initial review, maps the balance behind the suit, and negotiates and documents a resolution where the paper permits one, while independently licensed counsel handles the defense the company does not perform. The objective is to ensure no admission is made without counsel present, and to ensure counsel sees every page the funder filed. Simply assemble every page before the first call.

Everest Business Funding

The thinnest profile in the sweep belongs to Everest Business Funding LLC, identified by that legal name in its BBB profile, which places the company on NW 25th Street in Miami, Florida, though the company site itself lists phone contacts with no street address.

The homepage markets revenue based financing with fast working capital and business term loans. The profile is extremely thin for an operating funder, which is itself information, and it carries a peculiar silence around the street address. No state or federal enforcement action was found, though the sweep notes that a California desist order against a similarly named cash advance operation concerns a different company entirely, and the two must not be confused, though the site lists a phone number with little else.

Unique Funding Solutions

At 71 South Central Avenue in Valley Stream, New York, Unique Funding Solutions LLC conducts its principal business (the pleading that supplies the address dates to 2022, so the address should be confirmed rather than assumed), since the company site lists a phone contact with no street address.

The site navigation offers merchant cash advance with revenue based financing and alternate financing. The sweep found no state or federal enforcement action, a result the file reports without embellishment. Private suits naming the company, including one filed in the Southern District of New York in November 2022 and cited in the sweep through the filed complaint, are not counted as enforcement actions.

Any statement to the funder, even casually, can narrow the defense, so match the caption on the summons to the company that signed the agreement before responding.

Radium2 Capital

Because its website is a parked domain the sweep could not verify, Radium2 Capital LLC of Uniondale, New York, must be read through outside paper, including a BBB profile that lists it under factoring services without accreditation at 300 RXR Plaza.

A federal court opinion quotes the company own filing to the effect that it provides working capital and bills itself as a merchant cash advance company, which is as close to a business model statement as the sweep obtained. The sweep found no state or federal enforcement action, and private litigation, including a 2019 Minnesota federal case preserved in the court opinion, is not an enforcement action. The parked domain, which optimists will read as a technical lapse, means no current terms can be checked. Whether the silence signals anything beyond neglect is a question the sweep cannot answer, and counsel works from the agreement itself.

Forward Financing

Forward Financing LLC of Boston, at 53 State Street, states its menu without adornment, from revenue based financing to business loans for any business purpose, with decisions within hours and same day funding in many cases.

Rarely does the caption name only the company, since a lawsuit converts a payment dispute into a court calendar in order to compel an answer. No enforcement action surfaced on this name, so far as the sweep could determine.

The agreement will name the parties, and the caption on the lawsuit should match it.

Richmond Capital Group

The list closes with RCG Advances LLC, formerly known as Richmond Capital Group LLC and also doing business as Viceroy Capital Funding and Ram Capital Funding, which advanced merchant cash to small businesses and nonprofits until regulators ended the operation.

The outcome was extremely expensive for the principals, which is precisely the point.
