The Illinois owner who signed stacked advances confronts a creditor playbook written for speed, and the statutes answer speed with procedure, from lien proof through deception remedies to exemption schedules the collector cannot move.

Seven Illinois authorities compose the position below, taken in file order.

Secured Transactions Under Illinois Article 9

Every funding dispute in Illinois begins with a filing search. Under the Illinois secured transactions article, citable as Uniform Commercial Code Secured Transactions, a funder that asserts rights in receivables or equipment must establish creation, perfection, and priority, and the question whether an MCA seller holds an enforceable lien or only an unsecured contract claim sets the price of the entire workout.

Counsel should protect and preserve that distinction before discussing balances. We ensure the filings are pulled before any admission, even briefly made, concedes a lien the records do not support.

Deceptive Practices Under the Consumer Fraud Act

Section 2 of the Consumer Fraud and Deceptive Business Practices Act declares unlawful any unfair method of competition and any unfair or deceptive act in trade or commerce, enumerating deception, fraud, false pretense, false promise, misrepresentation, and concealment of material fact with intent that others rely, whether or not any person was misled in fact.

The funder structured its disclosures in order to keep the true cost of the advance out of the room, and a funding agreement sold through factor rates quoted as fees, reconciliation clauses that never reconcile, and renewal promises that evaporate on funding day supplies the material for a counterclaim that reprices the negotiation. What a seller chooses to disclose, or to withhold, sets the cost of all that follows.

The deception claim is not an ornament on the settlement demand. It is the demand.

The Interest Act and Its Commercial Carve Outs

Nine percent is the lawful rate on written contracts for money loaned or due, and then the carve outs arrive in sequence: banks and savings institutions may agree with borrowers on any rate, and any rate is lawful, except as provided in the Predatory Loan Prevention Act, for loans to corporations and other listed commercial transactions, a structure that supplies the baseline in one clause and hands the funder the exemption it will cite on the first call.

That frame is the whole usury fight in one paragraph, and counsel reads it twice, once for the ceiling the owner can invoke and once for the corporate exception the collector will invoke, because the side that names both provisions first controls the rate argument for the rest of the matter.

Exempt Property and the Wage Deduction Ceiling

Statutes ring fence the owner operator livelihood while the business debt is negotiated. Enumerated personal property stands exempt from judgment, attachment, or distress for rent, including necessary apparel and family effects, up to four thousand dollars of other property equity, up to two thousand four hundred dollars in one motor vehicle, up to one thousand five hundred dollars in trade implements and professional books, prescribed health aids, qualifying life insurance and annuity values, and rights to Social Security, unemployment, veterans, disability, support, and capped personal injury recoveries.

Wages receive their own ceiling. Deduction orders for any work week reach only the lesser of fifteen percent of gross pay or the amount by which disposable earnings exceed forty five times the applicable minimum wage, so the garnishment threat against an owner employee paycheck carries a number before the creditor finishes the sentence. There are exceptions, though in practice they tend to confirm the rule.

Confession of Judgment in Commercial Paper

Illinois tolerates confession clauses in commercial paper and polices them at the courthouse door. Under the confession of judgment provision, a person may confess judgment for a bona fide debt in person or through an authorized attorney, yet the application must be made in the county of execution, a defendant residence, or where a defendant property sits, or the judgment is void, and no power to confess given after late September of 1979 in a consumer transaction holds any validity, with judgments entered on such powers unenforceable.

MCA confession clauses survive only where they satisfy the venue and bona fide debt conditions, and debtor counsel attacks both. The venue was proper. The debt was not bona fide. demanding the execution county record and testing whether the confessed sum reflects a bona fide debt or a stack of unexplained fees. Most buyers of receivables know to the dollar what they purchased. They prefer the file unexamined.

Receivership Bonds and Suits Against Receivers

A receiver motion costs the movant money before it costs the owner control. The applicant posts bond to the adverse party covering damages and attorney fees should the appointment be set aside, a condition waivable for good cause after notice and hearing, while receivers carrying on the business may be sued for their acts without prior leave, subject to the appointing court jurisdiction.

The bonding cost disciplines motions drafted for intimidation rather than administration. An owner who answers with a damages estimate and a draft bond objection changes the subject from surrender to expense.

When the Collector Was Never Licensed

The appellate decision in LVNV Funding against Trice supplies the sharpest instrument in the file. Where the legislature criminalized collection activity by an unregistered agency, the court held that legislative intent voids any judgment entered in favor of the unregistered agency, voidness rather than voidability being the consequence, reversing the denial of the debtor motion to vacate, so proof that a receivables buyer sued while unlicensed erases the resulting judgment rather than supplying a defense to be argued.

The docket in a Cook County file showed three collection suits by one buyer in a single spring, none of them preceded by registration, a pattern the motion to vacate laid out exhibit by exhibit across a nineteen page filing the judge read from the bench. Registration first, negotiation later. The motion itself costs little beyond the exhibit work, yet its effect on the remaining portfolio is disproportionate, because a buyer that loses one judgment to voidness discounts every sibling file in the same drawer. Whether later legislatures will soften that voidness rule or extend it remains unanswered in the reports, and counsel files the vacatur motion while the question stays open.

Delancey Street, a settlement company rather than a law firm, provides a confidential review of Illinois funding exposure while independent counsel resolves the legal questions, and an owner can open that review through Delancey Street.

The statutes apportion protection before any collector calls. An owner who maps perfection, deception, rate, exemption, venue, bond, and registration before answering the first demand negotiates from the text rather than from fear, and the text in Illinois rewards the party who read it first.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
