The MCA funder that files first in Nevada often owns less than the filing suggests.

Before the first demand letter arrives, before counsel for the funder measures the confession clause against Nevada procedure, the owner who has read seven statutes regards the dispute from a steadier position.

Nevada sets no general ceiling on business credit rates, so the contest moves from price to conduct, from conduct to licensure, and from licensure to the priority of the filings themselves, and seven authorities set the terms in the order a restructuring actually uses them.

Nevada Secured Transactions Under NRS 104.9101

Nevada secured transactions gateway opens the article that governs security interests in personal property and fixtures with sales of accounts and chattel paper, and every MCA filing in the state answers to it.

After the filing appears on the record, the agreement behind the filing decides its weight, because the statute supplies the system of filing, perfection, and priority while the contract supplies the obligation the system protects, and no stack of filings can enlarge an obligation the agreement never created.

Most funders file early and read the filing as ownership. Lien stacks of this kind invite review of perfection, though funders continue to file them as if no owner will test the order.

A filing perfects nothing beyond what the underlying agreement supports.

Control claims over deposit accounts and proceeds arguments the funder will use against the business meet the same test. Perfection turns on the filed record.

What Counts as Deception

False numbers cost more than true ones.

NRS 598.0915 defines the deceptive trade practice through enumerated acts in the course of business or occupation, from passing off and false representations of source or quality to bait advertising and undisclosed cost offers dressed as free, and false payoff statements with phantom fees in MCA collection and workout communications sit within these categories.

The prohibition covers, if precision matters, communications that misrepresent legal authority the sender does not hold, including threats drafted in order to suggest remedies the filer cannot obtain.

Enhanced penalties follow under NRS 598.0973, which permits civil penalties of $25,000 per violation directed at an elderly person and $15,000 per violation directed at a person with disability, and the provision evidences the Attorney General and Director enforcement apparatus behind the prohibition (the published actions remain few, which is part of the problem).

That schedule prices misconduct into settlement.

Whether a given workout letter crosses the line is a question the correspondence itself must answer.

Agreed Interest Rates Under NRS 99.050

Parties may agree in writing to any rate of interest on money due or to become due, with compounding and charges as specified, and subsection 2 caps only covered servicemember and dependent consumer credit at the lesser of 36 percent APR or the federal cap.

Nevada permits the rate. The state punishes the false statement about the rate. The result is a peculiar asymmetry: the rate is free and the false statement is costly. That changes the arithmetic.

There are exceptions, though in practice they confirm the narrowness of the exception rather than widen it.

The written term controls, and the rest follows from the written term.

The owner agrees to the rate and then discovers the rate was never the dispute.

Usury arguments against MCA pricing are extremely narrow here, so restructuring leans on deception, licensing, and lien defenses instead. Simply preserve the executed agreement and every statement of the balance, and resist the urge to answer a demand letter with admissions, even casually.

Property Exempt From Execution

NRS 21.090 reserves an extensive schedule from execution, and Nevada execution exemption schedule lists the categories with values that bound recovery.

The schedule covers household goods and personal effects with trade tools, inventory, and professional libraries within stated values, plus one vehicle to an equity limit and tiered protection of disposable earnings keyed to a weekly threshold of $770 and the federal minimum wage.

These caps set the settlement arithmetic. Counsel should confirm current figures on the live code before pleading them.

Most owners discover these exemptions after the levy. The arithmetic that remains after the exemptions is the ground where negotiation starts, or should.

Confession Practice and the Collector License

A confession entered without action can still undo an owner who ignores it.

NRS 17.090 authorizes judgment by confession for money due or to become due or to secure contingent liability, through a written defendant statement with clerk filing and endorsement on the judgment roll, so MCA confession clauses are presumptively enforceable and challenges must target compliance with the procedure of sections 17.100 through 17.110 or the carve outs stated by other law.

The confession clause sits in the agreement the way a sealed letter sits in a drawer, present and unexamined until the day it is opened.

Steps the owner takes, or does not take, in the first weeks decide how much of this framework remains available. NRS 649.020 defines the collection agency as any person engaged, as a primary or secondary pursuit, in collecting or soliciting claims owed to another, with carve outs for in house staff, banks, attorneys in usual practice, originators servicing their own claims, and the official chapter table confirms the licensing spine with bond and debt buyer provisions, so third party servicers and debt buyers must clear this regime before collecting in Nevada.

Rarely does a single filing decide the priority contest, so counsel reviews the agreement, tests the perfection, and answers the lien claim with the arithmetic behind it. Delancey Street, a private business debt relief company based in New York and not a law firm, reviews MCA positions of this kind through a confidential initial review and coordinates with independently licensed counsel for legal work, because review and analysis must precede negotiation. The objective is to ensure no statement about the balance goes out without counsel present, and to ensure the response protects and preserves every defense the statutes allow.

These statutes reward preparation more than position.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
